No.3089 of 2006)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p id=\"p_1\">1.\tLeave granted.\n<\/p>\n<p id=\"p_2\">2.\tChallenge in this appeal is to the order passed by a<br \/>\nlearned Single Judge of the Punjab and Haryana High Court<br \/>\nallowing the Revision Petition filed under <a href=\"\/doc\/1571667\/\" id=\"a_1\">Section 401<\/a> of the<br \/>\nCode of Criminal Procedure, 1973 (in short the &#8216;Code&#8217;) which<br \/>\nwas filed before it by Kurra Ram since deceased and<br \/>\nrepresented by his daughter i.e. respondent No.2 in the<br \/>\npresent appeal.\n<\/p>\n<p id=\"p_3\">3.\tBackground facts in a nutshell are as follows:\n<\/p>\n<p id=\"p_4\">\tA complaint was filed by the aforesaid Kurra Ram<br \/>\nalleging commission of offences punishable under <a href=\"\/doc\/538436\/\" id=\"a_1\">Sections<br \/>\n498-A<\/a>, <a href=\"\/doc\/988620\/\" id=\"a_2\">406<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_3\">323<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_4\">506<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_5\">148<\/a> and <a href=\"\/doc\/999134\/\" id=\"a_6\">149<\/a> of the Indian Penal Code,<br \/>\n1860 (in short the &#8216;<a href=\"\/doc\/1569253\/\" id=\"a_7\">IPC<\/a>&#8216;) by Jaswant-son in law and husband<br \/>\nof his daughter-Saroj, Ran Singh and Raj Bala, the present<br \/>\nappellants who were father and mother of Jaswant and two<br \/>\nothers namely, Jai Singh and Suman, the brother and married<br \/>\nsister of Jaswant.\n<\/p>\n<p id=\"p_5\">\tIt was stated in the complaint that Saroj got married to<br \/>\nJaswant on 14.4.1994 and that she was harassed for dowry by<br \/>\nthe aforesaid accused persons. Learned Additional Chief<br \/>\nJudicial Magistrate, Hissar, after recording preliminary<br \/>\nevidence of the complainant, decided to proceed against all the<br \/>\naccused persons for the alleged offences. Separate Revision<br \/>\nPetitions were filed by Jai Singh, Ran Singh and Suman taking<br \/>\nthe stand that there is no offence made out so far as they are<br \/>\nconcerned. Learned Additional Sessions Judge found that no<br \/>\ncase was made out against aforesaid accused persons and<br \/>\ndirected that proceedings would continue only against<br \/>\nJaswant. The order dated 4.11.2003 disposing of the revisions<br \/>\nin the aforesaid manner was challenged by Kurra Ram in the<br \/>\nRevision Petition before the High Court. It was held by High<br \/>\nCourt that there is no ground to proceed against Jai Singh and<br \/>\nSuman who may just be living in the house, but may not be<br \/>\ninterfering in matrimonial problems of Saroj and Jaswant.<br \/>\nTherefore, the order of the Additional Sessions Judge was<br \/>\nupheld to that extent. But so far as the present appellants are<br \/>\nconcerned the High Court inter alia observed as follows:\n<\/p>\n<p id=\"p_6\">&#8220;However, when articles of dowry are handed<br \/>\nover to elder members in the family that will<br \/>\nmean that those were handed over to Ran<br \/>\nSingh and Raj Bala i.e.  father and mother of<br \/>\nthe husband who could misappropriate. It is<br \/>\nthey who can practice cruelty for less dowry or<br \/>\notherwise.&#8221;\n<\/p>\n<p id=\"p_7\">\t\t\t(Underlined for emphasis)<\/p>\n<p>\tThe High Court noted that police had earlier registered a<br \/>\ncase and had sent cancellation report and thereafter the<br \/>\ncomplaint was filed by Kurra Ram who appeared as PW-1, as<br \/>\nhis son Rajesh appeared as PW-2 and Saroj as PW-3.\n<\/p>\n<p id=\"p_8\">4.\tLearned counsel for the appellants submitted that the<br \/>\nHigh Court failed to notice that some customary articles were<br \/>\ngiven to relatives of the bridegroom. That cannot be covered by<br \/>\nthe expression &#8216;dowry&#8217;. High Court noticed the fact that the<br \/>\ncomplainant tried to rope even a married sister who was living<br \/>\nfar away and the brother, which shows the tendency to falsely<br \/>\nimplicate them. Reference is also made to the following<br \/>\nobservations of the High Court:\n<\/p>\n<p id=\"p_9\">&#8220;..They are close relatives but the fact remains<br \/>\nthat an effort is made by the complainant to<br \/>\nimplicate as many persons as possible, in such<br \/>\nmatters.&#8221;\n<\/p>\n<p id=\"p_10\">5.\tLearned counsel for the respondent-State and the<br \/>\ncomplainant submitted that it is not a case where the<br \/>\nAdditional Sessions Judge should have interfered and the High<br \/>\nCourt has therefore rightly set aside the order dated 4.11.2003<br \/>\nwhich was impugned before it.\n<\/p>\n<p id=\"p_11\">6.\t<a href=\"\/doc\/1249134\/\" id=\"a_8\">Section 2<\/a> of the Dowry Prohibition Act, 1961 (in short<br \/>\n&#8216;<a href=\"\/doc\/1763444\/\" id=\"a_9\">Dowry Act<\/a>&#8216;) defines &#8220;dowry&#8221; as under:-\n<\/p>\n<p id=\"p_12\"><a href=\"\/doc\/1249134\/\" id=\"a_10\">Section 2<\/a>. Definition of &#8216;dowry&#8217;  In this Act,<br \/>\n&#8216;dowry&#8217; means any property or valuable<br \/>\nsecurity given or agreed to be given either<br \/>\ndirectly or indirectly <\/p>\n<p id=\"p_13\">(a) by one party to a marriage to the<br \/>\nother party to the marriage; or<\/p>\n<p id=\"p_14\">(b)\tby the parents of either party to a<br \/>\nmarriage or by any other person, to<br \/>\neither party to the marriage or to any<br \/>\nother person, <\/p>\n<p>at or before or any time after the marriage in<br \/>\nconnection with the marriage of the said<br \/>\nparties, but does not include dower or mehr<br \/>\nin the case of persons to whom the Muslim<br \/>\npersonal law (Shariat) applies.\n<\/p>\n<p id=\"p_15\">Explanation I- For the removal of doubts, it is<br \/>\nhereby declared that any presents made at<br \/>\nthe time of a marriage to either party to the<br \/>\nmarriage in the form of cash, ornaments,<br \/>\nclothes or other articles, shall not be deemed<br \/>\nto be dowry within the meaning of this<br \/>\nsection, unless they are made as<br \/>\nconsideration for the marriage of the said<br \/>\nparties.\n<\/p>\n<p id=\"p_16\">Explanation II- The expression &#8216;valuable<br \/>\nsecurity&#8217; has the same meaning in <a href=\"\/doc\/1320984\/\" id=\"a_11\">Section 30<\/a><br \/>\nof the Indian Penal Code (45 of 1860).&#8221;\n<\/p>\n<p id=\"p_17\">7.\tThe word &#8220;dowry&#8221; is defined in <a href=\"\/doc\/1249134\/\" id=\"a_12\">Section 2<\/a> of the Dowry<br \/>\nAct. Thus, there are three occasions related to dowry. One is<br \/>\nbefore the marriage, second is at the time of marriage and the<br \/>\nthird &#8220;at any time&#8221; after the marriage. The third occasion may<br \/>\nappear to be unending period. But the crucial words are &#8220;in<br \/>\nconnection with the marriage of the said parties&#8221;. Other<br \/>\npayments which are customary payments e.g. given at the<br \/>\ntime of birth of a child or other ceremonies as are prevalent in<br \/>\ndifferent societies are not covered by the expression &#8220;dowry&#8221;.<br \/>\n(<a href=\"\/doc\/1521945\/\" id=\"a_13\">See Satvir Singh v. State of Punjab<\/a> (2001 (8) SCC 633))<br \/>\n.\n<\/p>\n<p id=\"p_18\">8.\tThe High Court has fallen in grave error while observing<br \/>\nthat present appellants &#8220;could misappropriate&#8221; and &#8220;who can<br \/>\npractice cruelty&#8221;. The conclusions to say the least are<br \/>\npresumptuous. Learned Additional Sessions Judge by a well<br \/>\nreasoned order had held that there was no material to show<br \/>\nthat demand for any dowry was made and an attempt was<br \/>\nmade to rope in many persons. When the High Court was<br \/>\ninterfering with such conclusions arrived at on facts it ought<br \/>\nto have indicated the reasons necessitating such interference.<br \/>\nThat has not been done and on the contrary on presumptuous<br \/>\nconclusions the order of learned Additional Sessions Judge<br \/>\nhas been set aside.\n<\/p>\n<p id=\"p_19\">9.\tReasons introduce clarity in an order. On plainest<br \/>\nconsideration of justice, the High Court ought to have set forth<br \/>\nits reasons, howsoever brief, in its order indicative of an<br \/>\napplication of its mind. The absence of reasons has rendered<br \/>\nthe High Court&#8217;s judgment not sustainable.\n<\/p>\n<p id=\"p_20\">10.\tEven in respect of administrative orders Lord Denning<br \/>\nM.R. in Breen v. Amalgamated Engineering Union (1971 (1) All<br \/>\nE.R. 1148) observed &#8220;The giving of reasons is one of the<br \/>\nfundamentals of good administration&#8221;. In Alexander Machinery<br \/>\n(Dudley) Ltd. v. Crabtree (1974 LCR 120) it was observed:<br \/>\n&#8220;Failure to give reasons amounts to denial of justice&#8221;. Reasons<br \/>\nare live links between the mind of the decision taker to the<br \/>\ncontroversy in question and the decision or conclusion arrived<br \/>\nat&#8221;. Reasons substitute subjectivity by objectivity. The<br \/>\nemphasis on recording reasons is that if the decision reveals<br \/>\nthe &#8220;inscrutable face of the sphinx&#8221;, it can, by its silence,<br \/>\nrender it virtually impossible for the Courts to perform their<br \/>\nappellate function or exercise the power of judicial review in<br \/>\nadjudging the validity of the decision. Right to reason is an<br \/>\nindispensable part of a sound judicial system, reasons at least<br \/>\nsufficient to indicate an application of mind to the matter<br \/>\nbefore Court. Another rationale is that the affected party can<br \/>\nknow why the decision has gone against him. One of the<br \/>\nsalutary requirements of natural justice is spelling out reasons<br \/>\nfor the order made, in other words, a speaking out. The<br \/>\n&#8220;inscrutable face of a sphinx&#8221; is ordinarily incongruous with a<br \/>\njudicial or quasi-judicial performance.\n<\/p>\n<p id=\"p_21\">11.\tIt is to be noted that the High Court itself has held that<br \/>\nthere was an attempt to rope in many persons and it did not<br \/>\nfind any merit or challenge to the discharge of the married<br \/>\nsister and the brother.\n<\/p>\n<p id=\"p_22\">12.\tAbove being the position, the impugned order of the High<br \/>\nCourt cannot be maintained and is set aside. We make it clear<br \/>\nthat we have not expressed any opinion on merits so far as<br \/>\nhusband Jaswant is concerned.\n<\/p>\n<p id=\"p_23\">13.\tThe appeal is allowed to the aforesaid extent.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ran Singh And Anr vs State Of Haryana And Anr on 30 January, 2008 Author: .
