JUSTICE ARVIND KUMAR\n\nPresent:-    Mr. SPS Sidhu, Advocate\n             for the appellant\n                      ...\n\nARVIND KUMAR, J:\n<\/pre>\n<p id=\"p_2\">             The complainant, Seeta Rani, has sought permission to file an<br \/>\nappeal against the judgment dated 21.1.2008 passed by learned Sub<br \/>\nDivisional Judicial Magistrate, Jalalabad(West), District Ferozepur, by dint<br \/>\nof which the respondent-accused No.1 Gurdev Singh has been acquitted in a<br \/>\ncomplaint case under <a href=\"\/doc\/988620\/\" id=\"a_1\">Sections 406<\/a>\/<a href=\"\/doc\/538436\/\" id=\"a_1\">498-A<\/a> IPC. Complaint qua the other<br \/>\naccused, namely, accused Nos. 2 to 8, was ordered to be dismissed after<br \/>\nrecording of preliminary evidence.\n<\/p>\n<p id=\"p_3\">             The facts relevant are that complainant Seeta Rani was married<br \/>\nwith accused-respondent Gurdev Singh on 15.1.1997 and all articles of<br \/>\ndowry were given to her by her parents at the time of marriage. It is alleged<br \/>\nthat some time after the marriage, accused Gurdev Singh started taunting the<br \/>\ncomplainant on one pretext or the other in regard to demand of dowry. A<br \/>\ndaughter was born out of the wedlock. Later, a demand for motor-cycle is<br \/>\nalleged to have been made. A Panchayat was also convened in which the<br \/>\nrespondents-accused allegedly repeated the said demand of motor-cycle.<br \/>\nThey on demand refused to give the dowry articles to the complainant and<br \/>\nhave misappropriated the same. This led to filing of the present complaint<br \/>\nby complainant Seeta Rani. After recording of preliminary evidence of the<br \/>\ncomplainant, the trial Court only summoned accused No.1-respondent<br \/>\nGurdev Singh while dismissing the complainant against accused Nos. 2 to 8.<br \/>\nAfter framing of charges against the respondent-accused,the witnesses were<br \/>\ncross-examined by his counsel. Thereafter, on closure of prosecution<br \/>\nevidence, the incriminating material was put to the accused when his<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Crl. Misc. No. 235-MA of 2008                                           -2-<\/span><br \/>\nstatement under <a href=\"\/doc\/767287\/\" id=\"a_2\">Section 313<\/a> Cr.P.C. was recorded. He denied all of them<br \/>\nand pleaded false implication. In defence, he examined DW-1 Raj Kumar,<br \/>\nClerk, Judicial Record Room, Ferozepur.\n<\/p>\n<p id=\"p_4\">             After hearing the learned Public Prosecutor as well as learned<br \/>\ndefence counsel, the trial court came to the conclusion that the material<br \/>\nproduced on the record by the prosecution does not inspire confidence and<br \/>\nconnecting the accused with the alleged commission of crime and<br \/>\naccordingly acquitted the respondent. Now, the complainant has filed the<br \/>\npresent application, seeking leave to file an appeal.\n<\/p>\n<p id=\"p_5\">             I have heard learned counsel for the applicant-appellant and<br \/>\nhave also gone through the paper-book carefully.\n<\/p>\n<p id=\"p_6\">             The learned trial Court while acquitting the respondent-accused<br \/>\nof the charges, observed that there is no independent corroboration to the<br \/>\nversion of the complaint. The complaint was filed by her against 8 persons<br \/>\nout of which, only one, i.e. respondent-accused, had been summoned and<br \/>\ncomplaint qua remaining seven was dismissed and the complainant was not<br \/>\naggrieved against the said order since she did not prefer any revision. The<br \/>\ntrial Court held that no specific instances have been given as to when<br \/>\nalleged payment of Rs.35,000\/- was made or when alleged beatings were<br \/>\ngiven or when the complainant was thrown out of the house. The trial Court<br \/>\nhas held the allegations to be vague and not specific. The High Court ought<br \/>\nnot to interfere with the order of acquittal unless the judgment of acquittal is<br \/>\nperverse or highly unreasonable. In the instant case, the judgment of<br \/>\nacquittal rendered by the learned Sub Divisional Judicial Magistrate,<br \/>\nJalalabad(West), District Ferozepur, is neither perverse nor unreasonable<br \/>\nand it cannot be said that the trial court based its findings on irrelevant or<br \/>\ninadmissible evidence.
