Criminal Revision Application No.400 of 2010<br \/>\nhas been filed by   wife and daughter of respondent No.2 (they shall<br \/>\nbe hereinafter to be referred to respectively accordingly).<br \/>\nRespondent No.2 (hereinafter to be referred to as &#8216;the husband&#8217;) has<br \/>\nfiled Special Criminal Application No.1455 of 2010. Both sides are<br \/>\nchallenging the  same judgment of the Family Court, Surat  dated 24th<br \/>\nJune 2010 passed in Criminal Misc. Application No.16 of 2008.\n<\/p>\n<p id=\"p_1\">\tBetween<br \/>\nthe husband and the wife, matrimonial disputes developed. Wife<br \/>\nthereupon had to seek maintenance under <a href=\"\/doc\/1056396\/\" id=\"a_1\">section 125<\/a> of the Criminal<br \/>\nProcedure Code.  The same was granted at the rate of Rs.500\/- and<br \/>\nRs.300\/- per month to the wife and the daughter respectively. She<br \/>\nthereupon filed for application for enhancement of maintenance  under<br \/>\n<a href=\"\/doc\/778934\/\" id=\"a_1\">section 127<\/a> of the Criminal Procedure Code on 12.9.2002.   Thereafter<br \/>\n on behalf of the minor application  Ex.47 was filed  before the<br \/>\nFamily Court stating, inter alia, that in the application under<br \/>\n<a href=\"\/doc\/778934\/\" id=\"a_2\">section 127<\/a>,   maintenance at the rate of Rs.3500\/- per month was<br \/>\nclaimed in favour of the daughter. However, thereafter, cost of<br \/>\neducation   has gone up considerably and she may therefore be granted<br \/>\nmaintenance   at the rate of Rs.9,000\/- per month.  This application<br \/>\nwas kept for hearing along with the  main matter.   Finally, the<br \/>\nlearned Judge passed the impugned order awarding Rs.3500\/- per month<br \/>\nto each of the claimants by way of maintenance.  Both sides have<br \/>\nchallenged this order.  Whereas the case of the wife and the daughter<br \/>\nis that  they are entitled to higher  maintenance, case of the<br \/>\nhusband is that increase granted  by the Family Court ought not to<br \/>\nhave been applied from the date of the application   i.e. 12.9.2002.<br \/>\nIt is also the case  of the husband that the daughter after  crossing<br \/>\n18 years of age cannot get maintenance under <a href=\"\/doc\/1056396\/\" id=\"a_3\">section 125<\/a> of the<br \/>\nCriminal Procedure Code.\n<\/p>\n<p id=\"p_2\">\tIt<br \/>\nis not in dispute that presently, the husband is employed as<br \/>\nTradesman in Kakrapar Atomic Station.  His salary slip for the month<br \/>\nof March 2010 reveals that he earns gross salary of Rs.27,271\/-.  Of<br \/>\ncourse, there would be certain compulsory deductions such as, income<br \/>\ntax, etc. which the husband would have to  pay,  which would to some<br \/>\nextent reduce the said income.  Nonetheless, considering his sizable<br \/>\ntake-home salary of approximately Rs.25,000\/- as of now, the<br \/>\nmaintenance  required to be paid to the wife and the daughter needs<br \/>\nto be worked out.  While doing so, one must bear in mind that in the<br \/>\nyear 2002, the income of the husband  would not have been as much as<br \/>\nhis present income.  Simultaneously, I am conscious of the fact that<br \/>\nthe daughter admittedly  crossed 18 years  of age on 23rd<br \/>\nSeptember 2010.  As per <a href=\"\/doc\/1056396\/\" id=\"a_4\">section 125<\/a> of the Criminal Procedure Code,<br \/>\ntherefore, thereafter  there cannot be any maintenance from the<br \/>\nfather  under the said provision at least.\n<\/p>\n<p id=\"p_3\">\tOn<br \/>\nthe one hand, I would have to, therefore,  provide for  reduced<br \/>\nmaintenance  in favour of the wife and daughter from the year 2002,<br \/>\non the other, at least under <a href=\"\/doc\/1056396\/\" id=\"a_5\">section 125<\/a> of the Criminal Procedure<br \/>\nCode,  the daughter  would  cease to  get maintenance after  she<br \/>\nbecame major.  This would lead to a larger saving for the husband.<br \/>\nThe wife, therefore, could legitimately  seek higher maintenance from<br \/>\nthe husband.  I am conscious  that the wife has not prayed for<br \/>\nmaintenance higher than that of Rs.3500\/- per month. This was,<br \/>\nhowever, on the basis that she yielded to her daughter&#8217;s larger<br \/>\ndemand and greater need considering the young age and education that<br \/>\nshe is pursuing.  Simultaneously,  I may also record that if the case<br \/>\nof husband is that  the moment the daughter turns 18, she will not be<br \/>\nentitled to maintenance, he may have to move application under<br \/>\n<a href=\"\/doc\/778934\/\" id=\"a_6\">section 127<\/a> of the Code and   the wife also could file application<br \/>\nunder <a href=\"\/doc\/778934\/\" id=\"a_7\">section 127<\/a> for higher maintenance for her.  However, in such<br \/>\nissues where question of sustenance of the wife and  the daughter are<br \/>\n concerned which touches directly the human lives and when relevant<br \/>\nfacts are undisputed,   such extra-technical approach would not be<br \/>\njustified.\n<\/p>\n<p id=\"p_4\">\tUnder<br \/>\nthe circumstances, I am of the opinion that the husband should pay<br \/>\nmaintenance to his wife and daughter at the rate of Rs.2500\/- (Two<br \/>\nthousand five hundred only) and Rs.1500\/- (One thousand  five hundred<br \/>\nonly) from 12.9.2002 till 1.1.2005.  From 1.1.2005, he shall pay<br \/>\nmaintenance at the rate of Rs.2500\/- (Two thousand five hundred only)<br \/>\n each  till 1st January 2009 (around the time  when the<br \/>\n6th Pay Commission  recommendations were implemented in<br \/>\nGovernment and Semi Government organizations of course with<br \/>\nretrospective effect).  From 1st January 2009  till 23rd<br \/>\nSeptember 2010, he shall pay maintenance to the wife at the rate of<br \/>\nRs.3500\/- (Three thousand five hundred only)  and to the daughter at<br \/>\nthe rate of Rs.5000\/- (Five thousand only).  From 24th<br \/>\nSeptember 2010 onwards, the husband shall pay maintenance to the wife<br \/>\nat the rate of Rs.9,000\/-  (Nine thousand only) per month. The<br \/>\ndaughter  from the said date onwards  shall not get any maintenance<br \/>\nunder <a href=\"\/doc\/1056396\/\" id=\"a_8\">section 125<\/a> of the Criminal Procedure Code.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\nSpecial Criminal Application No.1455 of 2010,  under order dated<br \/>\n1.9.2010 passed by this Court, the husband has  deposited a sum of<br \/>\nRs.50,000\/- before the Family Court, which shall be  paid over to the<br \/>\nwife, if not already done so, without waiting for  the no objection<br \/>\nfrom the husband which shall be adjusted towards arrears.\n<\/p>\n<p id=\"p_6\">\tOn<br \/>\ncondition that the husband deposits further  sum of Rs.25,000\/- with<br \/>\nthe Family Court, Surat latest by 29th October 2010 and<br \/>\nthereafter clears the entire arrears as per this order in four equal<br \/>\n installments falling due once every alternate month,  first of which<br \/>\n will fall due on 1st December 2010 and continues to pay<br \/>\nthe prospective maintenance to the wife regularly, there shall be no<br \/>\ncoercive  recovery against him, failing which it will be open for the<br \/>\nFamily Court to recover the same in accordance with law.\n<\/p>\n<p id=\"p_7\">\tBoth<br \/>\nthe petitions stand disposed of accordingly.\n<\/p>\n<p id=\"p_8\">\t\t\t\t\t\t\t(Akil<br \/>\nKureshi, J.)   <\/p>\n<p>(vjn)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Premilaben vs State on 21 October, 2010 Author: Akil Kureshi,&amp;Nbsp;
