Respondents\n\nPRAYER\n\nWrit Petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India\npraying for issuance of a Writ of Mandamus, to direct the second respondent to\ncomplete the assessment of the petitioner company for the years 2003-04 and\n2004-05 expeditiously and to refund the amount of Rs.18,96,905- as contemplated\nunder Rule 18F(3) of the TNGST Rules.\n\n!For Petitioner \t... Mr.R.D.Ganesan\n^For Respondents\t... Mr.V.Rajasekaran\n\t\t\t    Spl.Government Pleader\n\n:ORDER\t\n<\/pre>\n<p id=\"p_1\">\t\tMr.V.Rajasekaran, learned Special Government Pleader had taken<br \/>\nnotice on behalf of the respondents. By consent, this writ petition itself is<br \/>\ntaken up for final disposal.\n<\/p>\n<p id=\"p_1\">\t\t2.The case of the petitioner is that in respect of some of the works<br \/>\ndone by the petitioner to the Southern Railways, the Railways has deducted an<br \/>\namount of Rs.18,97,105\/-, which has been transmitted to the Commercial Tax<br \/>\nDepartment.  The work was in respect of the assessment order for the years 2003-<br \/>\n04 and 2004-05 and the petitioner has submitted the accounts for the above said<br \/>\nyears to the second respondent.  However, the assessment order has not been<br \/>\npassed.\n<\/p>\n<p id=\"p_2\">\t\t3. It is stated in the counter affidavit that the amount which was<br \/>\ndeducted at source by the Railways has been transmitted to the Department, the<br \/>\nAssessment Order could not be passed for the above said two years due to the<br \/>\nconduct of the petitioner in not producing various records such as purchase<br \/>\naccounts, day book etc.,<\/p>\n<p id=\"p_3\">\t\t4.Mr.R.Ganesan, learned counsel appearing for the petitioner has<br \/>\nsubmitted that even though the petitioner has produced all the records, as it is<br \/>\nseen in  various communication filed by the petitioner in the typed set of<br \/>\npapers, the petitioner is still prepared to produce to all the documents to the<br \/>\nassessing authority, if a specific notice is given in this regard.\n<\/p>\n<p id=\"p_4\">\t\t5.Mr.V.Rajasekaran, learned Special Government Pleader would submit<br \/>\nthat the order can be passed to direct the respondents to complete the entire<br \/>\nprocess of assessment within the stipulated time.\n<\/p>\n<p id=\"p_5\">\t\t6.In view of the same, this writ petition is disposed of with a<br \/>\ndirection to the second respondent to inform the petitioner as to the nature of<br \/>\nthe documents required for the purpose of completion of assessment for the years<br \/>\n2003-04 and 2004-05 within a period of two weeks from the date of receipt of a<br \/>\ncopy of this order and on such communication from the second respondent, the<br \/>\npetitioner shall furnish the said records within a period of one week<br \/>\nthereafter, and on production of such records the second respondent shall<br \/>\ncomplete the assessment for the said years and pass appropriate orders including<br \/>\nthe order in respect of the refund or otherwise of the amount transmitted from<br \/>\nthe Southern Railway to an extent of Rs.18,97,105\/-.  The second respondent<br \/>\nshall complete the final assessment order on merits within a period of four<br \/>\nweeks thereafter.\n<\/p>\n<p id=\"p_6\">\t\t7.The Writ Petition is disposed of with the above direction.
