Justice K.SURENDRA MOHAN\n\n Dated :20\/01\/2011\n\n O R D E R\n<\/pre>\n<p id=\"p_1\">             R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n<\/p>\n<p id=\"p_1\">          &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p id=\"p_2\">                   W.P.(Civil) No.9243 of 2010\n<\/p>\n<p id=\"p_3\">          &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n           Dated this the 20th day of January, 2011<\/p>\n<p>                              Judgment<\/p>\n<p>Basant, J.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">       The petitioner has come to this court with this writ petition<\/p>\n<p>under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India for issue of<\/p>\n<p>directions for respondents 1 to 3 to afford police protection to<\/p>\n<p>operate stage carriage No.KL-16\/D-7051 on the route kadakkal-<\/p>\n<p>Attingal without any obstruction or interference by respondents 4<\/p>\n<p>to 6.\n<\/p>\n<p id=\"p_6\">       2. According to the petitioner, he is the registered owner of<\/p>\n<p>the said vehicle. He has the stage carriage permit to operate the<\/p>\n<p>vehicle in his name. He has his own employees to run the vehicle<\/p>\n<p>also. Respondents 4 to 6, according to the petitioner, have<\/p>\n<p>nothing to do with the petitioner&#8217;s vehicle. They are employees of<\/p>\n<p>one Rajeev who is the owner and permit holder in respect of<\/p>\n<p>another vehicle No.KL-16\/D-7657. Respondents 4 to 6 who have<\/p>\n<p>nothing to do with the petitioner and petitioner&#8217;s vehicle are<\/p>\n<p>illegally obstructing the operation of the service of the petitioner.<\/p>\n<p>It is in these circumstances, the petitioner has come to this court.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 9243\/2010                    2<\/span><\/p>\n<p id=\"p_7\">      3. This writ petition was admitted on 19.3.2010. On<\/p>\n<p>23.3.2010 interim directions were issued to respondents 1 to 3 &#8220;to<\/p>\n<p>give adequate police protection for the willing workers of the<\/p>\n<p>petitioner to ply his vehicle KL-16\/D-7051 on the route Kadakkal-<\/p>\n<p>Attingal as per the permit as against respondents 4 to 6&#8221;. This<\/p>\n<p>interim direction which was initially for a period of 10 days has<\/p>\n<p>been extended from time to time.\n<\/p>\n<p id=\"p_8\">      4. Respondents 5 and 6 have entered appearance. They<\/p>\n<p>have filed counter affidavit. They contend that it is incorrect to<\/p>\n<p>say that respondents 5 and 6 are not employees in the vehicle<\/p>\n<p>KL-16\/D-7051 operating on the route Kadakkal-Attingal. It is true<\/p>\n<p>that this bus and the permit stand in the name of the petitioner<\/p>\n<p>herein, but really and actually the petitioner is only a name<\/p>\n<p>lender. A close relative of the petitioner herein by name Rajeev is<\/p>\n<p>really in control of the situation. He has two vehicles, KL-16\/D-<\/p>\n<p>7051 and KL-16\/D-7657 referred above. To deny benefits to the<\/p>\n<p>workers, the records were maintained in the name of two<\/p>\n<p>different individuals. The said Rajeev is not available in India and<\/p>\n<p>is employed abroad. One Sadanandan, the father of said Rajeev<\/p>\n<p>is actually carrying on the management of both vehicles together.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 9243\/2010                   3<\/span><\/p>\n<p>The petitioner and the said Rajeev and Sadanandan are resorting<\/p>\n<p>to unfair labour practice to deny legitimate dues and benefits to<\/p>\n<p>the employees in the two vehicles. The party respondents have<\/p>\n<p>no intention to obstruct the running of the vehicle KL-16\/D-7051.<\/p>\n<p>They only want to raise peaceful protest. They want to raise an<\/p>\n<p>industrial dispute. Rights of the employees are trammelled upon<\/p>\n<p>and benefits are not being paid to the employees. Already the<\/p>\n<p>labour authorities have been moved. But the petitioner is not co-<\/p>\n<p>operating with the labour authorities. In these circumstances, the<\/p>\n<p>constitutional powers under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> cannot be invoked in<\/p>\n<p>favour of the petitioner herein. This petition may be dismissed<\/p>\n<p>and the interim order may be vacated, submits the learned<\/p>\n<p>counsel for respondents 5 and 6.\n<\/p>\n<p id=\"p_9\">     5. The learned Government Pleader after taking instructions<\/p>\n<p>submits that there is a labour dispute between the parties and<\/p>\n<p>the respective contentions are as indicated above. There is no<\/p>\n<p>obstruction to the running of the vehicle. Now necessary<\/p>\n<p>protection is being afforded in the light of the interim order. If<\/p>\n<p>there will be any obstruction, necessary police protection shall be<\/p>\n<p>afforded without any prejudice to the rights of the employees to<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">WPC 9243\/2010                    4<\/span><\/p>\n<p>raise the industrial dispute and complain about the alleged unfair<\/p>\n<p>labour practice and victimization by the employer of the two<\/p>\n<p>vehicles against the employees including respondents 5 and 6.<\/p>\n<p id=\"p_10\">      6. We record the submission made on behalf of respondents<\/p>\n<p>5 and 6 that they shall not obstruct the plying of the vehicle. We<\/p>\n<p>make it clear that we have not intended to express any opinion<\/p>\n<p>on merits about the labour dispute raised by the parties. It shall<\/p>\n<p>be open to the parties to get their disputes resolved in<\/p>\n<p>accordance with law. We further make it clear that we have not<\/p>\n<p>intended in any manner to prevent the rights of the employees<\/p>\n<p>including respondents 5 and 6 to demonstrate peacefully<\/p>\n<p>demanding redressal of their grievances as employees. In the<\/p>\n<p>light of the undertaking by respondents 5 and 6 that the peaceful<\/p>\n<p>plying of the vehicle shall not be obstructed and in the light of the<\/p>\n<p>undertaking by respondents 1 to 3 that if there is obstruction,<\/p>\n<p>necessary police protection shall be afforded, we are satisfied no<\/p>\n<p>further directions are necessary. In the light of the said<\/p>\n<p>undertaking given, we do not want to invoke our powers under<\/p>\n<p><a href=\"\/doc\/1712542\/\" id=\"a_2\">Article 226<\/a> of the Constitution and issue any specific directions.<\/p>\n<p>We repeat that we have not intended to express any opinion on<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">WPC 9243\/2010                   5<\/span><\/p>\n<p>merits about the contentions of the rival sides about the stand<\/p>\n<p>taken by them in the labour dispute. Documents have been<\/p>\n<p>produced in respect of the rival contentions. We are carefully<\/p>\n<p>avoiding any detailed reference to them lest it may prejudice the<\/p>\n<p>interest of the either parties.\n<\/p>\n<p id=\"p_11\">     7.
