No. 21721 of 2002\n               =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                  Dated this, the 27th March, 2009.\n\n                            J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioners are employees who voluntarily retired from the<\/p>\n<p>service of the Indian Bank by availing of the benefits of Ext. P2<\/p>\n<p>scheme, namely, Indian Bank Voluntary Retirement Scheme, 2000, in<\/p>\n<p>the years 2000 and 2001 but after 1-9-2000. Under that scheme,<\/p>\n<p>apart from the ex-gratia benefits offered, the persons retiring<\/p>\n<p>voluntarily under the scheme would be entitled to the following three<\/p>\n<p>benefits:\n<\/p>\n<p id=\"p_1\">\n<blockquote id=\"blockquote_1\"><p>      &#8220;1. Gratuity as per <a href=\"\/doc\/553799\/\" id=\"a_1\">Gratuity Act<\/a>\/Service Gratuity as the case may<br \/>\n      be.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      2. Pension (including commuted value of pension) as per Indian<br \/>\n      Bank (Employees&#8217;) Pension Regulations 1995\/Bank&#8217;s contribution<br \/>\n      towards provident fund as per rules.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      3. Leave encashment as per rules.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_2\">Ext. P1 is the extract from the Indian Bank (Employees) Pension<\/p>\n<p>Regulations, 1995. In clause 29(5) thereof , the qualifying service of<\/p>\n<p>an employee retired voluntarily under that Regulation shall be<\/p>\n<p>increased by a period not exceeding five years, subject to the<\/p>\n<p>condition that the total qualifying service rendered by such employee<\/p>\n<p>shall not in any case exceed thirty-three years and it does not take<\/p>\n<p>him beyond the date of superannuation. According to the petitioners,<\/p>\n<p>the petitioners are also entitled to have the same benefit in so far as<\/p>\n<p>the pension regulations as a whole have been made applicable to<\/p>\n<p>those persons who voluntarily retire under the voluntary retirement<\/p>\n<p>scheme.    However, for the purpose of calculating their pension,<\/p>\n<p>weightage of five years provided for in Regulation 29(5) was not given<\/p>\n<p>to them. They filed a representation, Ext. P5, before the Bank which<\/p>\n<p>was rejected by Ext. P6, order holding that the addition of five years<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">O.P.. No. 21721\/2002                  -: 2 :-<\/span><\/p>\n<p>of qualifying service would be applicable only to those who retire<\/p>\n<p>voluntarily under Regulation 29 and not to those who retire<\/p>\n<p>voluntarily under the scheme which is not contemplated by the Rules.<\/p>\n<p>The petitioners are challenging Ext. P6 order seeking the following<\/p>\n<p>reliefs:\n<\/p>\n<p id=\"p_3\">\n<blockquote id=\"blockquote_3\"><p>      &#8220;i)    Issue a writ of mandamus or other appropriate writ, order<br \/>\n      or direction directing the respondent Bank to disburse pension<br \/>\n      and other benefits extending the benefit of increase of qualifying<br \/>\n      service by 5 years as provided under Rule of Ext. P1 Regulations<br \/>\n      to the petitioners.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      ii)    issue a writ of certiorari or other appropriate writ, order or<br \/>\n      direction quashing Ext. P4 and P6 and similar orders issued in<br \/>\n      respect of all the petitioners.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>      iii)   declare that the voluntary retires like the petitioners under<br \/>\n      Ext. P2 scheme is entitled to get their pension fixed and paid by<br \/>\n      increasing their qualifying service by 5 years as provided under<br \/>\n      Rule 29(5) of the pension Regulations of Ext. P1.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">\n<p id=\"p_5\">      2. A counter affidavit has been filed supporting the impugned<\/p>\n<p>order. According to respondents, the petitioners are not persons who<\/p>\n<p>have retired voluntarily under Regulation 29, to whom only                  the<\/p>\n<p>benefit under Regulation 29(5) is applicable. The petitioners being<\/p>\n<p>employees who retired voluntarily under a scheme not envisaged in<\/p>\n<p>the Rules, they are not to be treated as persons retired voluntarily<\/p>\n<p>under Regulation 29(5) and therefore they are not entitled to the<\/p>\n<p>benefits of Regulation 29(5), is the contention raised by the learned<\/p>\n<p>counsel for the Bank. According to him, the petitioner is only entitled<\/p>\n<p>to pension as calculated for a person who retires on superannuation<\/p>\n<p>as per the Rules. He also submits that Regulation 28 of the Pension<\/p>\n<p>Regulations has been amended with effect from 1-9-2000, adding a<\/p>\n<p>proviso, as as a result of which persons who retire voluntarily under<\/p>\n<p>the scheme is taken out of the purview of Regulation 29. He relies on<\/p>\n<p>the decision of the Supreme Court in <a href=\"\/doc\/1329690\/\" id=\"a_1\">Bank of Baroda &amp; Others v.<\/p>\n<p>Ganpat Singh Deora, CDJ<\/a> 2008 S C 2115, wherein while upholding<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">O.P.. No. 21721\/2002                 -: 3 :-<\/span><\/p>\n<p>similar amendment to the Regulation of Baroda Bank, which is in pari<\/p>\n<p>materia with that of Indian Bank Regulations, the Supreme Court<\/p>\n<p>held that persons voluntarily retired under a scheme is not eligible for<\/p>\n<p>the benefit of Regulation 29 and sub clause (5) thereof.<\/p>\n<p id=\"p_6\">      3. I have considered the rival contentions in detail.<\/p>\n<p id=\"p_7\">      4. The relevant provision of Regulation 29(5) reads thus:<\/p>\n<p>      &#8220;29. Pension on Voluntary Retirement:-\n<\/p>\n<p id=\"p_8\">      (1) On or after the first day of November, 1993, at any time after<br \/>\n      an employee has completed twenty years of qualifying service he<br \/>\n      may, by giving notice of not less than three months in writing to<br \/>\n      the appointing authority retire from service;\n<\/p>\n<p id=\"p_9\">                          xx                  xx                   xx<\/p>\n<p>      (5)   The qualifying service of an employee retiring voluntarily<br \/>\n      under this regulation shall be increased by a period not exceeding<br \/>\n      five years, subject to the condition that the total qualifying service<br \/>\n      rendered by such employee shall not in any case exceed thirty-<br \/>\n      three years and it does not take him beyond the date of<br \/>\n      superannuation.&#8221;\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">                                            (underlining supplied)<\/p>\n<p>The argument of the petitioners is that the pension regulations<\/p>\n<p>envisage only three types of pension namely, (1) superannuation<\/p>\n<p>pension, (2) pension on voluntary retirement and (3) invalid pension.<\/p>\n<p>In so far as the petitioners are not eligible for superannuation pension<\/p>\n<p>and invalid pension, the only other class of pensioners to which they<\/p>\n<p>can be fitted into is persons who have retired voluntarily. According<\/p>\n<p>to them, the case of persons who retire voluntarily is covered by<\/p>\n<p>Regulation 29 and notwithstanding the fact that Regulation 29 speaks<\/p>\n<p>about persons who retired from service after completing 20 years<\/p>\n<p>giving three months&#8217; notice, the petitioners should be construed as<\/p>\n<p>persons voluntarily retired as per Regulation 29.<\/p>\n<p id=\"p_12\">      5. I am unable to countenance that contention because of the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">O.P.. No. 21721\/2002                -: 4 :-<\/span><\/p>\n<p>amendment to regulation 28, which reads thus:\n<\/p>\n<p id=\"p_13\">\n<blockquote id=\"blockquote_6\"><p>      &#8220;28. Superannuation Pension: Superannuation Pension shall be<br \/>\n      granted to an employee who has retired on his attaining the age of<br \/>\n      Superannuation specified in the Service Regulations or settlements.<br \/>\n      Provided that, with effect from 1st day of September, 2000, Pension<br \/>\n      shall also be granted to an employee who opts to retire before<br \/>\n      attaining the age of Superannuation, but after rendering service for<br \/>\n      a minimum period of 15 years in terms of any scheme that may be<br \/>\n      framed for such purpose by the Board with the approval of the<br \/>\n      Government.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_14\">Therefore,     the petitioners who have retired voluntarily under a<\/p>\n<p>scheme have to be treated as a fourth type of pensioners who would<\/p>\n<p>be eligible only for pension calculated as applicable to persons who<\/p>\n<p>have retired on superannuation.           In that view of the matter, the<\/p>\n<p>petitioners cannot claim benefits as persons who retired voluntarily<\/p>\n<p>under Regulation 29 in so far as Regulation 29(5) specifically makes<\/p>\n<p>the provision applicable to only persons who retired voluntarily under<\/p>\n<p>Regulation 29(1).       This is rightly so, since persons who retires<\/p>\n<p>voluntarily under scheme is entitled more benefits than those who<\/p>\n<p>retire voluntarily under Regulation 29(1) get. This position has been<\/p>\n<p>sufficiently clear by the Supreme Court in the decision of Ganpat<\/p>\n<p>Singh Deora&#8217;s case (supra), in which the Supreme Court has held<\/p>\n<p>thus in paragraphs 16 to 21:\n<\/p>\n<p id=\"p_15\">\n<blockquote id=\"blockquote_7\"><p>      &#8220;16. The BOBEVRS-2001 itself does not give any indication, other<br \/>\n      than what has been stated in paragraph 2, as to which of the<br \/>\n      employees of the appellant-Bank would be entitled to opt for<br \/>\n      voluntary retirement.      It only mentions that all permanent<br \/>\n      employees of the bank, who as on 31st March, 2001, would have<br \/>\n      completed\/would be completing minimum 15 years of service or<br \/>\n      those who have completed\/would be completing 40 years of age,<br \/>\n      would be eligible to apply for voluntary retirement under the<br \/>\n      BOBEVRS-2001.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>      17. The conditions relating to completing 15 years of service for<br \/>\n      being eligible to apply for BOBEVRS-2001 are special to the<br \/>\n      Scheme as also to the case of those employees who wished to<br \/>\n      apply for voluntary retirement under the aforesaid Scheme, if they<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">O.P.. No. 21721\/2002                -: 5 :-<\/span><\/p>\n<p>      had completed or would be completing 40 years of age. The latter<br \/>\n      condition appears to have been incorporated in view of the<br \/>\n      provisions of Regulations 14 and 32 of the Pension Regulations,<br \/>\n      1995, to enable employees who had completed 10 years of service<br \/>\n      to also become eligible to apply for premature retirement under<br \/>\n      the Pension Regulations, 1995.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>      18.    However, we are inclined to agree with Ms. Bhati that<br \/>\n      Regulation 29 does not contemplate voluntary retirement under<br \/>\n      the Voluntary Retirement Scheme and applies only to such<br \/>\n      employees who themselves wish to retire de hors any Scheme of<br \/>\n      Voluntary Retirement, after having completed 15 years of<br \/>\n      qualifying service for the said purpose.      There is a distinct<br \/>\n      difference between the two situations and Regulation 29 would not<br \/>\n      cover the case of an employee opting to retire on the basis of a<br \/>\n      Voluntary Retirement Scheme.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>      19.    Furthermore, Regulation 2 of the Voluntary Retirement<br \/>\n      Scheme, 2001, of the appellant-Bank merely prescribes a period of<br \/>\n      qualifying service for an employee to be eligible to apply for<br \/>\n      voluntary retirement. On the other hand, Regulations 14 and 29 of<br \/>\n      the Pension Regulations, 1995, relate to the period of qualifying<br \/>\n      service for pension under the said Regulations, in two different<br \/>\n      situations.   While Regulation 14 provides that in order to be<br \/>\n      eligible for pension an employee would have to render a minimum<br \/>\n      of 10 years service, Regulation 29 is applicable to the employees<br \/>\n      choosing to retire from service pre-maturely, and in their case the<br \/>\n      period of qualifying service would be 15 years. The facts of this<br \/>\n      case, however, do not attract the provisions of Regulation 29 since<br \/>\n      the respondent accepted the offer of voluntary retirement under<br \/>\n      the Scheme framed by the Bank and not on his own volition de<br \/>\n      hors any Scheme of Voluntary retirement.         In such a case,<br \/>\n      Regulation 14 read with Regulation 32 providing for premature<br \/>\n      retirement would not also apply to the case of the respondent.<br \/>\n      While Regulation 2 of the BOBEVRS-2001 speaks of eligibility for<br \/>\n      applying under the Scheme, Regulation 14 of the Pension<br \/>\n      Regulations, 1995, contemplates a situation whereunder an<br \/>\n      employee would be eligible for premature pension.         The two<br \/>\n      provisions are for two different purposes and for two different<br \/>\n      situations. However, Regulation 28 of the Pension Regulations,<br \/>\n      1995, after amendment made provision for situations similar to the<br \/>\n      one in the instant case. In the absence of any particular provision<br \/>\n      for payment of pension to those who opted for BOBEVRS-2001<br \/>\n      other than Regulation 11(ii) of the Scheme, we are once again left<br \/>\n      to fall back on the Pension Regulations, 1995, and the amended<br \/>\n      provisions of Regulation 28 which brings within the scope of<br \/>\n      Superannuation Pension employees who opted for the Voluntary<br \/>\n      Retirement Scheme, which will be clear from the Explanatory<br \/>\n      Memorandum. However, the period of qualifying service has been<br \/>\n      retained as 15 years for those opting for BOBEVRS-2001 and is<br \/>\n      treated differently from premature retirement where the minimum<br \/>\n      period of qualifying service has been fixed at 10 years in keeping<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">O.P.. No. 21721\/2002                -: 6 :-<\/span><\/p>\n<p>      with Regulation 14 of the Pension Regulations, 1995.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_11\"><p>      20. We are, therefore, of the view that not having completed the<br \/>\n      required length of qualifying service as provided under Regulation<br \/>\n      28 of the 1995 Regulations, the respondent was not eligible for<br \/>\n      pension under the Pension Regulations, 1995, of the appellant<br \/>\n      Bank.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_12\"><p>      21. In the facts of the case and the terms of the BOBEVRS-2001<br \/>\n      and the Pension Regulations, 1995, we are unable to agree with<br \/>\n      the interpretation of the BOBEVRS-2001 Scheme and the Pension<br \/>\n      Regulations, 1995, as has been done by the learned Single Judge<br \/>\n      and the Division Bench of the High Court and We, therefore, allow<br \/>\n      the appeal without costs. Consequently, the orders passed by the<br \/>\n      Division Bench of the High Court and impugned in this appeal in<br \/>\n      D.B. Special Appeal (W) No. 481 of 2005 filed by the respondent<br \/>\n      against the dismissal of his Writ Petition CWP No. 6525 of 2005,<br \/>\n      are set aside. Similarly, the Writ Petition filed by the appellant-<br \/>\n      Bank is allowed along with this Appeal.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_13\"><p>                                             (Underlining supplied)<\/p>\n<p>Therefore, in view of the amended Regulation read with the said<\/p>\n<p>Supreme Court decision, it is abundantly clear that the petitioners<\/p>\n<p>are not entitled to the benefits of Regulation 29(5). Therefore, the<\/p>\n<p>original petition is without any merit and accordingly, the same is<\/p>\n<p>dismissed.\n<\/p><\/blockquote>\n<pre id=\"pre_1\">                                    Sd\/-    S.
