In view of this statement made by learned advocate at the<br \/>\nBar under the instruction of his client, the Court is inclined to<br \/>\nissue notice for final disposal of this appeal as well as the suit<br \/>\nitself.  The other side is expected to be ready with their defence,<br \/>\nif any, on or before the returnable date. \tNotice for final disposal<br \/>\nreturnable on 8\/3\/2010.\n<\/p>\n<p id=\"p_1\">                                                     [<br \/>\nS.R.
