Mr.N.Anandakumar\n\n\n^For Respondents  ...  \tMr.K.Chellapandian,\n\t\t\tAdditional Public Prosecutor.\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">(Order of the Court was made by P.D.DINAKARAN, J)<\/p>\n<p>\t\tThe challenge in this habeas corpus petition is to the order of<br \/>\ndetention, dated 11.12.2004, passed by the   second  respondent against one<br \/>\nVellaichamy (hereinafter referred as &#8220;the detenu&#8221;), branding him as a<br \/>\n&#8220;Bootlegger&#8221; and directing preventive detention under Section 3(1) of the Tamil<br \/>\nNadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest<br \/>\nOffenders, Goondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates<br \/>\nAct, 1982 <a href=\"\/doc\/195458\/\" id=\"a_1\">(Tamil Nadu Act<\/a> 14 of 1982) read with the orders issued by the<br \/>\nGovernment in G.O.(D)No.275, Prohibition and Excise (XVI) Department, dated 18th<br \/>\nOctober 2004 under sub-section (2) of <a href=\"\/doc\/1800148\/\" id=\"a_2\">Section 3<\/a> of the said Act.   The<br \/>\npetitioner is the wife of the detenu.\n<\/p>\n<p id=\"p_1\">\t\t2.Learned counsel for the petitioner would submit that a pre-<br \/>\ndetention representation, dated 23.11.2004, was sent by the petitioner to the<br \/>\ndetaining authority making several allegations against the sponsoring authority,<br \/>\nbut the same was not considered by the detaining authority and if at all the<br \/>\nsame has been considered and disposed of, it might have been mentioned  in the<br \/>\ngrounds of detention, but there is no mention about the same and, therefore, on<br \/>\nthis ground, the order of detention is liable to be quashed.\n<\/p>\n<p id=\"p_2\">\t\t3.We have heard the learned Additional Public Prosecutor on the<br \/>\nabove aspect and also perused the material available on record.\n<\/p>\n<p id=\"p_3\">\t\t4.The specific contention of the learned counsel for the petitioner<br \/>\nis that even though the petitioner had made a pre-detention representation on<br \/>\n23.11.2004, the same was not considered and disposed of by the detaining<br \/>\nauthority before passing the detention order.  The respondents in their counter<br \/>\naffidavit have stated that the pre-detention representation, dated 24.11.2004,<br \/>\nwas, in fact, duly considered, but rejected before passing the detention order.<br \/>\nConcededly,  even assuming that it was considered and rejected, the same is not<br \/>\navailable either in the book-let supplied to the detenu  nor a mention is made<br \/>\nabout this in the grounds of detention and, in our considered view, this<br \/>\nvitiates the impugned order of detention.  This view stands supported by an<br \/>\nearlier decision of the Apex Court in DISTRICT MAGISTRATE  V.  R. KUMARAVEL,<br \/>\nreported in 1994 SCC (Crl.) 229, a Division Bench decision of this Court in SYED<br \/>\nALI, T.M.  V.  STATE OF TAMIL NADU, reported in 1999(2) CTC 490, which have been<br \/>\nfollowed in the decision rendered in HCP No.1965 of 2000, decided on 23.01.2001,<br \/>\nin which one of us (P.D.DINAKARAN,J) is a party.\n<\/p>\n<p id=\"p_4\">\t\t5.For the said reason, this habeas corpus petition is allowed and<br \/>\nthe impugned order of detention, dated 11.12.2004, in Crl.M.P.No.84\/2004, passed<br \/>\nby the second respondent, is quashed.
