Justice ANTONY DOMINIC\n\n Dated :09\/07\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                 W.P.(C) NO. 20405 OF 2010 (A)\n                =====================\n\n              Dated this the 9th day of July, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner is the husband of a serving military personnel. He<\/p>\n<p>was working as       a Pharmacist under the Taluk Headquarters,<\/p>\n<p>Hospital, Kodungallur.      Based on Ext.P1 Government Order<\/p>\n<p>providing certain concessions to employees like the petitioner, he<\/p>\n<p>sought an inter district transfer to Pathanamthitta, the home<\/p>\n<p>district. Though by Ext.P2, his claim was allowed, there was no<\/p>\n<p>vacancy to accommodate him, and therefore, he was not posted.<\/p>\n<p>That led to filing of writ petitions resulting in Exts.P3 and P4<\/p>\n<p>judgments. Finally, by Exts.P5 and P6, he was accommodated in<\/p>\n<p>a deputation vacancy at Konny in Pathanamthitta District.<\/p>\n<p id=\"p_1\">      2.    While so, on the allegation that the petitioner did not<\/p>\n<p>comply with the direction to report for Sabarimala duty,<\/p>\n<p>disciplinary action was initiated against the petitioner resulting in<\/p>\n<p>Ext.P14 order of suspension. In an appeal that was filed by the<\/p>\n<p>petitioner, pursuant to the orders passed by the Government,<\/p>\n<p>Ext.P16 order was passed by the 2nd respondent ordering<\/p>\n<p>reinstatement of the petitioner in Pathanamthitta District itself<\/p>\n<p>WPC No. 20405\/10<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :2 :<\/span><\/p>\n<p>with a rider that the petitioner will not be posted at Konny.<\/p>\n<p id=\"p_2\">     3.    The petitioner then submitted representations pointing<\/p>\n<p>out the existence of three vacancies at Kallooppara, Puramattom<\/p>\n<p>and Vennikulam, which according to the petitioner are stations<\/p>\n<p>nearer to his residential place. However, by Ext.P19 order, he was<\/p>\n<p>posted at Malayalapuzha. According to the petitioner, Ext.P19<\/p>\n<p>posting him at Malayalapuzha was issued without complying with<\/p>\n<p>the directions in Ext.P18 judgment requiring the 2nd respondent<\/p>\n<p>to consider the petitioner&#8217;s claim for accommodation in any one of<\/p>\n<p>the aforesaid stations. It is on that premise, the writ petition has<\/p>\n<p>been filed.\n<\/p>\n<p id=\"p_3\">     4.    Learned Government Pleader has obtained instructions<\/p>\n<p>in the matter. According to him, Ext.P18 judgment was received<\/p>\n<p>by the 3rd respondent on 24\/6\/2010, and that, prior to that, on<\/p>\n<p>15\/6\/2010, Ext.P19 order was issued posting the petitioner at<\/p>\n<p>Malayalapuzha. It is also submitted that before the receipt of<\/p>\n<p>Ext.P18, three vacancies pointed out by the petitioner were filled<\/p>\n<p>up, and it was therefore that the 3rd respondent could not<\/p>\n<p>accommodate the petitioner at the stations pointed out by him.<\/p>\n<p id=\"p_4\">     5.    If as stated by the learned Government Pleader, the<\/p>\n<p>WPC No. 20405\/10<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :3 :<\/span><\/p>\n<p>vacancies indicated by the petitioner were filled up prior to the<\/p>\n<p>receipt of Ext.P18 judgment, this Court cannot find fault with the<\/p>\n<p>3rd respondent on the ground that Ext.P19 order was passed<\/p>\n<p>without considering the claim of the petitioner. Therefore, Ext.P19<\/p>\n<p>is unassailable.
