The respondent herein has<br \/>\npreferred              SCA No.17267 of 2010 and challenged the same<br \/>\naward which is challenged in present petition by the employer i.e.<br \/>\nSiddhi Cooperative Bank Limited. In view of the fact that the same<br \/>\naward is challenged by the employer and the employee, the contention<br \/>\nraised by the petitioner deserves to be considered. Hence, Rule.<br \/>\nMr. Saiyed, learned advocate waives service of Notice of Rule on<br \/>\nbehalf of the respondent.\n<\/p>\n<p id=\"p_1\">2.<br \/>\nSo far as the interim relief is concerned it is noticed that the<br \/>\npetitioner herein had raised contention that the respondent is not<br \/>\ncovered within the definition of the term &#8220;employee&#8221;<br \/>\nas defined under Section 3(13) of the Bombay Industrial Relation Act,<br \/>\n1946. The labour Court, having examined the decision of the employer<br \/>\nof dispensing the inquiry and then establishing the charges before<br \/>\nthe Court, came to the decision to award Rs.1,50,000\/- as<br \/>\ncompensation instead of granting any other relief including relief of<br \/>\nreinstatement and\/or backwages. In Appeal learned Industrial Court<br \/>\nenhanced the said amount of Rs.1,50,000\/- to Rs.5,00,000\/-. However<br \/>\non examination of the order any justifiable reason for enhancing such<br \/>\namount from the amount awarded by the labour Court does not emerge.<br \/>\nIt prima facie appears that the reasons recorded by the labour Court<br \/>\nwith regard to the petitioner&#8217;s contention that respondent was not<br \/>\nemployee are required to be examined in light of the legal position<br \/>\nsettled by catena of judgments. Hence, having regard to the aforesaid<br \/>\naspects and balance of convenience, interim relief deserves to be<br \/>\ngranted. Thus, it is directed that by way of interim relief the<br \/>\noperation of the impugned award shall remain stayed.
