Zone XIII, Directorate of Education, as<br \/>\nwas notified to the Appellant vide letter dated 30\/10\/2009.\n<\/p>\n<p id=\"p_3\">Grounds for the First Appeal:\n<\/p>\n<p id=\"p_4\">No information provided by the PIO.\n<\/p>\n<p id=\"p_5\">Order of the First Appellate Authority (FAA):\n<\/p>\n<p id=\"p_6\">The First Appellate Authority directed the PIO\/DDE(NW-B) to give a reply to the Appellant<br \/>\nwithin two weeks.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                               Page 1 of 2<\/span><\/p>\n<p id=\"p_7\"> Grounds for the Second Appeal:\n<\/p>\n<p id=\"p_8\">Non-compliance of the order of The First Appellate Authority.\n<\/p>\n<p id=\"p_9\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_10\">Both the parties were given an opportunity for hearing. However, neither party appeared. From a<br \/>\nperusal of the papers it appears that the information has not been provided to the appellant even<br \/>\nafter the specific order of the First Appellate Authority. No exemption has been claimed by the<br \/>\nPIO and the FAA has clearly ordered that the information must be provided.\n<\/p>\n<p id=\"p_11\">Decision:\n<\/p>\n<p id=\"p_12\">The Appeal is allowed.\n<\/p>\n<p id=\"p_13\">      The PIO is directed to give the complete information to the appellant before<br \/>\n30 June 2010.\n<\/p>\n<p id=\"p_14\">The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.\n<\/p>\n<p id=\"p_15\">From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. PIO has further refused to obey the orders of his<br \/>\nsuperior officer, which raises a reasonable doubt that the denial of information may also be<br \/>\nmalafide. The First Appellate Authority has clearly ordered the information to be given.\n<\/p>\n<p id=\"p_16\">It appears that the PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause<br \/>\nnotice is being issued to the PIO, and is directed give reasons to the Commission to show cause<br \/>\nwhy penalty should not be levied..\n<\/p>\n<p id=\"p_17\">The PIO will present before the Commission at the above address on 06 July 2010 at 3.00pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1).
