Chief Justice)\n\n\n\n\n       The parties have settled the matter.       2nd     appellant and Counsel for\n\n\nappellants     present.     1st  Respondent-Bank   Manager   and   Counsel     present.\n\n\nThe parties have settled the dispute as follows:\n\n\n\n\n\n       Petitioners  have  agreed   to  pay  a  sum   of   Rs.1,00,000\/-   (Rupees  One\n\n\nlakh only) within 2 days and another sum of Rs.2,00,000\/- (Rupees Two lakhs\n\n\nonly) within another 10 days.  This will be accepted by the Respondent Bank\n\n\nin full and final settlement of the decree dues in this case. Chief Justice)<\/p>\n<p>        Both parties and their counsel are present.   The amounts were due in<\/p>\n<p>respect   of   a   contract   between   the   appellant&#8217;s   predecessor     and   the<\/p>\n<p>respondent-Development   Authority   .       The   appellant&#8217;s     legal   heirs   are   the<\/p>\n<p>present   claimants.     After   discussions   it   was   suggested   by   the   appellant&#8217;s<\/p>\n<p>counsel that if a sum of Rs.94,259\/- which is covered by a bill prepared by the<\/p>\n<p>authority   is   paid   to   the   appellants   without   deductions,   the   matter   can   be<\/p>\n<p>settled.  The respondent is also prepared to settle the matter, but it is pointed<\/p>\n<p>out that there should be a deduction towards   legal charges.   This is a case<\/p>\n<p>where   amount   became   due   long   back   and   the   appellant   has   also   suffered<\/p>\n<p>loss of interest.   Taking into this aspect it was suggested by us that the sum<\/p>\n<p>of Rs.94,259\/- (Rupees Ninety four thousand two hundred and fifty nine only)<\/p>\n<p>should   be   released   as   final   settlement   without   any   deduction   towards   legal<\/p>\n<p>charges.     After   discussions   this   was   agreed   to.     In   the   circumstances   the<\/p>\n<p>matter is settled on the following terms:\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">AS NO.342\/2000\/D                               -2-<\/span><\/p>\n<p id=\"p_3\">       i. The respondent shall release a sum of Rs.94,259\/- (Rupees  Ninety<\/p>\n<p>four   thousand   two   hundred   and   fifty   nine   only)   on   executing   the   final<\/p>\n<p>supplementary agreement by the appellants on or before 31.1.2007.  This will<\/p>\n<p>be in full and final settlement of all dues from the respondent.\n<\/p>\n<p id=\"p_4\">       ii.
