Mr. H.L.\n<\/p>\n<p id=\"p_1\">Jani, learned Additional Public Prosecutor waives service of rule on<br \/>\nbehalf of the respondent.  In the facts and circumstances of the<br \/>\ncase, this matter is taken up for hearing today.\n<\/p>\n<p id=\"p_2\">\tThis is an<br \/>\napplication for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">section 438<\/a> of the Code of<br \/>\nCriminal Procedure in connection with a criminal complaint being C.R.<br \/>\nNo. I- 87 of 2008 registered with Kalol City Police Station for<br \/>\noffence punishable under <a href=\"\/doc\/92983\/\" id=\"a_1\">section 306<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_3\">\tLearned advocate<br \/>\nfor the petitioner submitted that considering the role attributed to<br \/>\nthe petitioner, which is reflected in the FIR produced at Annexure<br \/>\n&#8216;A&#8217; to the petition, the petitioner has been falsely implicated in<br \/>\nthe commission of offence, and, therefore, the prayer as set out in<br \/>\nthe application for anticipatory bail be granted. He further<br \/>\nsubmitted that the applicant is ready and willing to co-operate with<br \/>\nthe investigating officer and is not likely to flee the course of<br \/>\njustice and, therefore, the case of the applicant may be considered<br \/>\nfor grant of anticipatory bail.\n<\/p>\n<p id=\"p_4\">\tOn the other<br \/>\nhand, Mr. H.L. Jani,  learned Additional Public Prosecutor for the<br \/>\nstate opposed the grant of bail and submitted that considering the<br \/>\nalleged involvement of the petitioner and the manner in which the<br \/>\noffence is committed, it is a fit case not to grant anticipatory<br \/>\nbail, and, therefore, the applicant does not deserve the<br \/>\ndiscretionary relief.\n<\/p>\n<p id=\"p_5\">\tHaving heard the<br \/>\nlearned the rival submissions of the learned advocates and<br \/>\nconsidering the role attributed to the petitioner in the police<br \/>\npapers, FIR at Annexure &#8216;A&#8217; and the order passed by learned<br \/>\nAdditional Sessions, Fast Track Court No.4, Gandhinagar in Criminal<br \/>\nMisc. Application No. 242 of 08, the petitioner has been booked for<br \/>\noffence punishable under <a href=\"\/doc\/92983\/\" id=\"a_2\">section 306<\/a> of the Indian Penal Code.  I<br \/>\nhave also considered the nature of the offence, the manner in which<br \/>\nthe offence is alleged to have been committed and the gravity of the<br \/>\noffence and considering the facts and circumstances, I am inclined to<br \/>\ngrant anticipatory bail to the applicant.\n<\/p>\n<p id=\"p_6\">\tIn the event of<br \/>\narrest of the petitioner in connection with C.R. No. I   87 of 2008<br \/>\nregistered with Kalol City Police Station for offence punishable<br \/>\nunder <a href=\"\/doc\/92983\/\" id=\"a_3\">section 306<\/a> of the Indian Penal Code, he shall be released on<br \/>\nbail on executing a bond of Rs.10,000\/- [Rupees ten thousand only]<br \/>\nwith one surety of the like amount on the following conditions that<br \/>\nhe shall:\n<\/p>\n<p id=\"p_7\">[a].\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p id=\"p_8\">[b].\tshall remain<br \/>\npresent at the concerned Police Station on 4th August 2008<br \/>\nbetween 9.00 AM to 3.00 PM.\n<\/p>\n<p id=\"p_9\">[c].\tshall not<br \/>\nhamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p id=\"p_10\">[d].\tat the time<br \/>\nof execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p id=\"p_11\">[e].\tnot leave<br \/>\nIndia without the permission of the Court and, if holding a passport,<br \/>\nhe shall surrender the same before the trial Court within a week;\n<\/p>\n<p id=\"p_12\">[f].\tnot obstruct<br \/>\nor hamper the police investigation and not play mischief with the<br \/>\nevidence collected or yet to be collected by the police;\n<\/p>\n<p id=\"p_13\">\tIt would be open<br \/>\nto the Investigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just; and the competent Court would decide it<br \/>\non merits.\n<\/p>\n<p id=\"p_14\">\tThis order will<br \/>\nhold good, if the petitioner is arrested at any time within 90 days<br \/>\nfrom today.  The order for release on bail will remain operative only<br \/>\nfor a period of ten days from the date of his arrest. Thereafter, it<br \/>\nwill be open to the petitioner to make a fresh application for being<br \/>\nenlarged on bail in usual course, which, when it comes up before the<br \/>\ncompetent Court, will be decided in accordance with law, having<br \/>\nregard to all the attending circumstances and the materials available<br \/>\nat the relevant time, without being influenced by the fact that<br \/>\nanticipatory  bail was granted.\n<\/p>\n<p id=\"p_15\">\tWith these<br \/>\ndirections, this Criminal Misc. Application is allowed.
