Alternatively, it is prayed that the Registry be directed<br \/>\n\tto take back the aforesaid original Demand Drafts and a direction be<br \/>\n\tissued to the State Bank of India to issue Demand Drafts in favour<br \/>\n\tof the applicant of equivalent amount in US dollars payable at<br \/>\n\tSingapore at the prevailing rate on the date of issuance of the<br \/>\n\tDemand Draft for the total amount of two original Demand Drafts or<br \/>\n\tto transmit the money in US dollars at the rate prevailing on the<br \/>\n\tdate of issuance of the demand drafts or telegraphically transfer<br \/>\n\tthe money in the account of the applicant at Singapore in terms of<br \/>\n\tthe details provided in the application.\n<\/p>\n<p id=\"p_1\">The<br \/>\n\tlearned advocate for the applicant has invited attention to the<br \/>\n\taverments made in the application to point out the difficulties<br \/>\n\tfaced by the applicant in getting the two demand drafts encashed.<br \/>\n\tIt is submitted that in the circumstances, the Court may at least<br \/>\n\tconsider granting the alternative prayer made in the application.\n<\/p>\n<p id=\"p_2\">Vide<br \/>\n\torder dated 13th February 2009 made in Civil Application<br \/>\n\tNo.367 of 2008, this Court had directed the Registry to return the<br \/>\n\tamount of Rs.11.6 lakhs payable to the applicant herein, after<br \/>\n\tobtaining a demand draft in favour of the applicant, after deducting<br \/>\n\tthe bank charges for issuance of the necessary demand draft of the<br \/>\n\taforesaid amount.  It was further directed that the demand draft be<br \/>\n\thanded over to the learned advocate for the appellant.\n<\/p>\n<p id=\"p_3\">Having<br \/>\n\tregard to the submissions advanced by the learned advocate for the<br \/>\n\tapplicant and in the light of the averments made in the application,<br \/>\n\tin the opinion of the Court, interests of justice would be met if<br \/>\n\tthe alternative prayer made in the application is granted.\n<\/p>\n<p id=\"p_4\">In<br \/>\n\tthe light of the aforesaid, the application is allowed.
