THAKKER, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">1.       Delay condoned. Leave granted.<\/p>\n<p id=\"p_3\">2.       The present appeal is filed against an<\/p>\n<p>order of conviction and sentence recorded by<\/p>\n<p>the Chief Judicial Magistrate, Hailakandi on<\/p>\n<p>September 21, 2002, confirmed by the Sessions<\/p>\n<p>Judge,   Hailakandi   on   May   26,   2003    and   also<\/p>\n<p>confirmed by the High Court of Assam on July<\/p>\n<p>31, 2007.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                      2<\/span><\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">3.           Few   relevant      facts    of     the    case    are<\/p>\n<p>that on June 15, 1995, according to the case of<\/p>\n<p>the prosecution, one Moinul Haque Laskar lodged<\/p>\n<p>a    First   Information        Report    (FIR)        before   the<\/p>\n<p>Officer-in-charge,         Hailakandi          Police    Station.<\/p>\n<p>In the FIR, it was alleged by the informant<\/p>\n<p>complainant that his brother Abdul Haque Laskar<\/p>\n<p>had gone to cultivate land early in the morning<\/p>\n<p>at about 6.30 a.m. Eight accused as mentioned<\/p>\n<p>in the FIR armed with deadly weapons attacked<\/p>\n<p>Abdul Haque Laskar and caused grievous injuries<\/p>\n<p>on different parts of his body. On hearing hue<\/p>\n<p>and cry of the complainant Moinul Haque Laskar<\/p>\n<p>and    his    brothers,       several      persons        arrived<\/p>\n<p>there. The accused persons fled away and the<\/p>\n<p>injured      was   taken   to    hospital.        On    receiving<\/p>\n<p>FIR,     Officer-in-charge         of     Hailakandi       Police<\/p>\n<p>Station registered Case No. 195 of 1995 against<\/p>\n<p>the     accused      for      commission         of      offences<\/p>\n<p>punishable under <a href=\"\/doc\/1258372\/\" id=\"a_1\">Sections 147<\/a>, <a href=\"\/doc\/1133601\/\" id=\"a_1\">325<\/a> and <a href=\"\/doc\/180217\/\" id=\"a_2\">506<\/a> of<\/p>\n<p>Indian       Penal     Code        (IPC)         and      started<\/p>\n<p>investigation.         During            the      course         of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                      3<\/span><\/p>\n<p>investigation, several statements came to be<\/p>\n<p>recorded.    The       injured     was     examined      by     the<\/p>\n<p>Medical     Officer       and     a      charge     sheet       was<\/p>\n<p>submitted      for       offences         punishable          under<\/p>\n<p><a href=\"\/doc\/1258372\/\" id=\"a_3\">Sections 147<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_4\">323<\/a>, <a href=\"\/doc\/1540253\/\" id=\"a_5\">326<\/a> and <a href=\"\/doc\/180217\/\" id=\"a_6\">506<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_7\">IPC<\/a> against all<\/p>\n<p>the accused.\n<\/p>\n<p id=\"p_6\">4.         The charge was read over and explained<\/p>\n<p>to the accused who pleaded `not guilty&#8217; and<\/p>\n<p>claimed to be tried. The prosecution, in order<\/p>\n<p>to prove the case against the accused, examined<\/p>\n<p>five witnesses including injured Abdul Haque<\/p>\n<p>Laskar,     Medical       Officer        and      Investigating<\/p>\n<p>Officer.    The    `defence&#8217;       did     not     examine      any<\/p>\n<p>witness. In the statement under <a href=\"\/doc\/767287\/\" id=\"a_8\">Section 313<\/a> of<\/p>\n<p>the   Code        of     Criminal         Procedure,          1973<\/p>\n<p>(hereinafter referred to as `the Code&#8217;), the<\/p>\n<p>accused denied the incident and involvement in<\/p>\n<p>any manner whatsoever.\n<\/p>\n<p id=\"p_7\">5.         The learned Chief Judicial Magistrate,<\/p>\n<p>Hailakandi vide his judgment and order dated<\/p>\n<p>September    21,       2002,     held    the      case   against<\/p>\n<p>accused proved for offences punishable under<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                                  4<\/span><\/p>\n<p><a href=\"\/doc\/1258372\/\" id=\"a_9\">Sections     147<\/a>     and   <a href=\"\/doc\/724142\/\" id=\"a_10\">324<\/a>,    <a href=\"\/doc\/1569253\/\" id=\"a_11\">IPC<\/a>.      On     sentence,<\/p>\n<p>however,     the    learned     Magistrate        noted    that<\/p>\n<p>accused Islam Uddin (accused No.5), Sahab Uddin<\/p>\n<p>(accused No.6), Aftab Uddin (accused No.3) and<\/p>\n<p>Fakar    Uddin     (accused   No.2)    were       young.    He,<\/p>\n<p>therefore, thought it fit to grant benefit of<\/p>\n<p>releasing them on admonition since they did not<\/p>\n<p>appear to have committed any offence in past<\/p>\n<p>nor   they   were    involved     in   any   offence.      The<\/p>\n<p>learned Judicial Magistrate, however, convicted<\/p>\n<p>Abdul    Subhan      (accused     No.1),      Abdul       Wahid<\/p>\n<p>(accused No.7), Abdul Kuddus (accused No.8) and<\/p>\n<p>Muslim     Uddin     (accused     No.4)      for     offences<\/p>\n<p>punishable under <a href=\"\/doc\/1258372\/\" id=\"a_12\">Sections 147<\/a> and <a href=\"\/doc\/724142\/\" id=\"a_13\">324<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_14\">IPC<\/a>. For<\/p>\n<p>an offence punishable under <a href=\"\/doc\/1258372\/\" id=\"a_15\">Section 147<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_16\">IPC<\/a>,<\/p>\n<p>the learned Magistrate ordered the abovestated<\/p>\n<p>accused to undergo simple imprisonment for one<\/p>\n<p>month and a fine of Rs.100 each, in default,<\/p>\n<p>simple    imprisonment     for    five     days.     For    the<\/p>\n<p>offence punishable under <a href=\"\/doc\/724142\/\" id=\"a_17\">Section 324<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_18\">IPC<\/a>, he<\/p>\n<p>ordered them to undergo simple imprisonment for<\/p>\n<p>two months and a fine of Rs.200\/- each, in<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                                                      5<\/span><\/p>\n<p>default, simple imprisonment for ten days. The<\/p>\n<p>sentences were ordered to run concurrently.<\/p>\n<p id=\"p_8\">6.        Being        aggrieved         by    the     order    of<\/p>\n<p>conviction       and    sentence,         all     the     accused<\/p>\n<p>preferred Criminal Appeal No. 20 of 2002. The<\/p>\n<p>learned    Sessions         Judge   upheld       the    order    of<\/p>\n<p>conviction as well as sentence and dismissed<\/p>\n<p>the appeal.\n<\/p>\n<p id=\"p_9\">7.        The four accused who were ordered to<\/p>\n<p>undergo    substantive        sentence,         then    preferred<\/p>\n<p>Criminal Revision No. 331 of 2003. The High<\/p>\n<p>Court,    by    the    impugned     order,       dismissed      the<\/p>\n<p>revision holding that no illegality could be<\/p>\n<p>said to have been committed by both the Courts<\/p>\n<p>below.    The    said    order      is    challenged      in    the<\/p>\n<p>present appeal.\n<\/p>\n<p id=\"p_10\">8.        On April 1, 2008, the Hon&#8217;ble Chamber<\/p>\n<p>Judge    granted      the    prayer      for    exemption      from<\/p>\n<p>surrendering in view of short sentence imposed<\/p>\n<p>on the appellants. The matter was then placed<\/p>\n<p>before the Court for admission hearing on April<\/p>\n<p>28, 2008. On that day, it was stated by the<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                                                                      6<\/span><\/p>\n<p>learned     counsel     for     the   appellants        that    the<\/p>\n<p>parties had entered into an amicable settlement<\/p>\n<p>and though the offence punishable under <a href=\"\/doc\/724142\/\" id=\"a_19\">Section<\/p>\n<p>324<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_20\">IPC<\/a> has now been made non-compoundable, at<\/p>\n<p>the time when the offence was committed, it was<\/p>\n<p>compoundable. The Court, in view of the above<\/p>\n<p>statement,       issued        notices      by    making       them<\/p>\n<p>returnable early. Notice was also ordered to be<\/p>\n<p>issued to injured Abdul Haque Laskar. Notices<\/p>\n<p>were accordingly served on respondents.<\/p>\n<p id=\"p_11\">9.          We have heard learned counsel for the<\/p>\n<p>parties.\n<\/p>\n<p id=\"p_12\">10.         The learned counsel for the appellants<\/p>\n<p>submitted that the parties have compromised the<\/p>\n<p>matter,      entered      into        settlement        and      an<\/p>\n<p>application        is   made    to    that    effect     praying<\/p>\n<p>therein     that    compounding       may    be   ordered       for<\/p>\n<p>offences punishable under <a href=\"\/doc\/1258372\/\" id=\"a_21\">Sections 147<\/a> and <a href=\"\/doc\/724142\/\" id=\"a_22\">324<\/a>,<\/p>\n<p><a href=\"\/doc\/1569253\/\" id=\"a_23\">IPC<\/a> and an appropriate order in accordance with<\/p>\n<p>law   may   be     passed.      Compromise       deed   is     also<\/p>\n<p>placed on record signed by the parties wherein<\/p>\n<p>it is expressly stated that the injured Abdul<br \/>\n<span class=\"hidden_text\" id=\"span_5\">                                                                    7<\/span><\/p>\n<p>Haque Laskar has voluntarily given his consent<\/p>\n<p>without     any   force,      threat,     coercion,         undue<\/p>\n<p>influence,     pressure       etc.,     from     any    quarter<\/p>\n<p>whatsoever     for     making    the     joint     compromise<\/p>\n<p>petition     before     this     Court.    A     prayer      is,<\/p>\n<p>therefore, made by all the parties to compound<\/p>\n<p>the offence and acquit the three appellants who<\/p>\n<p>have approached this Court.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">11.         Now it is no doubt true that every<\/p>\n<p>crime is considered to be an offence against<\/p>\n<p>the society as a whole and not only against an<\/p>\n<p>individual even though an individual might have<\/p>\n<p>suffered thereby. It is, therefore, the duty of<\/p>\n<p>the State to take appropriate action against<\/p>\n<p>the offender. It is equally the duty of a Court<\/p>\n<p>of    law   administrating        criminal       justice      to<\/p>\n<p>punish a criminal.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">12.         But there are offences and offences.<\/p>\n<p>Certain     offences    are     very    serious        in   which<\/p>\n<p>compromise or settlement is not permissible.<br \/>\n<span class=\"hidden_text\" id=\"span_6\">                                                                        8<\/span><\/p>\n<p>Some other offences, on the other hand, are not<\/p>\n<p>so serious and the law may allow the parties to<\/p>\n<p>settle them by entering into a compromise. The<\/p>\n<p>compounding of an offence signifies that the<\/p>\n<p>person     against      whom       an      offence       has   been<\/p>\n<p>committed has received some gratification to an<\/p>\n<p>act as an inducement for his abstaining from<\/p>\n<p>proceeding        further      with        the    case     [<a href=\"\/doc\/1981864\/\" id=\"a_24\">Vinjay<\/p>\n<p>Devanna Nayak v. Ryot Sewa Sahkari Bank Ltd<\/a>.,<\/p>\n<p>(2008) 2 SCC 305].\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">13.        So     far   as<a href=\"\/doc\/1569253\/\" id=\"a_25\">     the      Code<\/a>      is   concerned,<\/p>\n<p><a href=\"\/doc\/895891\/\" id=\"a_26\">Section     320<\/a>    deals      with        offences     which      are<\/p>\n<p>compoundable, either by the parties without the<\/p>\n<p>leave of the Court or by the parties but only<\/p>\n<p>with the leave of the Court. Sub-section (1) of<\/p>\n<p><a href=\"\/doc\/895891\/\" id=\"a_27\">Section 320<\/a> enumerates the offences which are<\/p>\n<p>compoundable without the leave of the Court,<\/p>\n<p>while     sub-section        (2)     of     the    said    section<\/p>\n<p>specifies the offences which are compoundable<\/p>\n<p>with the leave of the Court. Sub-section (9) of<\/p>\n<p><a href=\"\/doc\/895891\/\" id=\"a_28\">Section    320<\/a>     declares;       &#8220;No      offence       shall    be<br \/>\n<span class=\"hidden_text\" id=\"span_7\">                                                              9<\/span><\/p>\n<p>compounded except as provided by this section&#8221;.<\/p>\n<p>It is thus clear that offences not referred to<\/p>\n<p>in sub-sections (1) and (2) of <a href=\"\/doc\/895891\/\" id=\"a_29\">Section 320<\/a> and<\/p>\n<p>not included in the Table are not compoundable.<\/p>\n<p>Similarly, offences punishable under laws other<\/p>\n<p>than<a href=\"\/doc\/1569253\/\" id=\"a_30\">    the   Indian   Penal    Code<\/a>   also    cannot    be<\/p>\n<p>compounded.\n<\/p>\n<p id=\"p_19\">\n<p id=\"p_20\">14.       Sub-section (8) of <a href=\"\/doc\/895891\/\" id=\"a_31\">Section 320<\/a> of the<\/p>\n<p>Code     expressly     enacts      that       where     the<\/p>\n<p>composition of an offence under this section is<\/p>\n<p>recorded by the Court, it shall have effect of<\/p>\n<p>an    acquittal   of   the   accused    with    whom    the<\/p>\n<p>offence has been compounded.\n<\/p>\n<p id=\"p_21\">\n<p id=\"p_22\">15.       Under<a href=\"\/doc\/1569253\/\" id=\"a_32\"> the Code<\/a>, as originally enacted<\/p>\n<p>in 1973, an offence punishable under <a href=\"\/doc\/724142\/\" id=\"a_33\">Section<\/p>\n<p>324<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_34\">IPC<\/a> (voluntarily causing hurt by dangerous<\/p>\n<p>weapons or means) was made compoundable with<\/p>\n<p>the leave of the Court. The said entry read as<\/p>\n<p>under:\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                                   10<\/span><\/p>\n<p id=\"p_23\">\n<blockquote id=\"blockquote_1\"><p>                        TABLE<\/p>\n<p>          Offence     Section of Person by whom<br \/>\n                      the Indian offence may be<a href=\"\/doc\/1569253\/\" id=\"a_35\"><br \/>\n                      Penal Code<\/a>    compounded<br \/>\n                      Applicable<br \/>\n<span class=\"hidden_text\" id=\"span_9\">             1             2             3<\/span><br \/>\n      Voluntarily         324    The person to<br \/>\n      causing hurt by            whom hurt is<br \/>\n      dangerous                  caused.<br \/>\n      weapons or<br \/>\n      means.\n<\/p><\/blockquote>\n<p id=\"p_24\">16.       It is no doubt true as stated by the<\/p>\n<p>learned counsel for the appellants even at the<\/p>\n<p>time of preliminary hearing of this matter that<\/p>\n<p>by<a href=\"\/doc\/1569253\/\" id=\"a_36\"> the Code<\/a> of <a href=\"\/doc\/1474968\/\" id=\"a_37\">Criminal Procedure (Amendment)<\/p>\n<p>Act<\/a>, 2005 (Act 25 of 2005) the above entry has<\/p>\n<p>been deleted. In other words, an offence of<\/p>\n<p>voluntarily causing hurt by dangerous weapons<\/p>\n<p>or means punishable under <a href=\"\/doc\/724142\/\" id=\"a_38\">Section 324<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_39\">IPC<\/a> is<\/p>\n<p>no more compoundable. <a href=\"\/doc\/1210757\/\" id=\"a_40\">The Amendment Act<\/a> of 2005<\/p>\n<p>came into force from June 23, 2006.<\/p>\n<p id=\"p_25\">17.       As we have already noted, according to<\/p>\n<p>the prosecution, the appellants had committed<br \/>\n<span class=\"hidden_text\" id=\"span_10\">                                                                 11<\/span><\/p>\n<p>the offence on June 15, 1995. In view of the<\/p>\n<p>above fact, in our opinion, Act 25 of 2005 has<\/p>\n<p>no application to the facts of the case. We,<\/p>\n<p>therefore, see no ground to refuse permission<\/p>\n<p>as sought by the parties who have compromised<\/p>\n<p>the offence which was compoundable under<a href=\"\/doc\/1569253\/\" id=\"a_41\"> the<\/p>\n<p>Code<\/a>   as    it   stood      in    1995.   If    it   is   so,<\/p>\n<p>compounding       can   be        permitted     and   accused<\/p>\n<p>(appellants) can be acquitted.\n<\/p>\n<p id=\"p_26\">\n<p id=\"p_27\">18.         For   the   foregoing       reasons,      in   our<\/p>\n<p>opinion, the appeal deserves to be allowed and<\/p>\n<p>is accordingly allowed by holding that since<\/p>\n<p>the matter has been compounded by compromise<\/p>\n<p>between the parties and there is no illegality<\/p>\n<p>therein, such compounding can be permitted by<\/p>\n<p>the Court. The appellants are, hence, entitled<\/p>\n<p>to acquittal.\n<\/p>\n<p id=\"p_28\">\n<p id=\"p_29\">19.         The order of conviction and sentence<\/p>\n<p>recorded by all Courts is hereby set aside and<br \/>\n<span class=\"hidden_text\" id=\"span_11\">                                                                                       12<\/span><\/p>\n<p>the appellants are ordered to be acquitted of<\/p>\n<p>the charges levelled against them.<\/p>\n<p id=\"p_30\">                         &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;J.<br \/>\n                         (C.K.
