JUSTICE R.M.DOSHIT\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 13\/01\/2010  \n \nORAL JUDGMENT<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE K.M.THAKER)<\/p>\n<p>\tThe<br \/>\npetitioner, a public charitable trust, claims to be owner of land<br \/>\nsituate in ward No.7, city Survey No.4542 in Surat city. The<br \/>\npetitioner trust, through its trustee, has challenged, by this<br \/>\npetition, an award dated 20th May 2009 passed under<br \/>\n<a href=\"\/doc\/291273\/\" id=\"a_1\">Section 11<\/a> of the Land Acquisition Act, 1894 {hereinafter referred to<br \/>\nas  the Act } on the ground that the award is malicious,<br \/>\ncapricious and illegal. The petitioner trust has also challenged the<br \/>\nnotice dated 22nd June 2009 issued by the respondent<br \/>\nMunicipal Corporation requiring that the possession of the lands in<br \/>\nquestion should be handed over to the respondent Corporation on or<br \/>\nbefore 7th July 2009.\n<\/p>\n<p id=\"p_1\">\tHeard<br \/>\nMr.Nakrani learned advocate for the petitioners and Mr.P.G.Desai,<br \/>\nlearned senior counsel with Mr.Pandya, learned advocate, for<br \/>\nrespondent corporation.\n<\/p>\n<p id=\"p_2\">\tBe<br \/>\nit noted that the very same award dated 20th May 2009 is<br \/>\nalso challenged by the tenants on the said land, by way of writ<br \/>\npetition being Special Civil Application No.7129 of 2009 which has<br \/>\nbeen disposed of by order dated 13th January 2010. The<br \/>\nlearned advocate for the petitioner has made common submissions with<br \/>\nregard to Special Civil Application No.7129 of 2009, Special Civil<br \/>\nApplication No.7572 of 2009 and Special Civil Application No.7574 of<br \/>\n2009. So as to avoid repetition of the factual background regarding<br \/>\nthe impugned award and the notice impugned in the present petition<br \/>\n(which has been recorded in the order dated 13.1.2010 passed in<br \/>\nSpecial Civil Application No.7129 of 2009),  the same are not<br \/>\nreiterated.\n<\/p>\n<p id=\"p_3\">\tIn<br \/>\npresent petition, the petitioner has relied on the order dated 14th<br \/>\nDecember 2007 by which the petitions being Special Civil Application<br \/>\nNos.5330 of 2007 and 13795 of 2007 (of which reference has been made<br \/>\nin the above said order dated 13.1.2010 passed in Special Civil<br \/>\nApplication No.7129 of 2009), were withdrawn with a view to making<br \/>\nrepresentation for allotment of alternative land. The  petitioner<br \/>\ntrust has also relied upon the order granting ad-interim relief<br \/>\npassed on 14th July 2009 in above mentioned Special Civil<br \/>\nApplication No.7129 of 2009.\n<\/p>\n<p id=\"p_4\">\tAs<br \/>\nnoted in the order dated 13.1.2010 passed in Special Civil<br \/>\nApplication No.7129 of 2009, the notifications under <a href=\"\/doc\/43654\/\" id=\"a_1\">Section 4<\/a> and <a href=\"\/doc\/1792838\/\" id=\"a_2\">6<\/a><br \/>\nof the Act have now culminated into award dated 20th May<br \/>\n2009 passed under <a href=\"\/doc\/291273\/\" id=\"a_3\">Section 11<\/a> of the Act. Besides this, the challenge<br \/>\nagainst the said notifications, at the behest of the tenants, has<br \/>\nearlier failed.\n<\/p>\n<p id=\"p_5\">\tFrom<br \/>\nthe averments in present petition and\/or in Special Civil Application<br \/>\nNo.7129 of 2009 it does not come out clearly as to whether the<br \/>\npetitioner trust had earlier independently challenged the<br \/>\nnotifications under <a href=\"\/doc\/43654\/\" id=\"a_4\">Sections 4<\/a> and <a href=\"\/doc\/1792838\/\" id=\"a_5\">6<\/a> of the Act or not. In any case,<br \/>\nafter the rendition of the award under <a href=\"\/doc\/291273\/\" id=\"a_6\">Section 11<\/a> pursuant to the<br \/>\nnotifications, any challenge by the petitioner against the<br \/>\nacquisition has no relevance.\n<\/p>\n<p id=\"p_6\">\tThe<br \/>\npetitioner trust has claimed that it has shown willingness to give<br \/>\npossession of the land upto 60% of the entire parcel of land in<br \/>\nquestion. When the respondent corporation made the acquisition to<br \/>\nrealize the purpose of reservation in the final development plan the<br \/>\ncontention, at this belated stage, that the District Centre cannot be<br \/>\ntermed as  Public Purpose , is not only untenable but<br \/>\nmisconceived also. Any challenge was not raised by the land owner<br \/>\nagainst the development plan at the relevant time which has<br \/>\nculminated in Final Development Plan 1986.  After rendition of the<br \/>\naward and when the respondent Corporation has already deposited the<br \/>\ncompensation amount and issued notice seeking possession of the lands<br \/>\nin question, in view of <a href=\"\/doc\/562722\/\" id=\"a_7\">Section 16<\/a> of the Act the lands, vest in the<br \/>\nCorporation free from all encumbrances.\n<\/p>\n<p id=\"p_7\">\tDuring<br \/>\nthe hearing it has come out from the submissions of Mr. Nakrani,<br \/>\nlearned advocate, that reference under <a href=\"\/doc\/1517117\/\" id=\"a_8\">Section 18<\/a> seeking enhancement<br \/>\nin the compensation has been made at the best of the land owner.<br \/>\nTherefore also, now there is no justification to entertain any<br \/>\nchallenge, at the best of the land owner, against the impugned award.<br \/>\nFurther, the petitioners have failed to demonstrate any ground or<br \/>\nmaterial to justify, let alone substantiate, the allegation that the<br \/>\nimpugned award is malicious and capricious or illegal. No ground has<br \/>\nbeen made out.\n<\/p>\n<p id=\"p_8\">\tFor<br \/>\nthe aforesaid reasons and the reasons recorded in order dated<br \/>\n13.1.2010 passed in Special Civil Application No.7129 of 2009, the<br \/>\npetition does not deserve to be entertained. The petition, therefore,<br \/>\nfails and is accordingly rejected. No order as to costs. Notice is<br \/>\ndischarged.
