SANTOSH HEGDE &amp; BISHESHWAR PRASAD SINGH.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">Bisheshwar Prasad Singh, J.\n<\/p>\n<p id=\"p_1\">\tThis appeal is directed against the judgment and order of<br \/>\nthe High Court of Madras dated 21st September, 2002 passed in<br \/>\nCriminal Appeal. No.293 of 1990 filed by the appellants against<br \/>\nthe judgment and order of the Sessions Judge dated 3rd August,<br \/>\n1990 whereby appellants 1 and 2 were found guilty of the<br \/>\noffences under <a href=\"\/doc\/1599401\/\" id=\"a_1\">Sections 341<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_1\">302<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_2\">109<\/a> IPC and appellant No.3<br \/>\nwas found guilty of the offence under <a href=\"\/doc\/1599401\/\" id=\"a_3\">Section 341<\/a> and <a href=\"\/doc\/1560742\/\" id=\"a_4\">302<\/a> IPC.<br \/>\nThe appellants have been sentenced to 6 months rigorous<br \/>\nimprisonment under <a href=\"\/doc\/1599401\/\" id=\"a_5\">Section 341<\/a> IPC and life imprisonment<br \/>\nunder <a href=\"\/doc\/1560742\/\" id=\"a_6\">Section 302<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_7\">109<\/a> and <a href=\"\/doc\/1560742\/\" id=\"a_8\">302<\/a> IPC.  The High Court by the<br \/>\nimpugned judgment and order dismissed the appeal and affirmed<br \/>\nthe judgment and order of the trial court.\n<\/p>\n<p id=\"p_2\">\tSpecial leave was granted limited to the question as to<br \/>\nwhether the offence proved falls under <a href=\"\/doc\/409589\/\" id=\"a_9\">Section 304<\/a> IPC and<br \/>\nwhether the conviction and sentence under <a href=\"\/doc\/1560742\/\" id=\"a_10\">Section 302<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_11\">302<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_12\">109<\/a><br \/>\nIPC calls for modification.\n<\/p>\n<p id=\"p_3\">\tAppellant No.1 Munuswamy is the father of appellants 2<br \/>\nand 3, namely Kumaresan and Selvam.  It is the case of the<br \/>\nprosecution that on 28th April, 1989 at about 3.00 p.m. while<br \/>\nPW.3 Adhimoolam was drying beedi leaves, appellant No.1 came<br \/>\nat about 4.00 p.m. and waited by the side of the road.\tAbout half<br \/>\nan hour later deceased Ravi came on a bicycle.\tHe was followed<br \/>\nby appellants 2 and 3 who also reached the place of occurrence<br \/>\nfollowing him.\tAppellant No.1 stopped the deceased while<br \/>\nappellants 2 and 3 who came from behind dashed their bicycle<br \/>\nagainst the bicycle of the deceased.   The deceased left his<br \/>\nbicycle and started running away chased by the appellants.<br \/>\nUltimately the accused over-powered him and while appellant<br \/>\nNo.1 caught hold of the right hand of the deceased, accused No.2<br \/>\ncaught hold of the left hand of the deceased.\tAppellant No.1<br \/>\nordered that the deceased should be stabbed and immediately<br \/>\nappellant No.3 took out a pen knife from his hip and stabbed the<br \/>\ndeceased on the right side of his chest.   They dragged the<br \/>\ndeceased and made him lie down near the road.  This incident<br \/>\nwas also witnessed by Ravi, PW. 4 who was grazing his cattle<br \/>\nnear the scene of occurrence.  They reported the matter to the<br \/>\nfather of the deceased who went to the police station and lodged<br \/>\nthe complaint.\tAfter investigation, the appellants were put up for<br \/>\ntrail and were ultimately found guilty of the offences as earlier<br \/>\nnoticed.\n<\/p>\n<p id=\"p_4\">\tThe medical evidence on record disclosed the following<br \/>\ninjuries on the body of the deceased :-\n<\/p>\n<p id=\"p_5\">1.\tAn incised gaping wound 8 cm x 3 cm over (R)<br \/>\ninterior aspect of chest at the level of right nipple<br \/>\nwith exposing muscle and rib (4th) beneath.\n<\/p>\n<p id=\"p_6\">2)\tA lacerated wound 3 cm x 2 cm x bone depth seen<br \/>\nover ( R ) side of parietal region.\n<\/p>\n<p id=\"p_7\">3)\tAn abrasion 3 cm x 2 cm seen over ( R ) leg.\n<\/p>\n<p id=\"p_8\">4)\tAn abrasion 4 cm x 3 cm seen over ( R ) buttock<br \/>\nregion.\n<\/p>\n<p id=\"p_9\">On Internal examination : Thorax : An incised<br \/>\nwound 6 cm x 2 cm x lung beneath seen on the<br \/>\nanterior aspect of pleura with 1200 ml. of bloody<br \/>\nfluid in the ( R ) Throacic cavity.  Lungs : Right<br \/>\nlung 510 g. wt.\t An incised wound 2 cm in breath<br \/>\nover the edge of medical aspect of upper lobe of<br \/>\nright lung.  C\/s. normal appearance and pale.  Left<br \/>\nLung : 500 gms. wt. C\/s. normal appearance and<br \/>\npale.\n<\/p>\n<p id=\"p_10\">Heart : 340 g. wt.  Great vessels on the anterior<br \/>\naspect of the Aorta a  cm x  cm punctured like<br \/>\nwound seen at the root of Aorta with clotted blood<br \/>\ncoming out.  On pressure from the Aorta.&#8221;\n<\/p>\n<p id=\"p_11\">\tAccording to PW.2, the doctor who conducted the post<br \/>\nmortem examination on the body of the deceased, the deceased<br \/>\ndied of shock and hemorrhage due to injury on vital organs.  It is<br \/>\nalso the case of the prosecution that the deceased died almost<br \/>\ninstantaneously.\n<\/p>\n<p id=\"p_12\">\tWe have carefully perused the evidence on record and we<br \/>\nfind that this is not a case where the appellants accidentally met<br \/>\nthe deceased with whom they had enmity of some sort, and at the<br \/>\nspur of the moment the assault took place.\n<\/p>\n<p id=\"p_13\">  It was sought to be contended on behalf of the appellants<br \/>\nthat appellant No.1 had merely caught the hand of the deceased<br \/>\nand appellant No.2 also did the same.  It was only appellant No.3<br \/>\nwho stabbed the deceased.  According to learned counsel,<br \/>\nappellants 1 and 2 can only be held guilty of the offence under<br \/>\n<a href=\"\/doc\/1599401\/\" id=\"a_13\">Section 341<\/a> IPC while the appellant No.3 can at best be said to<br \/>\nhave committed an offence punishable under <a href=\"\/doc\/409589\/\" id=\"a_14\">Section 304<\/a> IPC.<br \/>\nThey never intended to commit the murder of the deceased since<br \/>\nthe knife used by appellant No.3 was only a pen knife.\tLearned<br \/>\ncounsel, however, could not controvert the fact that the knife had<br \/>\na long blade enough to cause the injuries of the nature found.\tIt<br \/>\nis also worth noticing that apart from two abrasions there was<br \/>\nalso an incised gaping wound on the chest and a lacerated wound<br \/>\nover the right side of parietal region.\n<\/p>\n<p id=\"p_14\">Having regard to the nature of the injuries and their<br \/>\nlocation, it would be difficult to accept the submission that the<br \/>\nperson who assaulted the deceased with a knife did not intend to<br \/>\ncause the death of the deceased.\n<\/p>\n<p id=\"p_15\">The appellants came to the place of occurrence in a<br \/>\nplanned manner.\t The evidence is clear that appellant No.1 came<br \/>\nfirst and waited by the side of the road.  Thereafter appellants 2<br \/>\nand 3 came on a bicycle closely following the deceased.<br \/>\nAppellant No.1 stopped the deceased and appellants 2 and 3<br \/>\nmade sure that the deceased did not escape by dashing their<br \/>\nbicycle against his bicycle with the result that the deceased had to<br \/>\nabandon his bicycle and run for his life.  Even thereafter they<br \/>\nchased him and while appellants 1 &amp; 2 caught hold of his hands,<br \/>\nappellant No. 3 stabbed him with the knife.  These facts clearly<br \/>\ndisclose a pre-concerted plan to assault the deceased at the place<br \/>\nselected by the appellants.\n<\/p>\n<p id=\"p_16\">Appellant No.1 is said to have exhorted his son to stab the<br \/>\ndeceased.  Obviously he knew that his son was carrying a knife<br \/>\nor some such weapon, otherwise the words &#8216;stab&#8217; would not have<br \/>\nbeen used by appellant No. 1.  He may have merely exhorted his<br \/>\nson to assault the deceased.\tThis itself is a clear indication of<br \/>\nthe fact that accused No. 1, the father, knew that his son was<br \/>\ncarrying a knife.\n<\/p>\n<p id=\"p_17\">In the facts and circumstances of the case we are satisfied<br \/>\nthat so far as appellant No.3 is concerned, he is guilty of the<br \/>\noffence under <a href=\"\/doc\/1560742\/\" id=\"a_15\">Section 302<\/a> IPC.\tIt will not be possible to bring<br \/>\nhis case under any of the exceptions and to record his conviction<br \/>\nand sentence under <a href=\"\/doc\/409589\/\" id=\"a_16\">Section 304<\/a> IPC.\n<\/p>\n<p id=\"p_18\">\t So far as appellants 1 &amp; 2 are concerned, they have also<br \/>\nbeen rightly found guilty of the offence under <a href=\"\/doc\/1560742\/\" id=\"a_17\">Section 302<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_18\">109<\/a><br \/>\nIPC.  The evidence leaves no room of doubt that the appellants<br \/>\nhad entered into a conspiracy for killing the deceased and<br \/>\npursuant thereto appellant No.1 waited at the spot while<br \/>\nappellants 2 and 3 followed the deceased on their bicycle.  All of<br \/>\nthem chased the deceased.  After he was over-powered by<br \/>\nappellants 1 &amp; 2, on the order of appellant No.1, appellant No.3<br \/>\nstabbed him.  It cannot be said in the facts and circumstances of<br \/>\nthe case that the act of appellant No.3 was merely his individual<br \/>\nact, and that appellants 1 and 2 cannot be held guilty of the<br \/>\noffence under <a href=\"\/doc\/1560742\/\" id=\"a_19\">Section 302<\/a>\/<a href=\"\/doc\/513074\/\" id=\"a_20\">109<\/a> IPC.  On the facts found this is a<br \/>\ncase of abetment by conspiracy in which all the conspirators were<br \/>\npresent and actively participated when the plan was executed.\n<\/p>\n<p id=\"p_19\">\tWe, therefore, find no merit in this appeal and the same is<br \/>\naccordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Munnuswamy And Others vs State Of Tamilnadu on 14 August, 2002 Author: B P Singh Bench: N.
