Sahai, J.\n<\/pre>\n<p id=\"p_1\">Hon&#8217;ble Mrs. Jayashree Tiwari, J.\n<\/p>\n<p id=\"p_1\">        The short question that arises for consideration in this petition is whether<br \/>\nunder Rule 13 of the U.P. Minerals (Prevention of illegal Mining, Transportation<br \/>\nand Storage) Rules, 2002            (in brief    the     Rules 2002) the stored minerals<br \/>\n(boulders) could be seized by the respondents simultaneously while issuing a<br \/>\nshow cause notice by the Mines Officer.\n<\/p>\n<p id=\"p_2\">        The petitioner was granted a mining lease on 23.3.2006 on part of plot<br \/>\nno. 7347 Ka area 1.25 acre by the District Magistrate, Sonebhadra under Form<br \/>\nMM3 of the Uttar Pradesh Minor Minerals (Concession ) Rules, 1963. The lease<br \/>\nwas for a period of ten years from 23.3.2006 to 23.3.2016. Form MM11 was<br \/>\nissued for mining as well as for transportation of boulder and gitti. According to<br \/>\nthe petitioner he did not violate any terms of the mining lease and his stone<br \/>\ncrusher was installed on the           boundary at a distance of 70 meters from the<br \/>\nmining quarry within          the mining area leased out to the petitioner. The<br \/>\nboulders were kept on the mining area of the petitioner which were                     being<br \/>\ncrushed by the petitioner and gitti was manufactured.\n<\/p>\n<p id=\"p_3\">        It appears that       on the basis of some complaint dated 9.4.2010 by<br \/>\none Anoop Tripathi the stone crusher was inspected by the respondents and it<br \/>\nwas found that boulders were lying                  near     the crushing machine which<br \/>\nwas being crushed by the petitioner and Gitti was manufactured which was to<br \/>\nbe transported. The Mining Officer\/District Magistrate, Sonebhadra issued a show<br \/>\ncause notice to the petitioner on 19.4.2010 stating therein that the petitioner<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                        2<\/span><\/p>\n<p>has illegally stored 11500 sq.m. of gitti and 4500 sq. m. boulders. The<br \/>\npetitioner had no licence to store boulders     and the petitioner was asked to<br \/>\nfurnish information that the boulders were     obtained by the petitioner from<br \/>\nwhich mining lease holders; under which agreement they have supplied the<br \/>\nboulders to the petitioner; if   gitti have been transported by the petitioner<br \/>\nthen copies of Form MM 11 be furnished; the details of name and address of<br \/>\nthe mining lease holders who have supplied boulders          to the petitioner be<br \/>\nalso furnished. In the show cause notice it was also stated that the petitioner<br \/>\nhas been carrying out illegal mining operation and therefore            stock of<br \/>\nboulders found near the crusher of the petitioner as mentioned above was<br \/>\nseized by the mining officer while issuing    show cause notice on 19.4.2010.\n<\/p>\n<p id=\"p_4\">      The    question   is   whether    the    Mining    Officer   could    seize<br \/>\nthe boulders simultaneously while issuing notice under Section 13(2) of the<br \/>\nU.P. Minerals (Prevention of illegal Mining, Transportation and Storage) Rules,<br \/>\n2002. It is necessary to extract the Rule 13 of the aforesaid Rules.\n<\/p>\n<p id=\"p_5\">             Rule 13. Inspection and checking of the storage of<br \/>\n      minerals &#8211; (1) For the purpose of checking of the stored<br \/>\n      minerals or for any purposes connected with the Act<br \/>\n      or rules made thereunder, the District Officer or the Officer<br \/>\n      authorised by the State Government may,\n<\/p>\n<p id=\"p_6\">             (a)    enter, inspect any such storage premises,<\/p>\n<p id=\"p_7\">             (b)    weigh, measure or take measurement of stock of<br \/>\n                    mineral(s) lying in the store,\n<\/p>\n<p id=\"p_8\">             (c)    examine any document, book, register or record<br \/>\n             in     the possession,\n<\/p>\n<p id=\"p_9\">             (d)    take extracts from or make copies of such<br \/>\n                    document, book, register or records,\n<\/p>\n<p id=\"p_10\">             (e)    summon on order the production of any such<br \/>\n                    document, book, register or records as is referred to<br \/>\n             in     clause (c),\n<\/p>\n<p id=\"p_11\">             (f)    summon or examine any person having the control<br \/>\n             of     or connected with any stock of the mineral,\n<\/p>\n<p id=\"p_12\">             (g)    call for such information or return as may be<br \/>\n                    considered necessary.\n<\/p>\n<p id=\"p_13\">      2. If any illegality is found in the stock of the minerals, the<br \/>\n      District Officer or the officer authorised by the State Government<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                           3<\/span><\/p>\n<p>      in this behalf may issue a notice to such licensee to explain his<br \/>\n      case within thirty days from the receipt of the notice and if no<br \/>\n      explanation is submitted within stipulated time or the explanation<br \/>\n      so submitted is not found satisfactory then the licence may be<br \/>\n      determined by the District Officer and if the stock so checked is<br \/>\n      found without any lawful authority, the same may be seized and<br \/>\n      confiscated.\n<\/p>\n<p id=\"p_14\">         Rule13(1) gives power to the Mining Officer to check and inspect the<br \/>\nstored minerals, take measurement and inspect books etc. Rule                   13(2)<br \/>\nprovides that if any illegality is found by the Mining Officer or the District<br \/>\nOfficer or the officer authorised by the State Government in the stock of<br \/>\nthe minerals then show cause notice has to be issued to the petitioner calling<br \/>\nhis explanation within thirty days and if the explanation submitted by the<br \/>\npetitioner is not found satisfactory then the authorities have the power to<br \/>\ncome to the conclusion that the stock of mineral checked by them were stored<br \/>\nwithout any lawful authority, and the authority could direct for its seizure<br \/>\nand confiscation.\n<\/p>\n<p id=\"p_15\">      Learned Standing       Counsel   has vehemently           urged that   since the<br \/>\npetitioner was not holding any licence for storage of boulders, therefore after<br \/>\nthe mining operation, the storage of boulders had become illegal.\n<\/p>\n<p id=\"p_16\">      The petitioner had stated that the stone crusher had been established on<br \/>\nthe boundaries of the lease area and no licence is required to store         boulders<br \/>\nas after mining and excavation the boulders are stored on the leased area.<br \/>\nThe distance between      stone crusher and the quarry is only 70 meters whereas<br \/>\nin the counter affidavit the respondents have stated that the distance               is<br \/>\nabout 150 meters. However, if after mining operation the boulder coming out<br \/>\nafter excavation are kept on the area which had been leased to the petitioner<br \/>\nthen there is no occasion for the      petitioner for obtaining        licence for the<br \/>\nstorage of the boulders as provided by Rule 11(a) of the Rules 2002.\n<\/p>\n<p id=\"p_17\">      From    the reply    given by the       Mines   Officer    under the   Right   to<br \/>\n<a href=\"\/doc\/1965344\/\" id=\"a_1\">Information Act<\/a> filed as Annexure -3 to the rejoinder affidavit it is clear that<br \/>\nno mining lease holder had obtained any licence for storage of minerals on<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                4<\/span><\/p>\n<p>the area which had been leased out to him. The petitioner who is a mining<br \/>\nlease holder is not required to obtain any licence for storage of boulders<br \/>\nexcavated by him from his mines which were stored on the mining area for<br \/>\nwhich the petitioner was holding a valid lease.\n<\/p>\n<p id=\"p_18\">         If     the petitioner is required to obtain      any licence     for    storage of<br \/>\nboulders within the area for which he had been leased then such an order<br \/>\nshould have been passed by the respondents only after one month from the<br \/>\ndate of service of show cause notice, giving detailed reasons                   but without<br \/>\nexpiry of one month of show cause notice the boulders could not be seized by<br \/>\nthe respondents in view of clear provision of Rule 13(2) of the Rules 2002.<br \/>\nTherefore, show cause notice dated 19.4.2010 and simultaneous seizure of<br \/>\nboulders is contrary to Rule 13(2) of the Rules 2002.\n<\/p>\n<p id=\"p_19\">         Therefore, we direct that the seizure of boulders by the respondents<br \/>\nsimultaneously alongwith show cause notice dated 19.4.2010 is wholly illegal<br \/>\nand is liable to be quashed. However, if the petitioner submits his reply to the<br \/>\nshow cause notice within the            period of one month from today it shall be<br \/>\nconsidered by the respondents and the respondents                  shall pass a     detailed<br \/>\nreasoned order after considering each and every point raised by the petitioner<br \/>\nin his reply to the show cause notice.\n<\/p>\n<p id=\"p_20\">         In the result, the writ petition succeeds and is allowed. The show cause<br \/>\nnotice        dated     19.4.2010 so far    as it    directs    seizure of the petitioner&#8217;s<br \/>\nboulders is           quashed. The    boulders      which had     been    seized    by the<br \/>\nrespondents           shall   be released   to the petitioner     forthwith. However, the<br \/>\npetitioner shall submit his reply to the show cause notice within the period of<br \/>\none month from today which shall be considered by the respondents and the<br \/>\nrespondents shall pass a detailed reasoned order after considering each and<br \/>\nevery point raised by the petitioner in his reply to the show cause notice.\n<\/p>\n<p id=\"p_21\">         Parties shall bear their own costs.\n<\/p>\n<p id=\"p_22\">Order Date :- 7.7.2010<br \/>\nCMWP No.26810 of 2010\/P.P.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court M\/S Uma Stone Crushing Company And &#8230; vs State Of U.P.
