As such, in the decision of the learned Single Judge, the<br \/>\n\treference is made to the decision of the Apex Court in the case of<br \/>\n\tNaubat Ram Sharma Vs. Additional District Judge, reported in AIR<br \/>\n\t1987 SC 1352, which is a decision under <a href=\"\/doc\/427855\/\" id=\"a_1\">Article 136<\/a> of the<br \/>\n\tConstitution of India and not under <a href=\"\/doc\/100581\/\" id=\"a_1\">section 5<\/a> of the Limitation Act.<br \/>\n\t However, Mr.Pahwa fairly submitted that the learned Single Judge<br \/>\n\twanted to refer to another decision of the Apex Court in the case of<br \/>\n\tCollector, Land Acquisition, Anantnag Vs. Khatiji, which is reported<br \/>\n\ton the next page, i.e., AIR 1987 SC 1353.  Even if the decision in<br \/>\n\tthe case of Collector, Land Acquisition, Anantnag Vs. Khatiji<br \/>\n\treported at AIR 1987 SC 1353 is to be considered, the same has been<br \/>\n\tsubsequently considered by the Apex Court itself in its subsequent<br \/>\n\tdecision in the case of Oriental Aroma Chemical Industries Ltd. Vs.<br \/>\n\tGujarat Industrial Development Corporation and another reported in<br \/>\n\t(2010) 5 SCC 459 wherein the Apex Court after considering the<br \/>\n\taforesaid decision in the case of Collector, Land Acquisition,<br \/>\n\tAnantnag Vs. Khatiji, has observed at paras 14 to 16 as under:\n<\/p>\n<p id=\"p_2\">&#8220;14.We<br \/>\nhave considered the respective submissions. The law of limitation is<br \/>\nfounded on public policy. The legislature does not prescribe<br \/>\nlimitation with the object of destroying the rights of the parties<br \/>\nbut to ensure that they do not resort to dilatory tactics and seek<br \/>\nremedy without delay. The idea is that every legal remedy must be<br \/>\nkept alive for a period fixed by the legislature. To put it<br \/>\ndifferently, the law of limitation prescribes a period within which<br \/>\nlegal remedy can be availed for redress of the legal injury. At the<br \/>\nsame time, the courts are bestowed with the power to condone the<br \/>\ndelay, if sufficient cause is shown for not availing the remedy<br \/>\nwithin the stipulated time.\n<\/p>\n<p id=\"p_3\">15.\tThe<br \/>\nexpression &#8220;sufficient cause&#8221; employed in <a href=\"\/doc\/100581\/\" id=\"a_2\">Section 5<\/a> ofthe<br \/>\nIndian Limitation Act, 1963 and similar other statutes is elastic<br \/>\nenough to enable the courts to apply the law in a meaningful manner<br \/>\nwhich sub serves the ends of justice. Although, no hard and fast rule<br \/>\ncan be laid down in dealing with the applications for condonation of<br \/>\ndelay, this Court has justifiably advocated adoption of a liberal<br \/>\napproach in condoning the delay of short duration and a stricter<br \/>\napproach where the delay is inordinate &#8211; <a href=\"\/doc\/1117226\/\" id=\"a_3\">Collector, Land Acquisition,<br \/>\nAnantnag v. Mst<\/a>. <a href=\"\/doc\/1240908\/\" id=\"a_4\">Katiji, N. Balakrishnan v. M. Krishnamurthy<\/a> and     <\/p>\n<p><a href=\"\/doc\/1206100\/\" id=\"a_5\">Vedabai v. Shantaram Baburao Patil<\/a>.\n<\/p>\n<p id=\"p_4\">16.\tIn<br \/>\ndealing with the applications for condonation of delay filed on<br \/>\nbehalf of the State and its agencies\/instrumentalities this Court<br \/>\nhas, while emphasizing that same yardstick should be applied for<br \/>\ndeciding the applications for condonation of delay filed by private<br \/>\nindividuals and the State, observed that certain amount of latitude<br \/>\nis not impermissible in the latter case because the State represents<br \/>\ncollective cause of the community and the decisions are taken by the<br \/>\nofficers\/agencies at a slow pace and encumbered process of pushing<br \/>\nthe files from table to table consumes considerable time causing<br \/>\ndelay &#8211; <a href=\"\/doc\/1994192\/\" id=\"a_6\">G. Ramegowda v. Spl. Land Acquisition Officer<\/a>, <a href=\"\/doc\/852301\/\" id=\"a_7\">State of<br \/>\nHaryana v. Chandra Mani<\/a>, <a href=\"\/doc\/1367797\/\" id=\"a_8\">State of U.P. v. Harish Chandra<\/a>, <a href=\"\/doc\/1110842\/\" id=\"a_9\">State of<br \/>\nBihar v. Ratan Lal Sahu<\/a>, <a href=\"\/doc\/1298319\/\" id=\"a_10\">State of Nagaland v. Lipok AO<\/a>, and <a href=\"\/doc\/1962587\/\" id=\"a_11\">State<br \/>\n(NCT of Delhi) v. Ahmed Jaan<\/a>.&#8221;\n<\/p>\n<p id=\"p_5\">Thereafter,<br \/>\n\tthe delay of 4 years which was condoned by the High Court was not<br \/>\n\tupheld by the Apex Court.  It was also submitted by the learned<br \/>\n\tcounsel that the affidavit-in-reply has been filed, but no reasons<br \/>\n\tare mentioned dealing with the same.\n<\/p>\n<p id=\"p_6\">The<br \/>\n\tlearned counsel for the appellant has further placed on record the<br \/>\n\tcopy of the order dated 03.12.2010 passed by the learned Single<br \/>\n\tJudge in the First Appeal, whereby while adjourning the matter to<br \/>\n\t10.12.2010, the cost is imposed of Rs.5,000\/- upon the appellant<br \/>\n\therein who is respondent in the appeal before the learned Single<br \/>\n\tJudge.  It was submitted that since the LPA was to come up today on<br \/>\n\tboard, the motion of adjournment was made and upon the said motion,<br \/>\n\tthe learned Single Judge has passed the order.\n<\/p>\n<p id=\"p_7\">Hence,<br \/>\n\tNotice returnable no 20.12.2010.  By ad interim order, the further<br \/>\n\tproceedings before the learned Single Judge of First Appeal<br \/>\n\tNo.4039\/10 shall remain stayed with the further direction that the<br \/>\n\tappellant shall also maintain status quo of the property in<br \/>\n\tquestion.\n<\/p>\n<p id=\"p_8\"> (JAYANT<br \/>\nPATEL, J.)<\/p>\n<p> (S.\n<\/p>\n<p id=\"p_9\">R.
