SINGH, J.\n<\/p>\n<p id=\"p_1\">\tThe State of West Bengal has preferred this appeal by<br \/>\nSpecial Leave impugning the judgment and order of the High<br \/>\nCourt of Judicature at Calcutta dated 21st February, 1997 in<br \/>\nCriminal Revision No.2578 of 1994 whereby the High Court<br \/>\nquashed the criminal proceedings against the respondents herein<br \/>\nholding that the 3rd Special Court, Calcutta appointed under the<br \/>\nWest Bengal Criminal Law Amendment (Special Courts) Act,<br \/>\n1949 for trying offences under the <a href=\"\/doc\/1331755\/\" id=\"a_1\">Prevention of Corruption Act<\/a>,<br \/>\n1947 (for short Act of 1947) had no jurisdiction to try the<br \/>\nrespondents for the alleged offences after coming into force of the<br \/>\n<a href=\"\/doc\/1331755\/\" id=\"a_1\">Prevention of Corruption Act<\/a>, 1988 (for short Act of 1988) w.e.f.<br \/>\n9th September, 1998.  In substance, it held that though the said<br \/>\ncourt was earlier empowered to try offences under the Act of 1947,<br \/>\nsince no such jurisdiction was conferred upon it afresh after<br \/>\ncoming into force of the Act of 1988, which repealed the Act of<br \/>\n1947, it had no jurisdiction to try such offences after coming into<br \/>\nforce of the Act of 1988.\n<\/p>\n<p id=\"p_2\">\tThe facts of the case which are not in dispute may be briefly<br \/>\nrecapitulated.  The respondents herein were employees of the State<br \/>\nBank of India and at the relevant time were working in its Netaji<br \/>\nSubhash Road Branch, Calcutta.  A criminal case was registered<br \/>\nagainst them under the provisions of the Act of 1947 as also under<br \/>\n<a href=\"\/doc\/1897847\/\" id=\"a_2\">Sections 120B<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_3\">420<\/a>, <a href=\"\/doc\/1667388\/\" id=\"a_4\">419<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_5\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_6\">468<\/a> and <a href=\"\/doc\/1466184\/\" id=\"a_7\">471<\/a> of the IPC.  The<br \/>\noffences are alleged to have been committed by them in or about<br \/>\nthe month of August, 1988.  A month later, on 9.9.1988 the Act of<br \/>\n1988 came into force repealing the Act of 1947.  A criminal case<br \/>\nwas registered against respondents on 31.10.1988 and a<br \/>\nchargesheet was filed before the Court of the Metropolitan<br \/>\nMagistrate, Calcutta who by his order dated 12.7.1990 took<br \/>\ncognizance and transferred the case to the Metropolitan Magistrate<br \/>\n17th Court for trial.  However, on objection raised by the Public<br \/>\nProsecutor that the said Court had no jurisdiction to try the case as<br \/>\nthe same was exclusively triable by the Special Court, the said case<br \/>\nwas transferred to the Court of the 3rd Special Judge, Calcutta, a<br \/>\nCourt empowered under the West Bengal Criminal Law<br \/>\nAmendment (Special Courts) Act, 1949 to try offences under the<br \/>\nAct of 1947.  The 3rd Special Judge took cognizance on 22nd<br \/>\nMarch, 1993 when the chargesheet was filed before that Court.\n<\/p>\n<p id=\"p_3\">\tThe respondents herein challenged the jurisdiction of the 3rd<br \/>\nSpecial Judge to try the case, as he had not been so empowered<br \/>\nafter coming into force of the <a href=\"\/doc\/1331755\/\" id=\"a_8\">Prevention of Corruption Act<\/a>, 1988.<br \/>\nThe objection was rejected by the Special Court whereafter the<br \/>\nrespondents moved the High Court of Calcutta in its revisional<br \/>\njurisdiction.\n<\/p>\n<p id=\"p_4\">The sole question which arises for consideration before us is<br \/>\nwhether an offence committed while the Act of 1947 was in force<br \/>\ncan be tried by the Courts empowered to try offences under the Act<br \/>\nof 1947 after coming into force of the Act of 1988 w.e.f. 9.9.1988<br \/>\nrepealing the Act of 1947.  The case of the respondents before the<br \/>\nHigh Court was that the Special Courts had been vested with<br \/>\njurisdiction to try cases under the Act of 1947 by the West Bengal<br \/>\nSpecial Courts Act, 1949.  After coming into force of the Act of<br \/>\n1988 no such jurisdiction had been conferred on those courts and,<br \/>\ntherefore, they could not take cognizance or try an offence under<br \/>\nthe corresponding provisions of the Act of 1988.\n<\/p>\n<p id=\"p_5\"> It is, therefore, necessary to notice the relevant<br \/>\nprovisions of the <a href=\"\/doc\/1331755\/\" id=\"a_9\">Prevention of Corruption Act<\/a>, 1947 and the<br \/>\n<a href=\"\/doc\/1331755\/\" id=\"a_10\">Prevention of Corruption Act<\/a>, 1988 as also other legal provisions<br \/>\nwhich have a bearing on this subject.  <a href=\"\/doc\/616856\/\" id=\"a_11\">Section 5<\/a> of the Act of 1947<br \/>\ndefines misconduct while <a href=\"\/doc\/1331755\/\" id=\"a_12\">Section 5A<\/a> enumerates the Police<br \/>\nOfficers who shall investigate any offence punishable under<br \/>\n<a href=\"\/doc\/616856\/\" id=\"a_13\">Section 5<\/a> of the Act.  <a href=\"\/doc\/258943\/\" id=\"a_14\">Section 6<\/a> of the Criminal Law Amendment<br \/>\nAct, 1952, a <a href=\"\/doc\/110162683\/\" id=\"a_15\">Central Act<\/a>, provided for appointment of Special<br \/>\nJudges for trying offences under the Act of 1947, but so far the<br \/>\nState of West Bengal is concerned, by reason of the West Bengal<br \/>\nCriminal Law Amendment (Special courts) <a href=\"\/doc\/1596533\/\" id=\"a_16\">Amending Act<\/a>, 1953,<br \/>\n<a href=\"\/doc\/1028936\/\" id=\"a_17\">Sections 5<\/a> to <a href=\"\/doc\/1028936\/\" id=\"a_18\">10<\/a> of the Criminal Law (Amendment), Act, 1952<br \/>\nwere made inapplicable to the State of West Bengal.  Therefore,<br \/>\nSpecial Judges under the <a href=\"\/doc\/258943\/\" id=\"a_19\">Criminal Law (Amendment) Act<\/a>, 1952<br \/>\nwere not appointed in the State of West Bengal.  However, by the<br \/>\nWest Bengal Criminal Law Amendment (Special Courts) Act,<br \/>\n1949, the Provincial Government was empowered by Notification<br \/>\nin the Official Gazette to constitute Special Courts of Criminal<br \/>\nJurisdiction and from time to time by Notification in the Official<br \/>\nGazette to allot cases for trial to a Special Judge.  The Special<br \/>\nJudge had jurisdiction to try the cases for offences specified in the<br \/>\nSchedule to the Act which included an offence punishable under<br \/>\n<a href=\"\/doc\/616856\/\" id=\"a_20\">Section 5<\/a> of the Act of 1947.\n<\/p>\n<p id=\"p_6\">\tIt is thus apparent from the above provisions that the offence<br \/>\nunder <a href=\"\/doc\/616856\/\" id=\"a_21\">Section 5<\/a> of the Act of 1947 was made exclusively triable by<br \/>\na Special Judge appointed under the West Bengal Criminal Law<br \/>\nAmendment (Special Courts) Act, 1949.   It is not in dispute that<br \/>\nthe 3rd Special Judge before whom the respondents had been put up<br \/>\nfor trial was a Court vested with such jurisdiction.\n<\/p>\n<p id=\"p_7\">\t<a href=\"\/doc\/1331755\/\" id=\"a_22\">The Prevention of Corruption Act<\/a>, 1988 came into effect<br \/>\nfrom 9th September, 1988.  <a href=\"\/doc\/581728\/\" id=\"a_23\">Section 3<\/a> of the Act of 1988 empowers<br \/>\nthe Central Government or the State Government by Notification<br \/>\nin the Official Gazette to appoint as many Special Judges as may<br \/>\nbe necessary for such area or areas or for such case or group of<br \/>\ncases as may be specified in the Notification to try the offences<br \/>\nmentioned therein, which includes any offence punishable under<br \/>\nthe Act of 1988.  <a href=\"\/doc\/731949\/\" id=\"a_24\">Section 4<\/a> makes such cases exclusively triable by<br \/>\na Special Judge.  <a href=\"\/doc\/616856\/\" id=\"a_25\">Section 5<\/a> confers jurisdiction on the Special<br \/>\nJudge to take cognizance of offences without the accused being<br \/>\ncommitted to him for trial and, in trying the accused persons to<br \/>\nfollow the procedure prescribed by<a href=\"\/doc\/1569253\/\" id=\"a_26\"> the Code<\/a> of Criminal<br \/>\nProcedure, 1973 for the trial of warrant cases by the Magistrates.<br \/>\n<a href=\"\/doc\/1439469\/\" id=\"a_27\">Section 26<\/a> and <a href=\"\/doc\/1960291\/\" id=\"a_28\">30<\/a> of the said Act are relevant which read as<br \/>\nfollows:-\n<\/p>\n<p id=\"p_8\">&#8220;Sec. 26 &#8211;  Special Judges appointed under Act<br \/>\n46 of 1952 to be special Judges appointed under<br \/>\nthis Act  Every special Judge appointed under the<br \/>\n<a href=\"\/doc\/258943\/\" id=\"a_29\">Criminal Law Amendment Act<\/a>, 1952 for any area<br \/>\nor areas and is holding office on the<br \/>\ncommencement of this Act shall be deemed to be a<br \/>\nspecial Judge appointed under <a href=\"\/doc\/581728\/\" id=\"a_30\">section 3<\/a> of this Act<br \/>\nfor that area or areas and, accordingly, on and from<br \/>\nsuch commencement, every such Judge shall<br \/>\ncontinue to deal with all the proceedings pending<br \/>\nbefore him on such commencement in accordance<br \/>\nwith the provisions of this Act.&#8221;\n<\/p>\n<p id=\"p_9\">&#8220;Sec. 30 Repeal  and saving : &#8211; (1) <a href=\"\/doc\/1331755\/\" id=\"a_31\">The<br \/>\nPrevention of Corruption Act<\/a>, 1947 (2 of 1947)<br \/>\nand the <a href=\"\/doc\/258943\/\" id=\"a_32\">Criminal Law Amendment Act<\/a>, 1952 (46<br \/>\nof 1952) are hereby repealed.\n<\/p>\n<p id=\"p_10\">\t(2) Notwithstanding such repeal, but without<br \/>\nprejudice to the application of <a href=\"\/doc\/1030013\/\" id=\"a_33\">section 6<\/a> of the<br \/>\nGeneral Clauses Act, 1897 (10 of 1897), anything<br \/>\ndone or any action taken or purported to have been<br \/>\ndone or taken under or in pursuance of the Acts so<br \/>\nrepealed shall, insofar as it is not inconsistent with<br \/>\nthe provisions of this Act, be deemed to have been<br \/>\ndone or taken under or in pursuance of the<br \/>\ncorresponding provisions of this Act.&#8221;\n<\/p>\n<p id=\"p_11\">\tAs earlier noticed in the State of West Bengal no Special<br \/>\nJudge was appointed under the <a href=\"\/doc\/258943\/\" id=\"a_34\">Criminal Law Amendment Act<\/a>,<br \/>\n1952 to try offences under the Act of 1947.  However, Special<br \/>\nJudges were appointed under the West Bengal Criminal Law<br \/>\nAmendment (Special Courts) Act, 1949 to try offences under the<br \/>\n<a href=\"\/doc\/1331755\/\" id=\"a_35\">Prevention of Corruption Act<\/a> of 1947.\n<\/p>\n<p id=\"p_12\">\tThe High Court took the view that <a href=\"\/doc\/581728\/\" id=\"a_36\">Section 3<\/a> and <a href=\"\/doc\/731949\/\" id=\"a_37\">4<\/a> of the<br \/>\nAct of 1988 clearly provided that an offence punishable under the<br \/>\nAct of 1988 was triable only by a Special Judge appointed under<br \/>\n<a href=\"\/doc\/581728\/\" id=\"a_38\">Section 3<\/a> of the said Act and not by any other Court,<br \/>\nnotwithstanding anything contained in any other law for the time<br \/>\nbeing inforce.  <a href=\"\/doc\/1439469\/\" id=\"a_39\">Section 26<\/a> of the Act of 1988 only protected the<br \/>\nappointment of Special Judges under <a href=\"\/doc\/313868\/\" id=\"a_40\">Section 5<\/a> of the Criminal<br \/>\nLaw Amendment Act, 1952 and not the appointment of Special<br \/>\nJudges made under any other Act such as the West Bengal<br \/>\nCriminal Law Amendment (Special Courts) Act, 1949.  <a href=\"\/doc\/1331755\/\" id=\"a_41\">The Act<\/a> of<br \/>\n1988  being a Central Legislation had overriding effect over the<br \/>\nprovisions of the West Bengal Criminal Law Amendment (Special<br \/>\nCourts) Act, 1949.  The learned Judge following earlier decisions<br \/>\nof the Court held that taking cognizance of an offence under the<br \/>\nprovisions of the Act of 1988 by a Special Judge appointed under<br \/>\nSection 2 of the West Bengal Criminal Law (Special Courts) Act,<br \/>\n1949 was not permissible in law and, therefore, the order taking<br \/>\ncognizance was bad, illegal and without jurisdiction.\n<\/p>\n<p id=\"p_13\">\tReliance was placed by the appellant on Notification<br \/>\nNo.6614-J dated 23rd April, 1993 issued by the Government of<br \/>\nWest Bengal for appointment of Special Judges under Sub-section<br \/>\n(1) of <a href=\"\/doc\/581728\/\" id=\"a_42\">Section 3<\/a> of the Act of 1988.   By the said notification all the<br \/>\nJudges or Special Courts appointed under Sub-section (2) of<br \/>\n<a href=\"\/doc\/62140\/\" id=\"a_43\">Section 2<\/a> read with sub-section (1) of Section 9 of the West Bengal<br \/>\nCriminal Law Amendment (Special Courts) Act, 1949 and<br \/>\nfunctioning as such Judges were appointed as Special Judges under<br \/>\nthe Act of 1988 for the purpose of trial of offences as enumerated<br \/>\nin Clauses (a) and (b) of sub-section (1) of <a href=\"\/doc\/581728\/\" id=\"a_44\">Section 3<\/a> of the Act of<br \/>\n1988 in respect of the areas of their respective Courts.  The<br \/>\ncontention of the appellant was rejected by the learned Judge<br \/>\nholding that the Notification which in effect gave retrospective<br \/>\noperation to <a href=\"\/doc\/581728\/\" id=\"a_45\">Section 3<\/a> of the Act of 1988 was not legal and<br \/>\npermissible in law, and that if such effect had to be given it could<br \/>\nbe done by a Central Legislation, and not by a Government<br \/>\nNotification, since the Notification could not override the<br \/>\nprovisions of law.  In this view of the matter the High Court<br \/>\nallowed the Revision Petition and quashed the criminal proceeding<br \/>\nagainst the respondents.\n<\/p>\n<p id=\"p_14\">When the appeal was first argued before us on 6th April,<br \/>\n2004, it was argued on the basis of the provisions of the various<br \/>\nstatues noticed by the High Court, and counsel for the respondents<br \/>\nsubmitted before us that the proceeding had been rightly quashed<br \/>\nby the High Court for lack of jurisdiction in the Court trying them.<br \/>\nOn the other hand, counsel for the appellant &#8211; State submitted that<br \/>\nthe High Court was in error in quashing the proceeding. Relying<br \/>\nupon the Notification of 23.4.1993, it was contended that in any<br \/>\nevent the Courts had been vested with jurisdiction to try offences<br \/>\nunder the Act of 1988 by the said Notification.  In the alternative,<br \/>\nit was submitted that even if the Court came to the conclusion that<br \/>\nno court had been vested with jurisdiction to try offences under the<br \/>\nAct of 1988, rather than quashing the prosecution the same could<br \/>\nhave been kept in abeyance till such time as special courts were<br \/>\nempowered to try such offences.  It is the submission of the<br \/>\ncounsel for the State that an offence committed under the Act of<br \/>\n1947 does not stand obliterated by the repeal of the Act of 1947,<br \/>\nand indeed it could be tried under the corresponding provisions of<br \/>\nthe Act of 1988.  The only question was about the jurisdiction of<br \/>\nthe Court to try an offence under the Act of 1947 after coming into<br \/>\nforce of the Act of 1988.\n<\/p>\n<p id=\"p_15\">Later, it was brought to our notice by the counsel for the<br \/>\nappellant that the West Bengal Legislature has enacted an Act<br \/>\nknown as the Prevention of Corruption (West Bengal Amendment)<br \/>\nAct, 1994.  It was published in the Calcutta Gazette on 23rd<br \/>\nDecember, 1999.  The said enactment was not brought to the<br \/>\nnotice of the High Court, nor to our notice when the matter was<br \/>\nfirst argued. We, therefore, reheard the matter and afforded an<br \/>\nopportunity to counsel for the parties to make their<br \/>\nsubmissions on the basis of the new enactment brought to our<br \/>\nnotice.\n<\/p>\n<p id=\"p_16\">By Section 2 of the Prevention of Corruption (West<br \/>\nBengal Amendment) Act, 1994 <a href=\"\/doc\/688958\/\" id=\"a_46\">West Bengal Act<\/a> No.LVI of<br \/>\n1994, the <a href=\"\/doc\/1331755\/\" id=\"a_47\">Prevention of Corruption Act<\/a>, 1988 in its application<br \/>\nto the State of West Bengal stands amended for the purpose<br \/>\nand in the manner provided under the Act.  <a href=\"\/doc\/1331755\/\" id=\"a_48\">In the Act<\/a> of 1988,<br \/>\n<a href=\"\/doc\/1331755\/\" id=\"a_49\">Section 26A<\/a> has been inserted which is as follows:-\n<\/p>\n<p id=\"p_17\">&#8220;26A- Judges appointed to preside over Special<br \/>\nCourts under <a href=\"\/doc\/688958\/\" id=\"a_50\">West Bengal Act<\/a> 21 of 1949 to be<br \/>\ndeemed to be Special Judges appointed under<br \/>\nthis Act.- (1) Every Judge appointed to preside<br \/>\nover a Special Court under the West Bengal<br \/>\nCriminal Law Amendment (Special Courts) Act,<br \/>\n1949 (West Ben. Act 21 of 1949), for any area or<br \/>\nareas and holding office on the commencement of<br \/>\nthis Act shall be deemed to be a special Judge<br \/>\nappointed under <a href=\"\/doc\/581728\/\" id=\"a_51\">section 3<\/a> of this Act for that area<br \/>\nor areas and, accordingly, on and from such<br \/>\ncommencement every such Judge shall continue to<br \/>\ndeal with all the proceedings pending before him<br \/>\non such commencement in accordance with the<br \/>\nprovisions of this Act.\n<\/p>\n<p id=\"p_18\">\t(2) Every Judge appointed to preside over a<br \/>\nSpecial Court under the West Bengal Criminal<br \/>\nLaw Amendment (Special Courts) Act, 1949, for<br \/>\nany area or areas, holding office on any date after<br \/>\nthe commencement of this Act but before the<br \/>\ncommencement of the Prevention of Corruption<br \/>\n(West Bengal Amendment) Act, 1994 (hereinafter<br \/>\nreferred to as the said date) and purporting to act<br \/>\nunder the provisions of this Act, shall be deemed<br \/>\nto be a Special Judge appointed under <a href=\"\/doc\/581728\/\" id=\"a_52\">section 3<\/a> of<br \/>\nthis Act, for that area or areas and, accordingly, on<br \/>\nand from the said date, every such Judge shall<br \/>\ncontinue to deal with all the proceedings pending<br \/>\nbefore him on the said date in accordance with the<br \/>\nprovisions of the Act&#8221;.\n<\/p>\n<p id=\"p_19\">\tSection 4 of the West Bengal Amendment Act, 1994<br \/>\nprovides as follows:-\n<\/p>\n<p id=\"p_20\">\t&#8220;4. Saving and validation<br \/>\nNotwithstanding anything contained in the<br \/>\nprincipal Act or in any other law for the time being<br \/>\nin force, any order passed, any evidence recorded,<br \/>\nor any action taken under the principal Act by a<br \/>\nJudge of Special Court appointed under the West<br \/>\nBengal Criminal Law Amendment (Special<br \/>\nCourts) Act, 1949, and purporting to act under the<br \/>\nprovisions of the principal Act, before the<br \/>\ncommencement of this Act shall be deemed to<br \/>\nhave been validly passed, recorded or taken under<br \/>\nthe principal Act as amended by this Act as if this<br \/>\nAct were in force when such order was passed or<br \/>\nsuch evidence was recorded or such action was<br \/>\ntaken&#8221;.\n<\/p>\n<p id=\"p_21\">\tSub-section (1) of <a href=\"\/doc\/1331755\/\" id=\"a_53\">Section 26A<\/a> relates to Judges appointed<br \/>\nto preside over  Special Courts under the West Bengal Special<br \/>\nCourts Act, 1949 holding office on the commencement of the Act<br \/>\nof 1988.  They are deemed to be Special Judges appointed under<br \/>\n<a href=\"\/doc\/581728\/\" id=\"a_54\">Section 3<\/a> of the Act of 1988 and, accordingly, on and from such<br \/>\ncommencement they shall continue to deal with all the proceedings<br \/>\npending before them on commencement of the Act of 1988 in<br \/>\naccordance with the provisions of the Act of 1988.\n<\/p>\n<p id=\"p_22\">\tSub-section (2) of <a href=\"\/doc\/1331755\/\" id=\"a_55\">Section 26A<\/a> relates to Judges appointed<br \/>\nunder the West Bengal Special Courts Act, 1949 and holding<br \/>\noffice on any date after the commencement of the Act of 1988 but<br \/>\nbefore the commencement of the <a href=\"\/doc\/1210757\/\" id=\"a_56\">Amendment Act<\/a> of 1994.  Such<br \/>\nSpecial Judges purporting to act under the provisions of the Act of<br \/>\n1988 are deemed to be Special Judges appointed under <a href=\"\/doc\/581728\/\" id=\"a_57\">Section 3<\/a><br \/>\nof the Act of 1988. Accordingly, on and from the said date, every<br \/>\nsuch Judge shall continue to deal with all the proceedings pending<br \/>\nbefore him on the said date in accordance with the provisions of<br \/>\nthe Act of 1988.\n<\/p>\n<p id=\"p_23\">\tIt thus appears that sub-section (1) in its application is<br \/>\nconfined to a Special Judge appointed under the West Bengal<br \/>\nSpecial Courts Act, 1949 before the date of commencement of the<br \/>\nAct of 1988, while sub-section (2) confers jurisdiction on a Judge<br \/>\nappointed under the West Bengal Special Courts Act, 1949 on any<br \/>\ndate after the commencement of the Act of 1988 but before the<br \/>\ncommencement of the <a href=\"\/doc\/1210757\/\" id=\"a_58\">Amendment Act<\/a> of 1994.  In both cases<br \/>\nthey are deemed to be Special Judges appointed under <a href=\"\/doc\/581728\/\" id=\"a_59\">Section 3<\/a> of<br \/>\nthe Act of 1988 and are empowered to continue to deal with all the<br \/>\nproceedings pending before them in accordance with the<br \/>\nprovisions of the Act of 1988.\n<\/p>\n<p id=\"p_24\">\tSection 4 of the West Bengal Amendment Act, 1994 begins<br \/>\nwith a non obstante clause and seeks to save and validate any order<br \/>\npassed, any evidence recorded or any action taken under the Act of<br \/>\n1988 by a Judge of Special Court appointed under the West Bengal<br \/>\nSpecial Courts Act, 1949 while purporting to Act under the<br \/>\nprovisions of the Act of 1988 before the commencement of the<br \/>\nWest Bengal Amendment Act of 1994.  It is further provided that<br \/>\nall such orders passed, evidence recorded or actions taken shall be<br \/>\ndeemed to have been validly passed, recorded or taken under the<br \/>\nAct of 1988 as amended by the West Bengal Amendment Act,<br \/>\n1994 as if the latter Act was in force when such action was taken.\n<\/p>\n<p id=\"p_25\">\tWe have, therefore, no doubt that the West Bengal<br \/>\nAmendment Act, 1994 by inserting <a href=\"\/doc\/1331755\/\" id=\"a_60\">Section 26A<\/a> in the Act of 1988<br \/>\nhas created a legal fiction whereby a Special Judge appointed<br \/>\nunder the West Bengal Special Courts Act, 1949 even before the<br \/>\ncommencement of the Act of 1988, or thereafter, but before the<br \/>\ncommencement of the West Bengal Amendment Act, 1994, is<br \/>\ndeemed to be a Special Judge appointed under <a href=\"\/doc\/581728\/\" id=\"a_61\">Section 3<\/a> of the<br \/>\nPrevention of Corruption Act, 1988 and consequently empowered<br \/>\nto continue to deal with all the proceedings pending before him on<br \/>\nthe relevant date in accordance with the provisions of the Act.<br \/>\nSection 4 of the West Bengal Amendment Act, 1994 saves and<br \/>\nvalidates all actions taken by such Special Judges purporting to act<br \/>\nunder the provisions of the <a href=\"\/doc\/1331755\/\" id=\"a_62\">Prevention of Corruption Act<\/a>, 1988 as<br \/>\nif the West Bengal Amendment Act, 1994 was in force when such<br \/>\norder was passed or such evidence was recorded or such action<br \/>\nwas taken.  So viewed, the provisions of the West Bengal<br \/>\nAmendment Act, 1994 provide a complete answer to the<br \/>\ncontentions raised before us by learned counsel for the<br \/>\nrespondents.\n<\/p>\n<p id=\"p_26\">\tIn view of the provisions of the West Bengal Amendment<br \/>\nAct of 1994, we have no doubt that the Special Judge trying the<br \/>\naccused\/respondents and who was appointed under the West<br \/>\nBengal Special Courts Act, 1949 and purported to act under the<br \/>\nAct of 1988, is now vested with jurisdiction to try cases under the<br \/>\n<a href=\"\/doc\/1331755\/\" id=\"a_63\">Prevention of Corruption Act<\/a>, and by operation of law all actions<br \/>\ntaken by him purporting to act under the Act of 1988 are saved and<br \/>\nvalidated as if the <a href=\"\/doc\/1210757\/\" id=\"a_64\">Amendment Act<\/a> of 1994 were in force when<br \/>\nsuch an order was passed or such evidence was recorded or such<br \/>\naction was taken by him.  Giving effect to the legal fiction we must<br \/>\nimagine that <a href=\"\/doc\/1331755\/\" id=\"a_65\">Section 26A<\/a> stood incorporated in the Act of 1988<br \/>\nwhen it came into effect.\n<\/p>\n<p id=\"p_27\">\tCounsel for the respondents submitted that the fiction<br \/>\ncreated by the West Bengal Amendment Act, 1994 should not be<br \/>\ngiven an extended operation.  In considering such a statute, the<br \/>\nCourt must consider what is the fiction created, what is its purpose,<br \/>\nand what is its effect.  He further submitted that on a fair reading<br \/>\nof the provisions of the Act of 1988 as amended by the West<br \/>\nBengal Amendment Act of 1994, only those proceedings are saved<br \/>\nwhich were pending before the Special Judge on the date of<br \/>\ncommencement of the 1988 Act i.e. on 9th September, 1988.  In<br \/>\nthis case on the relevant date no proceeding was pending before<br \/>\nthe Special Judge as the matter was still under investigation.  He,<br \/>\nfurther, submitted that it is not permissible to read a fiction upon a<br \/>\nfiction in a deeming statute.  According to him, a statute can create<br \/>\nonly one fiction and therefore, it is not permissible to interpret the<br \/>\nprovisions of the Act of 1988 as creating two fictions, firstly that<br \/>\nthe Special Judges are deemed to have been appointed under<br \/>\n<a href=\"\/doc\/581728\/\" id=\"a_66\">Section 3<\/a> of the Act of 1988, and secondly, to deem that all actions<br \/>\ntaken by them were in accordance with corresponding provisions<br \/>\nof the Act of 1988 as if the West Bengal Amendment Act 1994<br \/>\nwere in force when such actions were taken.\n<\/p>\n<p id=\"p_28\">\tAccording to him, any offence committed before the Act of<br \/>\n1988 came into effect and in respect of which no proceeding was<br \/>\npending before a Special Judge, must lapse and the accused can not<br \/>\nbe tried for that offence at all.  Counsel has placed reliance upon<br \/>\nthree judgments of this Court reported in Mancheri Puthusseri<br \/>\nAhmed and Ors. Vs. Kuthiravattam Estate Receiver (1996) 6 SCC<br \/>\n185; State of Maharashtra Vs. Laljit Rajshi Shah &amp; Ors. (2000) 2<br \/>\nSCC 699 and Commissioner of Income-tax (Central) Calcutta Vs.<br \/>\nMoon Mills Ltd. AIR 1966 SC 870. We, however, find nothing in<br \/>\nthe aforesaid decisions to support the submission urged on behalf<br \/>\nof the respondents.\n<\/p>\n<p id=\"p_29\">\tThe submission that only those cases could be tried by the<br \/>\nSpecial Judges which were actually pending before them on the<br \/>\ndate the Act of 1988 came into effect, proceeds on an extraneous<br \/>\nassumption and ignores the clear provisions of sub-section (2) of<br \/>\n<a href=\"\/doc\/1331755\/\" id=\"a_67\">Section 26A<\/a> of the Act of 1988 inserted by the West Bengal<br \/>\nAmendment Act of 1994, which conferred validity on the actions<br \/>\nof Special Courts appointed even after the Act of 1988 coming into<br \/>\neffect.\n<\/p>\n<p id=\"p_30\">\tEven if, it is assumed for the sake of argument (though the<br \/>\nfactual position in this case is different) that the Act of 1947<br \/>\nhaving been repealed by the Act of 1988, and no Special Judge<br \/>\nhaving been appointed under <a href=\"\/doc\/581728\/\" id=\"a_68\">Section 3<\/a> of the Act of 1988 to try<br \/>\noffences under the <a href=\"\/doc\/1331755\/\" id=\"a_69\">Prevention of Corruption Act<\/a>, 1947, the result<br \/>\nwould not be that the offences committed stood abated and<br \/>\nconsequently the offenders could not be tried at all.  In such a<br \/>\nsituation, the trial of the offenders had to be postponed till such<br \/>\ntime as Special Courts were created to try those offences in<br \/>\naccordance with law.  In such a situation the High Court ought to<br \/>\nhave kept in abeyance the trial till jurisdiction was conferred upon<br \/>\na competent Court to try the accused in accordance with law.  This<br \/>\nCourt had occasion to consider such a situation in  State by Central<br \/>\nBureau of Investigation Vs. Sh. S. Bangarappa (2000) Supp. 4<br \/>\nSCR. This Court observed:\n<\/p>\n<p id=\"p_31\">&#8220;That apart, if the High Court found that XXI City<br \/>\nCivil and Sessions Judge, Bangalore is not<br \/>\nempowered to try such cases, how could that be a<br \/>\nground to quash the criminal proceedings?  At the<br \/>\nworst that would be a ground to transfer the case<br \/>\nfrom that Court to the Court having jurisdiction to<br \/>\ntry the offence, and if no Court has been<br \/>\nempowered till then, the criminal proceedings can<br \/>\nbe kept in abeyance till the Government issues a<br \/>\nnotification conferring such power on any other<br \/>\nCourt&#8221;.\n<\/p>\n<p id=\"p_32\">\tSo far as interpretation of a provision creating a legal fiction<br \/>\nis concerned, it is trite that the Court must ascertain the purpose for<br \/>\nwhich the fiction is created and having done so must assume all<br \/>\nthose facts and consequences which are incidental or inevitable<br \/>\ncorollaries to the giving effect to the fiction.  In construing a<br \/>\nfiction it must not be extended beyond the purpose for which it is<br \/>\ncreated or beyond the language of the Section by which it is<br \/>\ncreated.  It cannot be extended by importing another fiction.  These<br \/>\nprinciples are well settled and it is not necessary for us to refer to<br \/>\nthe authorities on this subject.  The principle has been succinctly<br \/>\nstated by Lord Asquith in East End Dwelling Co. Ltd. V. Finsbury<br \/>\nBorough Council, (1951) 2 ALL ER 587, when he observed :-\n<\/p>\n<p id=\"p_33\">&#8220;If you are bidden to treat an imaginary state of<br \/>\naffairs as real, you must surely, unless prohibited<br \/>\nfrom doing so, also imagine as real the<br \/>\nconsequence and incidents which, if the putative<br \/>\nstate of affairs had in fact existed, must inevitably<br \/>\nhave flowed from or accompanied it-.   The statute<br \/>\nsays that you must imagine a certain state of<br \/>\naffairs; it does not say that having done so, you<br \/>\nmust cause or permit your imagination to boggle<br \/>\nwhen it comes to the inevitable corollaries of that<br \/>\nstate of affairs&#8221;.\n<\/p>\n<p id=\"p_34\">\tThe above principle has been approved by this Court in<br \/>\nlarge number of decisions.\n<\/p>\n<p id=\"p_35\">\tApplying these principles to the provisions of the West<br \/>\nBengal Amendment Act of 1994 which inserts with retrospective<br \/>\neffect <a href=\"\/doc\/1331755\/\" id=\"a_70\">Section 26A<\/a> in the Act of 1988, we find that the Legislature<br \/>\nwas aware of the lacuna created by failure to appoint Special<br \/>\nJudges to try offences under the <a href=\"\/doc\/1331755\/\" id=\"a_71\">Prevention of Corruption Act<\/a>,<br \/>\n1988.  Though, offences had been registered, objections were<br \/>\nbeing taken before the Courts concerned as to their jurisdiction to<br \/>\ntry the accused and such objections had been upheld in some cases.<br \/>\nIt, therefore, became imperative for the Legislature to step in and<br \/>\nconfer jurisdiction upon Special Courts to try offences under the<br \/>\nAct of 1988.  Though Special Judges had been appointed in the<br \/>\nState of West Bengal under the West Bengal Special Courts Act,<br \/>\n1949, they could not take cognizance and try offences after the Act<br \/>\nof 1988 came into effect, since the Act of 1947 stood repealed and<br \/>\n<a href=\"\/doc\/1439469\/\" id=\"a_72\">Section 26<\/a> of the Act of 1988 did not save the Special Courts<br \/>\ncreated under the West Bengal Special Courts Act, 1949.  It was<br \/>\nwith this in view that the West Bengal Legislature enacted the<br \/>\nWest Bengal Amendment Act of 1994 inserting <a href=\"\/doc\/1331755\/\" id=\"a_73\">Section 26A<\/a> in the<br \/>\nAct of 1988.  Since, the Special Courts continued to exercise<br \/>\njurisdiction over the matters brought before them, the Legislature<br \/>\nby law conferred validity on such actions by a deeming provision.\n<\/p>\n<p id=\"p_36\">\tThe submission that a law can create only a single fiction<br \/>\nmust also be repelled.  This Court in Yellappagouda Shankargouda<br \/>\nPatil Vs. Basangouda Shiddangouda Patil, AIR 1960 SC 808; held<br \/>\nthat the Legislature may sometimes create a chain of fictions by<br \/>\nthe same Act or by succeeding Acts.  If the Legislature is<br \/>\ncompetent to enact a provision creating a legal fiction, we see no<br \/>\nreason why it cannot create a chain of fictions if necessity arises.<br \/>\nIt is true that in interpreting a provision creating a legal fiction it is<br \/>\nnot open to the Court to import another fiction.\n<\/p>\n<p id=\"p_37\">\tIn the instant case, the amendment of the Act of 1988 by the<br \/>\nWest Bengal Amendment Act, 1994 is intended to meet the<br \/>\nsituation arising from  non-appointment of Special Judges under<br \/>\nthe Act of 1988 which repealed the Act of 1947.  With a view to<br \/>\nmeet this situation the law deemed, subject to the conditions<br \/>\nenumerates therein, the Special Judges appointed under the West<br \/>\nBengal Special Courts Act, 1949 to have been appointed under<br \/>\n<a href=\"\/doc\/581728\/\" id=\"a_74\">Section 3<\/a> of the Act of 1988.  With the above purpose in mind it<br \/>\nwas further deemed that any order passed, evidence recorded, or<br \/>\naction taken purportedly under the Act of 1988, shall be deemed to<br \/>\nhave been validly passed recorded or taken under the Act of 1988<br \/>\nas if the Act of 1988 as amended by the West Bengal Amendment<br \/>\nAct, 1994 were in force at that time.   We, therefore, hold that the<br \/>\nPrevention of Corruption (West Bengal Amendment) Act, 1994 by<br \/>\namending the Act of 1988 inserting <a href=\"\/doc\/1331755\/\" id=\"a_75\">Section 26A<\/a> therein has vested<br \/>\njurisdiction in the Special Courts appointed under the West Bengal<br \/>\nCriminal Law Amendment (Special Courts) Act, 1949 subject to<br \/>\nconditions laid down therein, to try offences under the <a href=\"\/doc\/1331755\/\" id=\"a_76\">Prevention<br \/>\nof Corruption Act<\/a>, 1988.  All actions taken by them are validated<br \/>\nas if the West Bengal Amendment Act, 1994 were in force when<br \/>\nsuch action was taken.  Unfortunately, the aforesaid enactment<br \/>\nwhich governs the case in hand was not noticed by the High Court.<br \/>\nCounsel for the parties were also remiss in not bringing the West<br \/>\nBengal Amendment Act of 1994 to the notice of the High Court,<br \/>\nand therefore the judgment rendered by the High Court was per<br \/>\nincuriam.\n<\/p>\n<p id=\"p_38\">\tWe, therefore, allow this appeal, set aside the judgment and<br \/>\norder of the High Court quashing the proceeding before the 3rd<br \/>\nSpecial Judge, Calcutta and direct the said Court to proceed with<br \/>\nthe trial in accordance with law.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">1<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of West Bengal vs Sadan K.
