LTD - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nTH SOMPURA for\nAppellant(s) : 1, \nMR AH SHAH for NANAVATI ASSOCIATES for\nDefendant(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n\t  \nDate : 29\/07\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.\t\tThis<br \/>\nappeal is directed against the judgment and award dated 15th<br \/>\nFebruary, 1991 passed by the Commissioner for Workmen&#8217;s Compensation,<br \/>\nVeraval in Workmen&#8217;s Compensation Application No. 135 of 1989<br \/>\nwhereby, the application was partly allowed and the<br \/>\nappellant-original opponent was directed to pay Rs.4,358.50 paise to<br \/>\nthe respondent-original applicant within a period of one month from<br \/>\nthe date of an award, failing which interest @ 12% will be liable to<br \/>\nbe paid from the date of incident till realization of the awarded<br \/>\namount.\n<\/p>\n<p id=\"p_1\">2.0.\t\tThe<br \/>\nshort facts of the case are :-\n<\/p>\n<p id=\"p_2\">2.1.\t\tThe<br \/>\nappellant-original applicant was working in the factory of the<br \/>\nrespondent-original opponent on the monthly salary of Rs.600\/-. On<br \/>\n6th October, 1988, while discharging his duties, he met<br \/>\nwith an accident, as a result of which he received injuries on his<br \/>\nright limb and his right hand up to wrist. The appellant, therefore,<br \/>\npreferred an application before the learned Commissioner Workmen&#8217;s<br \/>\nCompensation, for grant of compensation.\n<\/p>\n<p id=\"p_3\">2.2.\t\tThe<br \/>\nlearned trial Court after hearing the respective parties and<br \/>\nconsidering the evidence on record, partly allowed the application<br \/>\nand directed the  respondent to pay Rs.4358.30 paise to the appellant<br \/>\nwithin one month from the date of award, failing which interest @ 12%<br \/>\nfrom the date of accident till realization of the awarded amount.<br \/>\nHence, this appeal.\n<\/p>\n<p id=\"p_4\">3.0.\t\tHeard<br \/>\nlearned counsel for the respective parties. It is admitted that the<br \/>\nworkman was earning Rs.600\/- p.m.  In absence of any evidence on<br \/>\nrecord, the Court below has assessed the age of the workman at the<br \/>\nrelevant time by 24 years on the basis of the medical certificate at<br \/>\nExh. 29. In my opinion, the said assessment arrived at by the Court<br \/>\nbelow is just and reasonable.\n<\/p>\n<p id=\"p_5\">3.1.\t\tIn<br \/>\nthe impugned award, the Court below has recorded finding that the<br \/>\nworkman had not totally loss the fingers in his right hand and that<br \/>\nhe had sustained injuries in the middle and ring finger. Accordingly,<br \/>\non the basis of Sr. No.31 and Sr. No. 35 of Part II of  Schedule I of<br \/>\nthe Workmen&#8217;s <a href=\"\/doc\/1113485\/\" id=\"a_1\">Compensation Act<\/a>, the Court below has assessed the<br \/>\npercentage of loss of earning capacity at 12% and 7% respectively,<br \/>\ntotalling to 19% as a whole.  The Court below has committed error in<br \/>\nalso relying upon the disability assessed by the Doctor concerned,<br \/>\nwhich is contrary to the provisions of the Act.\n<\/p>\n<p id=\"p_6\">3.2.\t\tIn<br \/>\nmy opinion, looking to the evidence on record, the Court below ought<br \/>\nto have relied upon the assessment made in the medical evidence of<br \/>\nthe Doctor concerned. Since workman was aged 24 years at the relevant<br \/>\ntime, the factor of 218.47 would be applicable as per the provisions<br \/>\nof the Act. Therefore, the workman shall be entitled in all, Salary<br \/>\nof Rs.600 its 50% = Rs. 300 and the relevant factor is 218.47 i.e<br \/>\n218.47 x 300 = 65,541\/ and since he had sustained 19% disability he<br \/>\nwould be entitled for 12,453\/-.\n<\/p>\n<p id=\"p_7\">3.3.\t\tFurther<br \/>\nin view of the amended provisions of the Act, the appellant is<br \/>\nentitled interest @ 6% instead of 12%, from the date of application<br \/>\ni.e. from 24th January, 1989 till realization.\n<\/p>\n<p id=\"p_8\">4.0.\t\tIn<br \/>\nthe result, the appeal is partly allowed. The impugned award of the<br \/>\nCourt below is modified to the extent that the workman shall be<br \/>\nentitled for an additional amount of Rs. 8095\/- and interest @ 6%<br \/>\nfrom the date of application till realization. Rest of the award<br \/>\nremains as it is.
