JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/02\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThis<br \/>\napplication has been filed with the following prayers:\n<\/p>\n<p id=\"p_1\">a)\tThis<br \/>\nHon&#8217;ble Court be pleased to issue fresh notice and give direct<br \/>\nservice to the present applicants for serving upon opponents Nos.23<br \/>\nand 29 at the addresses given hereunder:\n<\/p>\n<p id=\"p_2\">No.23.\tPravinchandra<br \/>\nChinubhai Sheth, Resident of 4, Shantiniketan Society, Gujarat<br \/>\nCollege Road, Near Art Palace, Ellisbridge, Ahmedabad.\n<\/p>\n<p id=\"p_3\">No.29.\tUpendra<br \/>\nKanubhai Amin, Resident of 6, Viswajit Society, Near Vijay Char<br \/>\nRasta, Navrangpura, Ahmedabad.\n<\/p>\n<p id=\"p_4\">b)\tThis<br \/>\nHon&#8217;ble Court be pleased to permit the applicants to bring the legal<br \/>\nheirs of deceased Sitaben on the record of the case, the names and<br \/>\naddresses of whom are as under:\n<\/p>\n<p id=\"p_5\">(i)\tAmrishbhai<br \/>\nR.Patel<\/p>\n<p id=\"p_6\">(ii)\tBabubhai<br \/>\nR.Patel<\/p>\n<p id=\"p_7\">(iii)\tRameshbhai<br \/>\nR.Patel<\/p>\n<p>\tAll<br \/>\nadults, resident of 27, Nirat Park, Opp.Sun &amp; Step Club, Thaltej,<br \/>\nAhmedabad<\/p>\n<p id=\"p_8\">c)\tThis<br \/>\nHon&#8217;ble Court be pleased to condone the abatement as well as delay,<br \/>\nif any, caused in bringing the heirs of opponent No.31 in the<br \/>\ninterest of justice.\n<\/p>\n<p id=\"p_9\">d)\tSuch<br \/>\nother and further reliefs as this Hon&#8217;ble Court may deem just and<br \/>\nexpedient be granted in favour of the applicants.\n<\/p>\n<p id=\"p_10\">\tI<br \/>\nhave heard Mr.M.B.Gandhi, learned counsel for the applicants and<br \/>\nMr.Pradeep Patel, learned counsel for respondents Nos.1\n<\/p>\n<p id=\"p_11\">&#8211; 5, 5\/2, 5\/3   8, 10 &#8211; 11, 13\/1, 13\/2\n<\/p>\n<p id=\"p_12\">&#8211; 19, 21, and have perused the averments made in the application.\n<\/p>\n<p id=\"p_13\">\tIt<br \/>\nis submitted by Mr.M.B.Gandhi, learned counsel for the applicants,<br \/>\nthat respondent No.31   Sitaben Ramabhai Patel expired on<br \/>\n14.08.2007 and her heirs  and legal representatives who are sought to<br \/>\nbe  brought on the record of the petition, have already been<br \/>\nimpleaded in First Appeal No.220 of 2009 pending in the High Court,<br \/>\nby allowing Civil Application No.601 of 2009 and, inadvertently, this<br \/>\naspect could not be mentioned in the cause-title of the petition.\n<\/p>\n<p id=\"p_14\">\tMr.Pradeep<br \/>\nPatel, learned counsel for  for respondents Nos.1 &#8211; 5, 5\/2, 5\/3<br \/>\n8, 10 &#8211; 11, 13\/1, 13\/2 &#8211; 19, 21, has no objection if the prayers made<br \/>\nin the application are granted.\n<\/p>\n<p id=\"p_15\">\tAccordingly,<br \/>\nthe application is allowed. Fresh Notices be issued to respondents<br \/>\nNos.23 and 29 at the addresses given in paragraph-3(a) of the<br \/>\napplication, making them returnable on 03.03.2010.\n<\/p>\n<p id=\"p_16\">\tThe<br \/>\ndelay that has occasioned in filing the application is condoned and<br \/>\nthe abatement is set aside and it is directed that the heirs of<br \/>\ndeceased Sitaben Ramabhai Patel, original respondent No.31, as<br \/>\ndescribed in paragraph 3(b) of the application, be brought on the<br \/>\nrecord of Special Civil Application No.12191 of 2009 and the<br \/>\ncause-title thereof be amended accordingly.
