Justice K.T.SANKARAN\n\n Dated :12\/03\/2010\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                       B.A.No.1449 of 2010\n                  ---------------------------------------------\n              Dated this the 12th day of March, 2010\n\n\n                               O R D E R\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the accused in<\/p>\n<p>Crime No.39 of 2010 of Sasthamcotta Excise Range.<\/p>\n<p>      2.  The offence alleged against the petitioner is under<\/p>\n<p>Section 55(i) of the Abkari Act.\n<\/p>\n<p>      3.   The prosecution case is that on 3.3.2010, the<\/p>\n<p>petitioner was found engaged in the sale of Indian made foreign<\/p>\n<p>liquor. A quantity of 800 ml. of Indian made foreign liquor was<\/p>\n<p>seized from the possession of the petitioner. The petitioner was<\/p>\n<p>arrested on 3.3.2010 and he was remanded to judicial custody.<\/p>\n<p>      4.   The learned counsel for the petitioner submitted that<\/p>\n<p>the petitioner is not involved in any other case of similar nature.<\/p>\n<p>      5.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\">BA No.1449\/2010                    2<\/span><\/p>\n<p>     The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.15,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class, Sasthamcotta, subject to the following conditions:<\/p>\n<blockquote><p>     a)     The    petitioner   shall   report  before    the<br \/>\n            investigating officer between 9 A.M.      and 11<br \/>\n            A.M.   on all Mondays, till the final report is<br \/>\n            filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>     b)     The    petitioner   shall  appear    before   the<br \/>\n            investigating officer for interrogation as and<br \/>\n            when required;\n<\/p><\/blockquote>\n<blockquote><p>     c)     The petitioner shall not try to influence the<br \/>\n            prosecution witnesses or tamper with the<br \/>\n            evidence;\n<\/p><\/blockquote>\n<blockquote><p>     d)     The petitioner shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>     e)     In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to be<br \/>\n            cancelled.\n<\/p><\/blockquote>\n<blockquote><p>     The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                                K.T.SANKARAN,<br \/>\n                                                      JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Prasannan Pillai vs State Of Kerala Represented By The on 12 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1449 of 2010() 1.
