Justice R.BASANT\n\n Dated :29\/06\/2007\n\n O R D E R\n                                     R.BASANT, J.\n\n                                  ----------------------\n\n                                B.A.No.3927 of 2007\n\n                            ----------------------------------------\n\n                    Dated this the  29th   day of June 2007\n\n\n                                       O R D E R\n<\/pre>\n<p id=\"p_1\">       Application for anticipatory bail.   The petitioner is the owner of<\/p>\n<p>a   hotel.     He   faces   allegations   that   theft   of   electrical   energy   was<\/p>\n<p>committed in his premises.   The F.I.R  has been registered under the<\/p>\n<p>relevant provisions of the <a href=\"\/doc\/261195\/\" id=\"a_1\">Indian Electricity Act<\/a>, 2003.  The police can<\/p>\n<p>only  investigate  but  cognizance  can  be taken  by  the Magistrate  only<\/p>\n<p>on the basis of the complaint of the notified authority.  Investigation is<\/p>\n<p>in   progress.     Demand   has   been   made   of   a   huge   amount   from   the<\/p>\n<p>petitioner.   The petitioner had approached this court and restoration<\/p>\n<p>of   electrical   energy   connection   has   been   ordered   on   condition   of<\/p>\n<p>payment   of   a   specified   amount.                    The   petitioner,   in   these<\/p>\n<p>circumstances,   apprehends   arrest   at   any   moment   .     It   is   submitted<\/p>\n<p>that   the   petitioner   is   absolutely   innocent.     Directions   under   <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section<\/p>\n<p>438<\/a> Cr.P.C may be issued in favour of the petitioner, it is prayed.<\/p>\n<p id=\"p_1\">       2.     Application is not seriously opposed by the learned Public<\/p>\n<p>Prosecutor   and   I   am   satisfied   in   the   facts   and   circumstances   of   this<\/p>\n<p>case   that   appropriate   directions   can   be   issued   under   <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section   438<\/a><\/p>\n<p>Cr.P.C   subject,   of   course,   to   conditions   which   shall   ensure   the<\/p>\n<p>interests of a fair, efficient and expeditious investigation.<\/p>\n<p id=\"p_2\">       3.     This   petition   is   hence   allowed.     The   petitioner   shall   be<\/p>\n<p>released on bail on the following terms and conditions:<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.3927\/07                               2<\/span><\/p>\n<p id=\"p_3\">       i)      Petitioner   shall   surrender   before   the   learned   Magistrate<\/p>\n<p>having jurisdiction at 11 a.m on 07\/07\/2007.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">       ii)     He  shall   be  released  on  regular   bail  on  condition that  he<\/p>\n<p>executes bond for Rs.25,000\/-(Rupees twenty five thousand only) with<\/p>\n<p>two   solvent   sureties   each   for   the   like   sum   to   the   satisfaction   of   the<\/p>\n<p>learned Magistrate.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">       iii)    The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation  before  the investigating   officer    between  10  a.m  and   4<\/p>\n<p>p.m   on   09\/07\/2007   and   10\/7\/2007   and   thereafter   as   and   when<\/p>\n<p>directed by the investigating officer  in writing to do so.<\/p>\n<p id=\"p_8\">       (iv)    If   the   petitioner   does   not   appear   before   the   learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   directions   issued   above   shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to   arrest<\/p>\n<p>the petitioner and deal with them in accordance with law, as if these<\/p>\n<p>directions were not issued at all.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">       (v)     If   he   was   arrested   prior   to   07\/07\/2007,   he   shall   be<\/p>\n<p>released   on   bail   on   his   executing   a   bond   for   Rs.25,000\/-   (Rupees<\/p>\n<p>twenty   five   thousand   only)   without   any   sureties,   undertaking   to<\/p>\n<p>appear before the learned Magistrate on 07\/07\/2007.<\/p>\n<pre id=\"pre_1\">\n\n\n\n\n\n                                                             (R.BASANT, JUDGE)\n\n\njsr\n\n\n                              \/\/ True Copy\/\/          PA to Judge\n\n\n<span class=\"hidden_text\" id=\"span_1\">B.A.No.3927\/07    3<\/span>\n\n\n<span class=\"hidden_text\" id=\"span_2\">B.A.No.3927\/07    4<\/span>\n\n\n       R.BASANT, J.\n\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n\n            ORDER\n\n\n\n\n\n21ST DAY OF MAY2007\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.P.Sundaran vs State Of Kerala Represented By on 29 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3927 of 2007() 1.
