     Petitioner claims to be the purchaser of the vehicle<\/p>\n
bearing Reg.No.KL-10-7775 which was allegedly seized<\/p>\n
for infraction of the provisions of the Kerala Protection of<\/p>\n
River Banks (Protection and Regulation of removal of<\/p>\n
sand) Act, 2002.       He has approached the District<\/p>\n
Collector, the 1st respondent for release of the vehicle<\/p>\n
and is aggrieved by the non-consideration of his request<\/p>\n
as such.\n<\/p>\n
     2.    The nature of the power exercised by the<\/p>\n
District Collector and the para meters within which such<\/p>\n
power is to be exercised have been dealt with by a Bench<\/p>\n
of this Court in Sanjayan Vs.Tahasildar [2007 (4) KLT<\/p>\n
597). Principles have been reiterated in Subramanian<\/p>\n
Vs. State of Kerala [2009 (1) KLT 77).\n<\/p>\n
     3.     In Subramanian’s case, this Court observed<\/p>\n
that   the power exercised by the District Collector is<\/p>\n

under Section 23 of the Kerala Protection of River Banks<\/p>\n
(Protection and Regulation of removal of sand) Act, 2002.<\/p>\n
It is also, therefore, quasi judicial in character. Reasons<\/p>\n
will have to be given by the District Collector       while<\/p>\n
passing orders under Section 23 of the Kerala Protection<\/p>\n
of River Banks (Protection and Regulation of removal of<\/p>\n
sand) Act, 2002 r\/w Rules 27 and 28 of Kerala Protection of<\/p>\n
River Banks and Regulation of Removal of Sand Rules<\/p>\n
2002. If there is a contention that the transportation of<\/p>\n
sand was supported by a pass issued by the competent<\/p>\n
local authority, that has to be referred.     The materials<\/p>\n
which are placed before      the District Collector by the<\/p>\n
subordinate officials shall also be looked into.   This has<\/p>\n
been indicated in Subramanian’s case. If motion is made<\/p>\n
by the owner of the vehicle for release of the vehicle on<\/p>\n
interim custody, it will be subject to the conditions<\/p>\n
mentioned in paragraph 58 of the said judgment.        The<\/p>\n
District Collector may pass orders on such applications on<\/p>\n
interim custody. (The scope of the directions contained in<\/p>\n
Subramanian’s case have later been dealt with in Sareesh<\/p>\n

clarifications have been issued in the latter case). Further<\/p>\n
conditions can be imposed in the course of release of the<\/p>\n
vehicle    as indicated by this Court in Shoukathali Vs.<\/p>\n
Tahasildar [2009 (1) KLT 640].\n<\/p>\n
      4.    Keeping in mind the observations made in the<\/p>\n
judgments in Shoukathali’s case and Subramanian’s case<\/p>\n
and Sareesh’s case which have been referred to, the 1st<\/p>\n
respondent shall pass final orders in the matter of<\/p>\n
confiscation\/release of the vehicle in question after<\/p>\n
conducting an appropriate enquiry as early as possible, at<\/p>\n
any rate within three months from the date of receipt of a<\/p>\n
copy of this judgment.\n<\/p>\n
      5.    In the meanwhile, if motion     is made by the<\/p>\n
petitioner for interim custody of the vehicle bearing Reg.<\/p>\n
KL-10 7775 then orders shall be passed by the District<\/p>\n
Collector on the application for    interim custody of the<\/p>\n
vehicle after notice to the registered owner and after<\/p>\n
hearing him, within four weeks from the date of receipt of a<\/p>\n
copy of this judgment in the light of the observations<\/p>\n

      6.    I make it clear that I have not considered the<\/p>\n
petitioner’s contentions on merits. It is up to the District<\/p>\n
Collector to consider whether the vehicle is to be released<\/p>\n
on interim custody or not.     It is also up to the District<\/p>\n
Collector to consider, in accordance with law, the question<\/p>\n
as to whether the vehicle has been used in a manner as to<\/p>\n
contravene the provisions of the Act and the Rules framed<\/p>\n
thereunder and as to whether the vehicle is liable for<\/p>\n
confiscation and pass final orders on that basis.<\/p>\n
      The writ petition is disposed of as above.       The<\/p>\n
petitioner shall produce copies of the judgment in<\/p>\n
Subramanian, Shoukathali and Sareesh along with the<\/p>\n
certified copy of this judgment before the 1st respondent,<\/p>\n
for compliance.\n<\/p>\n
