Justice N.K.BALAKRISHNAN\n\n Dated :25\/01\/2011\n\n O R D E R\n        PIUS C.KURIAKOSE &amp; N.K.BALAKRISHNAN, JJ.\n                        ------------------------\n                     L.A.A.No. 1144 OF 2010\n                        ------------------------\n\n            Dated this the 25th day of January, 2011\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">Pius C.Kuriakose, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      We find force      in the submissions of the learned   senior<\/p>\n<p>Government Pleader Smt.T.T.Josephina that the issue raised in<\/p>\n<p>this appeal by the Government is covered in favour of the<\/p>\n<p>Government by the judgment of this court in L.A.A. No.7\/2010.<\/p>\n<p>Relying on that judgment, we allow this appeal and refix the<\/p>\n<p>value of land under acquisition        at Rs.1,62,000\/- per Are in<\/p>\n<p>modification of the rate fixed under the impugned judgment.<\/p>\n<p id=\"p_3\">      The appeal is allowed to the above extent. The claimant<\/p>\n<p>will be entitled for all statutory benefits admissible under Section<\/p>\n<p>23(2), 23(1A) and Section 28 of the Act on the total refixed<\/p>\n<p>compensation to which he becomes eligible by virtue of this<\/p>\n<p>judgment.
