Case No. 19\/2011 for<\/p>\n<p>                        offences under <a href=\"\/doc\/471092\/\" id=\"a_1\">Sections 272<\/a>\/<a href=\"\/doc\/285163\/\" id=\"a_1\">273<\/a> of the Indian Penal<\/p>\n<p>                        Code and under <a href=\"\/doc\/110162683\/\" id=\"a_2\">Section 47(A)<\/a> of the Excise Act, are<\/p>\n<p>                        named accused in this case with allegation of<\/p>\n<p>                        manufacturing Mahua wine over the parti land<\/p>\n<p>                        belonging to them.\n<\/p>\n<p id=\"p_3\">                                    Submission is that nothing was being done<\/p>\n<p>                        over the land of the petitioners which is adjacent south<\/p>\n<p>                        of place of occurrence as is evident from paragraph six<\/p>\n<p>                        of the case diary.\n<\/p>\n<p id=\"p_4\">                                    It is further submitted that no other specific<\/p>\n<p>                        details of the place of occurrence is evident from entire<\/p>\n<p>                        investigation. Learned Additional Public Prosecutor<br \/>\n            who is armed with carbon copy of the case diary failed<\/p>\n<p>           to refute such submissions.\n<\/p>\n<p id=\"p_5\">                     Considering the facts and circumstances of<\/p>\n<p>           the case, in the event of their arrest or surrender within<\/p>\n<p>           a period of four weeks, let the above-named petitioners<\/p>\n<p>           be enlarged on bail on furnishing bail bond of sum of<\/p>\n<p>           Rs. 10,000\/- (ten thousand only) each with two sureties<\/p>\n<p>           of the like amount each to the satisfaction of S.D.J.M.,<\/p>\n<p>           Sherghati, Gaya, in connection with Dumariya P.S.<\/p>\n<p>           Case No. 19\/2011, subject to condition under <a href=\"\/doc\/1692057\/\" id=\"a_3\">section<\/p>\n<p>           438(2)<\/a> of the Code of Criminal Procedure, and<\/p>\n<p>           additional condition to attend the court regularly till<\/p>\n<p>           disposal of the case, in the event of failure on two<\/p>\n<p>           consecutive dates, without any reasonable explanation,<\/p>\n<p>           the privilege granted shall be deemed to be cancelled.<\/p>\n<pre id=\"pre_1\">Rajeev\/-                        ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Sewak Mistry &amp; Anr. vs The State Of Bihar on 18 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.27719 of 2011 1.
