V provide employrnent\nto _    compassionate ground. The\nFederation  the application concluded\n\nthat-the  of the applicant was not its employee\n\n .a:'idt therefore, appointment on compassionate ground\n\n   Being aggrieved by the said finding\n\nthat .._'\u00a7f1er \"husband was not a Government servant,\n\n A~ applicant had filed Writ Petition No.15062\/2005 and it\n\n disposed of on 16.10.2006 and the Karnataka Co-\n\n\"loperative Fisheries Federation Limited was directed to\n\n\n\nconsider the same and decide it in accordance with law.\n\nThe said Federation declined to appoint on\n\ncompassionate ground on the ground  \n\nwas not its employee. Thereforeillan'applicationjxgasfiied it\n\nfor direction to the respondent~..Departrrirgnt' of op<\/pre>\n
Husbandry and Fisheries toiiconsidei’   for
\ncompassionate  application was
\nresisted by the Stateibiyt  the husband of
\nthe applicailtigzas   Karnataka Co-\n<\/p>\n
operative?   and he died while

\nthereiorxe,”  a government servant, the<\/p>\n
applicant a is “not” ‘entitled to appointment on<\/p>\n
 .coinpEa.ssion_ate ground. The Tribunal after considering<\/p>\n
 ‘tits?  of counsel appearing for the parties and<\/p>\n
ori”\u00ab-Veri\ufb01cation of the records found that, Dyavegowda,<\/p>\n
 ehuusband of the applicant was appointed by the<\/p>\n
“I(l}oVernment as driver in the Fisheries Development<\/p>\n
‘ ‘ ”'”Corporation. It is clearly stated in the said order that,<\/p>\n
we<\/p>\n
the appointment is by the Government and appointee
\nwill be on deputation to the Karnataka Co–operative<\/p>\n
Inland Fisheries Federation and therefore’;”\u00abthe_: S_tat.e<\/p>\n
cannot now contend that Dyavegovvda_:’fvvas: not”
\nGovernment servant and in lvievvrcoff the .,fact”Vth_atw:.;t1ie ‘<\/p>\n
application was pending -for    _:\\\u00a7yevarsi,t\u00bb<\/p>\n
directed the Director 0fl4h”‘;AIij.1jI1al  Hnsbaiadry and
\nFisheries to consideethe  accordance with
\nlaw within three mo1’it1*1sfpositivelj,T  the date of the<\/p>\n
order. Being   t.l*1ef saidlmolrder of the Tribunal<\/p>\n
dated  ‘Statehas preferred this appeal.
\n “We   the learned Government
\nAdvocate ‘appearing’ for petitioners.<\/p>\n
 Tilgearned Government Advocate submitted that<\/p>\n
 ._i’l’7._e.1 the applicant Dyavegowda was not a<\/p>\n
Govettnrnent Servant and he was on deputation to<\/p>\n
“V * E{a_rna’taka Co–operative Inland Fisheries Federation
\n‘rid the said Federation is now closed and Dyavegowda<\/p>\n
 was not a Government servant and therefore, the<\/p>\n
question of appointment of the applicant on the<\/p>\n
compassionate ground would not arise.<\/p>\n
5. We have given careful consideration<\/p>\n
contentions of the learned Government  <\/p>\n
scrutinized the material on recordf’ <\/p>\n
6. T he material on Vrecord lvvozuld clearly <\/p>\n
that, the Tribunal on verificatioia of theporiginal’ records
\nhas held that, a temp’or_ary driver  created in
\nFisheries Development  Government<\/p>\n
retrospectivelg\/’lfrxoin and…..vwl3yavegowda was<\/p>\n
appoirgtedly  as driver to that post
\nretrospectively It is clearly stated in<\/p>\n
the ,S8Jd o’rder~.*that ‘lithe appointment is by the<\/p>\n
d V. “”Governin*entA..and appointee will be on deputation to<\/p>\n
 i’the.i-_Karnatva}rVa-Cooperative Inland Fisheries Federation<\/p>\n
and”\u00ab\u00abthere’fonr\u00a7’e; now it is not open to the State to contend<\/p>\n
Jthat_ Dvavegowda who died while in service was not a<\/p>\n
 e._’G.ov’e’1’nment Servant, as his order of appointment itself<\/p>\n
  would clearly show that he was treated as government<\/p>\n

shall be disposed off within three months from today.<\/p>\n
Accordingly, the writ petition is disrnissed.<\/p>\n
