Justice V.GIRI\n\n Dated :11\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">06\/2008\n\n O R D E R\n                     V.GIRI, J.\n       -------------------------\n         W.P.(C).No<\/a>.29774 of 2006 T\n       -------------------------\n        Dated this the 11th day of June, 2008.\n\n\n                   JUDGMENT\n<\/pre>\n<p id=\"p_1\">       The petitioner, who retired from the<\/p>\n<p>Water Authority as an Assistant Executive<\/p>\n<p>Engineer, is aggrieved by the non-disbursal<\/p>\n<p>of the Death cum Retirement Gratuity due to<\/p>\n<p>him.\n<\/p>\n<p id=\"p_1\">       2. The only dispute is whether the<\/p>\n<p>excess amount paid to one Mr.Jayaprakashan,<\/p>\n<p>who was working as NMR worker, pursuant to<\/p>\n<p>the orders issued by the then Assistant<\/p>\n<p>Executive Engineer, on the basis of which<\/p>\n<p>the  petitioner,      who     was    the     Assistant<\/p>\n<p>Engineer, had prepared the bill, should be<\/p>\n<p>treated as the liability of the petitioner.<\/p>\n<p>Reference is made to Ext.P4 judgment filed<\/p>\n<p>by the aforementioned Mr.Jayaprakashan.            The<\/p>\n<p>question as to whether the amount should be<\/p>\n<p>recovered from Mr.Jayaprakashan or not has<\/p>\n<p>not been finally decided in the said writ<\/p>\n<p>petition.  But, it was made clear that the<\/p>\n<p>W.P.(C).NO.29774\/06<\/p>\n<p>                     :: 2 ::\n<\/p>\n<p id=\"p_2\">\npetitioner therein shall be proceeded with<\/p>\n<p>only if other similarly situated persons are<\/p>\n<p>also proceeded with.\n<\/p>\n<p id=\"p_3\">       3. The counter affidavit filed by the<\/p>\n<p>Water Authority is silent on this aspect.  In<\/p>\n<p>my view, it may not be justified on the part<\/p>\n<p>of the Water Authority to withhold the Death<\/p>\n<p>cum   Retirement    Gratuity   due  to    the<\/p>\n<p>petitioner, without there being any certainty<\/p>\n<p>as regards the liability of Mr.Jayaprakashan,<\/p>\n<p>even as on date.\n<\/p>\n<p id=\"p_4\">       5.   In the result, the writ petition<\/p>\n<p>is disposed of directing the 1st respondent<\/p>\n<p>to disburse to the petitioner the Death cum<\/p>\n<p>Retirement Gratuity due to him, within one<\/p>\n<p>month from today.       The petitioner shall<\/p>\n<p>execute a bond in terms of Note 5 of Rule 116<\/p>\n<p>of Part III of the Kerala Service Rules, as a<\/p>\n<p>condition   for   obtaining   the Death   cum<\/p>\n<p>Retirement Gratuity.
