Justice V.GIRI\n\n Dated :31\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">07\/2009\n\n O R D E R\n                              V.GIRI,J.\n                       -------------------------\n                   W.P ( C) No<\/a>.21096 of 2009\n                       --------------------------\n                 Dated this the 31st July,2009\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Petitioner and the 3rd respondent are neighbours.<\/p>\n<p>Apparently, there is a dispute between the two relating to<\/p>\n<p>the pathway lying adjacent to the petitioner&#8217;s property.<\/p>\n<p>Third respondent has approached the RDO, as evidenced<\/p>\n<p>by Ext P3 complaint. It seems that the RDO sought for an<\/p>\n<p>enquiry into the complaint.           But thereupon, the 1st<\/p>\n<p>respondent the S.I of Police proceeded to issue Ext.P4,<\/p>\n<p>wherein, citing the pendency of the complaint before the<\/p>\n<p>RDO, he has directed the petitioner               to stop the<\/p>\n<p>construction of the compound wall. Enquiry as such has<\/p>\n<p>been done by the Village Officer, who has forwarded Ext.P5<\/p>\n<p>report.\n<\/p>\n<p id=\"p_1\">     2.    It is open to the RDO to take appropriate action,<\/p>\n<p>but obviously the S.I of Police has no jurisdiction to pass<\/p>\n<p>an order in the nature of Ext.P4.\n<\/p>\n<p id=\"p_2\">     3.    On production of a copy of this judgment along<\/p>\n<p>with copy of the writ petition before the RDO, he shall pass<\/p>\n<p>an order on Ext.P3 complaint either by way of preliminary<\/p>\n<p>W.P ( C) No.21096 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>order under Sec. 133 of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.PC<\/a> or otherwise dropping<\/p>\n<p>the same, within two weeks thereof. Obviously Ext.P4 shall<\/p>\n<p>be subject to further orders to be passed by the RDO.
