Justice P.Q.BARKATH ALI\n\n Dated :14\/12\/2010\n\n O R D E R\n              A.K.BASHEER &amp; P.Q.BARKATH ALI, JJ.\n               =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n                    M.A.C.A.No. 539 of 2007\n               =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n           Dated this the 14th day of December, 2010\n\n                          JUDGMENT\n<\/pre>\n<p id=\"p_1\">Barkath Ali, J.\n<\/p>\n<p id=\"p_1\">      Appellant is 3rd respondent\/Insurance Company in O.P.<\/p>\n<p>(MV) No.698 of 2001 on the file of the Motor Accidents Claims<\/p>\n<p>Tribunal, Vadakara. In this appeal the appellant challenges the<\/p>\n<p>judgment and award of the Tribunal dated July 31, 2006<\/p>\n<p>awarding a compensation of Rs.5,94,600\/- for the loss caused<\/p>\n<p>to the claimant on account of the injuries sustained in a motor<\/p>\n<p>accident.\n<\/p>\n<p id=\"p_2\">      2. Claimant in the O.P. sustained the following injuries in<\/p>\n<p>a motor accident that occurred on May 25, 2000 :-<\/p>\n<blockquote id=\"blockquote_1\"><p>      1) Lacerated wound 4 x 1 bone deep occiptal<br \/>\n          region.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      2) Fracture of left sigma.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      3) Epistaxis.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      4) Contusion on the servical code.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      5) Fracture of servical spine and the subluxation of<br \/>\n          C3, C4 vertebra with minimal disk collapse and<br \/>\n          myelemalacia of the code.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA 539\/2007                 2<\/span><\/p>\n<\/blockquote>\n<p id=\"p_3\">At the time of the accident he was aged 55 and was working<\/p>\n<p>as Railway Shunting Master Panamboor at Mangalore. The<\/p>\n<p>accident happened while the claimant working near M.C.M.<\/p>\n<p>Factory Railway Gate, a lorry hit the railway gate and as a<\/p>\n<p>result of which he sustained injuries and become paraplegic.<\/p>\n<p>Alleging negligence against 2nd respondent in the O.P.\/driver<\/p>\n<p>of the offending lorry, the claimant filed the O.P. before the<\/p>\n<p>Tribunal under <a href=\"\/doc\/136948773\/\" id=\"a_1\">section 166<\/a> of the Motor Vehicles Act claiming<\/p>\n<p>a compensation of Rs.6 lakhs.\n<\/p>\n<p id=\"p_4\">      3. Respondents 1 and 2 in the O.P., the owner and driver<\/p>\n<p>of the offending lorry, remained absent before the Tribunal.<\/p>\n<p>The 3rd respondent\/insurer of the offending lorry filed a written<\/p>\n<p>statement admitting the policy. PW1 was examined and<\/p>\n<p>Exts.A1 to A13 and Exts.X1 to X3 were marked on the side of<\/p>\n<p>the claimant. Exts.B1 was marked on the side of the<\/p>\n<p>respondents. On an appreciation of the evidence, the Tribunal<\/p>\n<p>found that the accident happened due to negligence of the 2nd<\/p>\n<p>respondent in the O.P. and awarded a compensation of<\/p>\n<p>Rs.5,94,600\/- with interest at 6% p.a. from the date of petition<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA 539\/2007                  3<\/span><\/p>\n<p>till realization and cost of Rs.15,000\/-.      The 3rd respondent<\/p>\n<p>Insurance Company has come up in appeal challenging the<\/p>\n<p>quantum of compensation awarded by the Tribunal.<\/p>\n<p id=\"p_5\">       4. Heard learned counsel for the appellant and learned<\/p>\n<p>counsel for the 3rd respondent, claimant.<\/p>\n<p id=\"p_6\">       5. The finding of the Tribunal that the accident occurred<\/p>\n<p>due to the negligence of the 2nd respondent\/driver of the lorry<\/p>\n<p>and that the claimant sustained injuries mentioned above in<\/p>\n<p>the accident are not challenged in this appeal. Therefore, the<\/p>\n<p>only question, which arises for consideration, is whether the<\/p>\n<p>compensation awarded by the Tribunal is excessive.<\/p>\n<p id=\"p_7\">       6.   Tribunal   awarded      a  total     compensation     of<\/p>\n<p>Rs.5,94,600\/-. Break up of the compensation awarded is as<\/p>\n<p>under:-\n<\/p>\n<pre id=\"pre_1\">       1) Pain and suffering         :   Rs. 50,000\/-\n       2) Hospital expenses          :   Rs. 16,600\/-\n       3) Mental shock and           :   Rs. 30,000\/-\n           inconvenience caused.\n\n       4) Permanent happy life       :   Rs. 30,000\/-\n           including the marital life.\n       5) Loss of income             :   Rs. 72,000\/-\n       6) Permanent disability       :   Rs.3,96,000\/-\n                                      -------------------------\n\n<span class=\"hidden_text\" id=\"span_2\">MACA 539\/2007                 4<\/span>\n\n           Total                   :   Rs.5,94,600\/-\n                                      =========\n\n<\/pre>\n<p id=\"p_8\">      7. The Tribunal took the monthly income of the claimant<\/p>\n<p>as Rs.6,000\/-, took the percentage of disability as 50%, as<\/p>\n<p>assessed by the Medical Board, adopted a multiplier of 11 and<\/p>\n<p>awarded a compensation of Rs.3,96,000\/- for the disability<\/p>\n<p>caused.\n<\/p>\n<p id=\"p_9\">      8. Learned counsel for the appellant contended that the<\/p>\n<p>monthly income taken by the Tribunal as Rs.6,000\/- is on the<\/p>\n<p>higher side and that as the claimant was aged 55 at the time of<\/p>\n<p>the accident, the proper multiplier ought to have been adopted<\/p>\n<p>by the Tribunal 8 instead of 11.\n<\/p>\n<p id=\"p_10\">      9. As regards the monthly income taken by the Tribunal<\/p>\n<p>as Rs.6,000\/-, we find force in the contention of the appellant<\/p>\n<p>that it is on the higher side. The claimant was working as a<\/p>\n<p>Railway Shunting Master at Panambcer, Mangalore. He was<\/p>\n<p>earning a salary of Rs.7,230\/- as evidenced by Ext.A13 series<\/p>\n<p>pay slips. As he was aged 55 at the time of the accident, he has<\/p>\n<p>to retire at the age of 60 and will be earning pension.<\/p>\n<p>Therefore, we feel that the monthly income of the claimant for<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">MACA 539\/2007                 5<\/span><\/p>\n<p>the purpose of assessing the compensation for the disability<\/p>\n<p>caused can be taken as Rs.5,000\/-. As regards the multiplier<\/p>\n<p>adopted by the Tribunal as 11 and the percentage of disability<\/p>\n<p>as 50% assessed by the Medical Board, we find the same to be<\/p>\n<p>reasonable. Thus, calculated for the disability caused, the<\/p>\n<p>claimant is entitled to a compensation of Rs.3,30,000\/-<\/p>\n<p>(Rs.5,000\/- x 12 x 11 x 50%) instead of Rs.3,96,000\/-.<\/p>\n<p id=\"p_11\">      10. There is another aspect in this case. The Tribunal<\/p>\n<p>awarded Rs.72,000\/- for the loss of earning for one year. As<\/p>\n<p>compensation is awarded for the disability caused and for loss<\/p>\n<p>of earning power, separate compensation should not have been<\/p>\n<p>awarded by the Tribunal towards loss of earning. As regards<\/p>\n<p>the compensation awarded under other heads, we find the<\/p>\n<p>same to be reasonable and therefore we are not disturbing the<\/p>\n<p>same.\n<\/p>\n<p id=\"p_12\">      11. In the result, the claimant is found entitled to a<\/p>\n<p>compensation     of Rs.4,56,600\/- instead     of Rs.5,93,600\/-<\/p>\n<p>awarded by the Tribunal. The Tribunal awarded interest only<\/p>\n<p>@ 6% per annum from the date of petition till realization,<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">MACA 539\/2007                6<\/span><\/p>\n<p>which appears to be very low. The claimant is entitled to<\/p>\n<p>interest @ 7.5% per annum from the date of petition till<\/p>\n<p>realization.
