NO.  837 OF 1998\n\n             =================================\n\n               Dated this the 6th day of March 2007\n\n\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      The   revision   petitioner   stands   convicted   for   the   offence<\/p>\n<p>under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Sections 279<\/a>, <a href=\"\/doc\/1402213\/\" id=\"a_1\">337<\/a> and <a href=\"\/doc\/1721129\/\" id=\"a_2\">338<\/a>  of the Indian Penal Code and<\/p>\n<p>sentenced   to   undergo   simple   imprisonment   for   15   days   for   the<\/p>\n<p>offence  under   <a href=\"\/doc\/1270101\/\" id=\"a_3\">section  279<\/a>   and  to   undergo   simple   imprisonment<\/p>\n<p>for   one   month   for   the   offence   under   <a href=\"\/doc\/1721129\/\" id=\"a_4\">section   338<\/a>   IPC.     No<\/p>\n<p>separate sentence is awarded for the offence under <a href=\"\/doc\/1402213\/\" id=\"a_5\">section 337<\/a><\/p>\n<p>IPC.   The prosecution case is that on 31.07.1991 at about 7.15<\/p>\n<p>a.m   the bus driven by the revision petitioner\/accused, that was<\/p>\n<p>proceeding   from   east-west   hit   on   another   bus   that   came   from<\/p>\n<p>opposite direction  alleging that the accident occurred due to the<\/p>\n<p>rash   and   negligent   driving   of   the   bus   by   the   accused\/revision<\/p>\n<p>petitioner.   PW7 sustained multiple fractures and PW8 sustained<\/p>\n<p>fracture of her nasal bone.   The rest of the witnesses have also<\/p>\n<p>sustained  minor injuries.   Both the  courts  below have held  that<\/p>\n<p>the accused is guilty of rash and negligent driving.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL. R.P. NO. 837 OF 1998              : 2 :<\/span><\/p>\n<p id=\"p_1\">      2.   I find that the scene mahazar clearly indicated that the<\/p>\n<p>bus   driven   by   the   revision   petitioner   was   totally   on   the   wrong<\/p>\n<p>side.     The   contention   of   the   counsel   for   the   revision   petitioner<\/p>\n<p>that it was a rainy day and that the visibility  was poor  and both<\/p>\n<p>the   vehicles   has   applied   brake   and   that   the   accident   was<\/p>\n<p>unavoidable,   cannot   be   sustained   in   view   of   the   fact   that   the<\/p>\n<p>vehicle  was  a  public   career  and the  revision petitioner  ought  to<\/p>\n<p>have been careful.   Had he driven the vehicle in a normal speed<\/p>\n<p>in   the   above   conditions   the   accident   could   have   been   averted.\n<\/p>\n<p id=\"p_2\">The report of the A.M.V.I showed that there was no mechanical<\/p>\n<p>defect to the vehicle.   In the circumstances, I find no reason to<\/p>\n<p>interfere in the findings of the courts below.\n<\/p>\n<p id=\"p_3\">      3.     Considering   the   fact   that   the   incident   had   taken   place<\/p>\n<p>more than 15 years ago and the revision petitioner was facing so<\/p>\n<p>far under the ordeal of prosecution and court proceedings, I find<\/p>\n<p>that the sentence is liable to be modified.   The sentence  for the<\/p>\n<p>offence under <a href=\"\/doc\/1721129\/\" id=\"a_6\">section 338<\/a> is modified to imprisonment till rising<\/p>\n<p>of  the   court   and   to  pay  a  compensation   of  Rs.10,000\/-  to  PW7<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL. R.P. NO. 837 OF 1998              : 3 :<\/span><\/p>\n<p>who sustained multiple fractures and in default to undergo simple<\/p>\n<p>imprisonment for one month.   No separate sentence is awarded<\/p>\n<p>for   the   offences   under   <a href=\"\/doc\/1270101\/\" id=\"a_7\">Section   279<\/a>   and   <a href=\"\/doc\/1402213\/\" id=\"a_8\">337<\/a>   IPC.     The   revision<\/p>\n<p>petitioner   is   granted   one   month&#8217;s   time   from   today   onwards   to<\/p>\n<p>pay   the   amount   of   compensation.     The   revision   petitioner   shall<\/p>\n<p>appear   before   Judicial   First   Class   Court,   Kodungallur   on<\/p>\n<p>30.04.2007 to receive sentence.\n<\/p>\n<p id=\"p_4\">      The Crl. R.P is disposed of accordingly.\n<\/p>\n<p id=\"p_5\">                                            K.R.
