Opposite parties\n\n                             ----------\n\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p id=\"p_1\">      Heard Mr Pankaj Gupta, learned Counsel for the petitioner<br \/>\nand Mr Sampurnand Shukla, learned Counsel appearing for the<br \/>\nprivate respondents.\n<\/p>\n<p id=\"p_1\">      The dispute arose in the instant writ petition relates to<br \/>\nelection of the petitioner for the post of Pradhan for Gram Sabha<br \/>\nHathigawan, Kunda, District Pratapgarh which was held in the<br \/>\nyear 2005. Several round of litigations has been filed between the<br \/>\nparties. Earlier, the petitioner has filed the writ petition which was<br \/>\nnumbered as Writ Petition No. 1594 (MS) of 2009 and the said<br \/>\nwrit petition was allowed. The operative portion of the order dated<br \/>\n30.3.2009 as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;Considering the dictum laid down in <a href=\"\/doc\/706345\/\" id=\"a_1\">Bhabhi vs.<br \/>\n      Sheo Govind and others<\/a> (supra), the writ petition is<br \/>\n      allowed. A writ in the certiorari is issued quashing the<br \/>\n      order of the S.D.O. Dated 16.10.2008 and the order<br \/>\n      of revisional court dated 18.3.2009. The matter is<br \/>\n      remitted to the S.D.O. to pass an order of re-counting<br \/>\n      in accordance with law and thereafter decide the<br \/>\n      issue on the basis of result secured in the re-counting<br \/>\n      within a period of six months.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      In compliance of the order dated 30.3.2009, the Sub-\n<\/p><\/blockquote>\n<p id=\"p_2\">Divisional Officer passed the order on 12.8.2009. Being aggrieved,<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>the order dated 12.8.2009, the petitioner preferred a revision No.<br \/>\n2 of 2009 before the In-charge District Judge, Pratapgarh and in<br \/>\nthe revision, the Revisional Authority passed an order dated<br \/>\n26.8.2009 quashing the order dated 12.8.2009 and remanding<br \/>\nthe matter to the opposite party No.2 for fixing another date for<br \/>\nrecounting of votes and deciding the matter, but he has not<br \/>\npassed any order in respect of application dated 12.8.2009 filed<br \/>\nby the petitioner. Feeling aggrieved by the order dated 26.8.2009,<br \/>\nhe filed a writ petition in this Court which was numbered as Writ<br \/>\nPetition No. 6703 (MS) of 2009 and the said writ petition is still<br \/>\npending, but in the meantime, vide order dated 1.12.2009, the<br \/>\nopposite party No.2 in an illegal and arbitrary manner directed for<br \/>\nrecounting of votes without disposing of the election petition filed<br \/>\nby Babuna. Subsequently, it was dismissed as infructuous.<br \/>\nTherefore, the order dated 1.12.2009 attains finality.\n<\/p>\n<p id=\"p_3\">      During pendency of the writ petition No. 6703 (MS) of 2009,<br \/>\nthe Sub-Divisional Officer passed the order for recounting of votes<br \/>\non 8.12.2009 which was stayed by the District Judge, Pratapgarh<br \/>\nvide order dated 10.12.2009 in Revision No. 3 of 2009. Thereafter,<br \/>\nthe said revision was dismissed vide order dated 22.3.2010, which<br \/>\nis being impugned in the instant writ petition. Though the order<br \/>\ndated 1.12.2009 attains finality, yet the petitioner has not<br \/>\nchallenged the said order in Revision No. 3 of 2009. In spite of<br \/>\nrepeated objections from the opposite parties, learned Counsel for<br \/>\nthe petitioner submits that after dismissal of the writ petition, he<br \/>\npreferred two revisions which were numbered as Revision No.2 of<br \/>\n2009 and No.3 of 2009 assailing the orders dated 1.12.2009 and<br \/>\n8.12.2009 respectively.\n<\/p>\n<p id=\"p_4\">      On perusal of the orders impugned, it revealed that the<br \/>\npetitioner has only assailed the order dated 8.12.2009, but he has<br \/>\nnot challenged the order dated 1.12.2009 at any relevant time,<br \/>\nthough it attains finality. Therefore, the petitioner has not come to<br \/>\nthe Court with clean hands.\n<\/p>\n<p id=\"p_5\">      <a href=\"\/doc\/1272928\/\" id=\"a_1\">In Prestige Lights Ltd. v. State Bank of India<\/a> : (2007)<br \/>\n8 SCC 449, it was held that in exercising power under <a href=\"\/doc\/1712542\/\" id=\"a_2\">Article 226<\/a><br \/>\nof the Constitution of India, the High Court is not just a court of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p>law, but is also a court of equity and a person who invokes the<br \/>\nHigh Court&#8217;s jurisdiction under <a href=\"\/doc\/1712542\/\" id=\"a_3\">Article 226<\/a> of the Constitution is<br \/>\nduty bound to place all the facts before the court without any<br \/>\nreservation. If there is suppression of material facts or twisted<br \/>\nfacts have been placed before the High Court then it will be fully<br \/>\njustified in refusing to entertain petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_4\">Article 226<\/a> of<br \/>\nthe Constitution. The Apex Court Court referred to the judgment<br \/>\nof Scrutton, LJ. in <a href=\"\/doc\/1245093\/\" id=\"a_5\">R v. Kensington Income Tax Commissioners<\/a>,<br \/>\nand observed:\n<\/p>\n<blockquote id=\"blockquote_2\"><p>      &#8220;In exercising jurisdiction under <a href=\"\/doc\/1712542\/\" id=\"a_6\">Article 226<\/a> of the<br \/>\n      Constitution, the High Court will always keep in mind<br \/>\n      the conduct of the party who is invoking such<br \/>\n      jurisdiction. If the applicant does not disclose full facts<br \/>\n      or suppresses relevant materials or is otherwise-guilty<br \/>\n      of misleading the Court, then the Court may dismiss<br \/>\n      the action without adjudicating the matter on merits.<br \/>\n      The rule has been evolved in larger public interest to<br \/>\n      deter unscrupulous litigants from abusing the process<br \/>\n      of Court by deceiving it. The very basis of the writ<br \/>\n      jurisdiction rests in disclosure of true, complete and<br \/>\n      correct facts. If the material facts are not candidly<br \/>\n      stated or are suppressed or are distorted, the very<br \/>\n      functioning of the writ courts would become<br \/>\n      impossible.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">      <a href=\"\/doc\/720893\/\" id=\"a_7\">In Welcome Hotel and Ors. v. State of Andhra Pradesh<br \/>\nand Ors<\/a>. etc. AIR 1983 SC 1015, the Apex Court has held that<br \/>\na party which has misled the Court in passing an order in its<br \/>\nfavour is not entitled to be heard on the merits of the case.\n<\/p>\n<p id=\"p_7\">      <a href=\"\/doc\/1007946\/\" id=\"a_8\">In K.D. Sharma v. Steel Authority of India Ltd. and<br \/>\nOrs<\/a>., the Apex Court has held that the jurisdiction of the Supreme<br \/>\nCourt under <a href=\"\/doc\/981147\/\" id=\"a_9\">Article 32<\/a> and of the High Court under <a href=\"\/doc\/1712542\/\" id=\"a_10\">Article 226<\/a> of<br \/>\nthe Constitution is extraordinary, equitable and discretionary and<br \/>\nit is imperative that the petitioner approaching the Writ Court<br \/>\nmust come with clean hands and put forward all the facts before<br \/>\nthe Court without concealing or suppressing anything and seek an<br \/>\nappropriate relief. If there is no candid disclosure of relevant and<br \/>\nmaterial facts or the petitioner is guilty of misleading the Court,<br \/>\nhis petition may be dismissed at the threshold without considering<br \/>\nthe merits of the claim. The same rule was reiterated in <a href=\"\/doc\/1393462\/\" id=\"a_11\">G.<br \/>\nJayshree and Ors. v. Bhagwandas S. Patel and Ors<\/a>.: (2009)<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                  4<\/span><\/p>\n<p>3 SCC 141.\n<\/p>\n<p id=\"p_8\">      In a recent decision of Dalip Singh Versus State of Uttar<br \/>\nPradesh and others [(2010) 2 Supreme Court Cases 114],<br \/>\nthe Apex Court has held that the making of patently false<br \/>\nstatement on oath by the appellant tenure-holders is amazing.<br \/>\nThe appellants efforts to mislead the authorities and the courts<br \/>\ngot transmitted through three generations and the conduct of the<br \/>\nappellant and his son to mislead the High Court and the Supreme<br \/>\nCourt cannot, but treated as reprehensible.\n<\/p>\n<p id=\"p_9\">      In view of what has been stated above, the petitioner has<br \/>\nnot come to the Court with clean hands and suppressed the<br \/>\nmaterial facts. Accordingly, I would like to dismiss both the writ<br \/>\npetitions with Rs.10,000\/- costs, which shall be payable by the<br \/>\npetitioner\/Kanya Devi within a period of one month failing which<br \/>\nthe same shall be recovered as arrears of land revenue.\n<\/p>\n<p id=\"p_10\">      Accordingly, both writ petitions are dismissed.\n<\/p>\n<p id=\"p_11\">Dt.6.7.2010<br \/>\nLakshman\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Smt.Kanya Devi vs Special Additional District And &#8230; on 6 July, 2010 1 Court No. 24 Writ Petition No. 2594 (MS) of 2010 Smt.
