Writ Petition No. 66572 of 2009\n\n                                Ashok Kumar Sureka\n\n                                      Versus\n\n                       Shiv Shankar Shukla and others\n\nHon'ble V.K.Shukla,J\n      Present writ petition has been filed by petitioner questioning the\nvalidity of the order dated 12.11.2009 wherein application moved by the\npetitioner supported by application under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of Limitation Act has\nbeen rejected for setting aside exparte award passed in Motor Accident\nClaim Petition No. 327 of 2006.\n      Brief background of the case is that Motor Accident Claim Petition No.\n327 of 2006 had been filed wherein petitioner has been impleaded and\narrayed as respondent no. 1. On 25.04.2006 in the said claim petition<\/pre>\n<p id=\"p_1\">notices were issued. Said notices were duly served and on behalf of<br \/>\npetitioner Ashok Kumar Sureka, Sri V.K. Mishra, Advocate has entered<br \/>\nappearance by filing authority memo on 15.11.2006 and requested for<br \/>\nsupplying copy of the claim petition and on the said request         requisite<br \/>\norders were passed. Other co-respondents namely respondent nos. 2 and 3<br \/>\nfiled their written statement and as far as petitioner is concerned no written<br \/>\nstatement has been filed on his behalf. On 30.07.2007 orders were passed<br \/>\nto proceed exparte and then issues were framed on 16.08.2007. As far as<br \/>\npetitioner is concerned repeated adjournment has been taken from his side<br \/>\nand ultimately award in question has been passed and said award in<br \/>\nquestion was sought to be executed then application had been moved for<br \/>\nsetting aside said exparte award supported by application under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of<br \/>\nLimitation Act. Said application in question has been rejected. At this<br \/>\njuncture present writ petition has been filed.\n<\/p>\n<p id=\"p_1\">      On 16.12.2009 learned counsel for the petitioner has stated that he<br \/>\nwas ready to deposit a sum of Rs. 75,000\/- before the Tribunal within two<br \/>\nweeks, in this background this Court directed the present writ petition for<br \/>\nlisting today i.e.11.01.2010.\n<\/p>\n<p id=\"p_2\">      Affidavit in support of deposit has also been filed.<br \/>\n      Learned counsel for the petitioner Sri Y.S. Sachan, contended with<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                       2<\/span><\/p>\n<p>vehemence that in the present case opinion which has been formed by<br \/>\nAdditional District Judge, Court No. 5 Kanpur Nagar while rejected the<br \/>\napplication under <a href=\"\/doc\/100581\/\" id=\"a_2\">Section 5<\/a> of Limitation Act is totally arbitrary and<br \/>\nerroneous opinion and for ends of justice order in question should be<br \/>\nquashed, opportunity should be afforded to the petitioner.\n<\/p>\n<p id=\"p_3\">      After respective arguments have been advanced factual position<br \/>\nwhich is emerging in the present case is that claim petition was filed on<br \/>\n25.04.2006. Notices were issued and on behalf of petitioner his counsel Sri<br \/>\nV.K.Mishra, Advocate has entered appearance and had made request for<br \/>\nsupplying copy of claim petition and on the said request requisite orders<br \/>\nhave been passed. Other co-respondents no. 2 and 3 had filed their reply.<br \/>\nOn 30.07.2007 looking into the conduct of the petitioner orders were passed<br \/>\nto proceed exparte. Issues were framed on 16.08.2007 and on the said date<br \/>\nno one had entered appearance on behalf of petitioner and whenever dates<br \/>\nwere fixed in future repeated adjournment has been sought for on behalf of<br \/>\npetitioner through different counsels whose names have been referred to in<br \/>\nthe impugned order. Evidence has been concluded and judgement has been<br \/>\ndelivered and thereafter execution proceedings has been undertaken then<br \/>\nsuch a request has come forward. Motor Accident Claims Tribunal has taken<br \/>\ninto account the conduct of the petitioner as well as his counsel and clearly<br \/>\nfound that ground which has been set out are totally ingenuine and<br \/>\ninsufficient ground and with these observation said application under<br \/>\n<a href=\"\/doc\/100581\/\" id=\"a_3\">Section 5<\/a> of Limitation Act has been rejected. View taken by Motor Accident<br \/>\nClaims Tribunal cannot be said to be arbitrary view from any point of view<br \/>\nwarranting interference by this Court in exercise of its authority of judicial<br \/>\nreview under <a href=\"\/doc\/1712542\/\" id=\"a_4\">Article 226<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_4\">      Consequently, writ petition as it has been framed and drawn is<br \/>\ndismissed.\n<\/p>\n<p id=\"p_5\">      No order as to cost.\n<\/p>\n<p id=\"p_6\">Dated 11.01.2010<br \/>\nDhruv\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ashok Kumar Sureka vs Shiv Shankar Shukla &amp; Ors. on 11 January, 2010 Court No. 21 Civil Misc.
