RAMKUMAR, J.\n\n                     = = = = = = = = = = = = =\n\n                        Crl.M.C.No.496 of 2008\n\n                    = = = = = = = = = = = = = =\n\n            Dated this the 5th  day of February, 2008\n\n\n                                   ORDER\n<\/pre>\n<p id=\"p_1\">      In   this   petition   filed   under   <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section   482<\/a>   Cr.P.C,   the<\/p>\n<p>petitioner   seeks   to   quash   Annexure   A1-FIR   and   Annexure   A4<\/p>\n<p>order re-opening the investigation.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.   Crime  No.11\/2007  of Alakode Police Station  in  Kannur<\/p>\n<p>district   was   registered   against   the   petitioner   for   offences<\/p>\n<p>punishable  under   <a href=\"\/doc\/1279834\/\" id=\"a_1\">Section  376<\/a>  IPC  and  <a href=\"\/doc\/335053\/\" id=\"a_2\">Sections  3(1)<\/a>,(xi),(xii)   of<\/p>\n<p>Scheduled Caste and <a href=\"\/doc\/25085007\/\" id=\"a_3\">Scheduled Tribe (Prevention  of Atrocities)<\/p>\n<p>Act<\/a>   1989.     The   de   facto   complainant   is   one   Usha,   who   alleged<\/p>\n<p>that,   while   she   was   working   in   the   nursery   belonging   to   the<\/p>\n<p>accused, the accused had ravished her several times resulting in<\/p>\n<p>her  becoming   pregnant  and   giving   birth  to  a   child   on  12.12.06<\/p>\n<p>and since she was a member of the Scheduled Caste, the accused<\/p>\n<p>has committed the aforesaid offences.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      3.     After   investigation,   the   Police   submitted   Annexure   A3<\/p>\n<p>refer  report   to  the  effect   that   the  sexual   intercourse   which   the<\/p>\n<p>complainant   had   with   the   accused   was   with   her   consent   and<\/p>\n<p>since   she   was   aged   25   years   at   the   time   of   the   alleged<\/p>\n<p>Crl.M.C.No.496 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       2<\/span><\/p>\n<p>occurrence,   the   sexual   intercourse   would   not   amount   to   the<\/p>\n<p>offence   of   rape   as   alleged.     Accepting   the   refer   report,   the<\/p>\n<p>learned Magistrate dropped the proceedings in R.C.No.187\/2007<\/p>\n<p>on   27.6.07.     Subsequently   the   Deputy   Superintendent   of   of<\/p>\n<p>Police,   Thaliparamba   filed   Annexure   A4   petition   for   further<\/p>\n<p>investigation alleging that the victim who is   a Scheduled Caste<\/p>\n<p>belongs to a poor family and was cheated by the accused through<\/p>\n<p>allurements   and   threats   and   on   coming   to   know   that   she   had<\/p>\n<p>lodged   a   complaint,   the   accused   had   influenced   her   and   her<\/p>\n<p>family members and dissuaded her from changing her version by<\/p>\n<p>promising   to   maintain   her   and   also   by   employing   criminal<\/p>\n<p>intimidation.   On 21.8.07, the learned Magistrate re-opened the<\/p>\n<p>investigation.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      4.     The   learned   counsel   for   the   petitioner-   accused   would<\/p>\n<p>submit that the order re-opening the investigation is illegal and<\/p>\n<p>even if it amounts to a further investigation falling under <a href=\"\/doc\/274924\/\" id=\"a_4\">Section<\/p>\n<p>173(8)<\/a>   Cr.P.C,   the   victim   in   her   subsequent   statement   under<\/p>\n<p>Sec.164 <a href=\"\/doc\/445276\/\" id=\"a_5\">Cr.P.C<\/a> has stated that she was in love with the accused-<\/p>\n<p>Devassia   and   she   had   bodily   relationship   with   him   resulting   in<\/p>\n<p>her giving birth to a child, that since she was an unwed woman<\/p>\n<p>Crl.M.C.No.496 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                          3<\/span><\/p>\n<p>she was finding it difficulty to reveal the father of the child and<\/p>\n<p>hence she had lodged complaints against the father of the child,<\/p>\n<p>that he is a married person having wife and children and she is<\/p>\n<p>not interesting in  conducting any case against him and she has<\/p>\n<p>no   grievance   against   him.     It   is   contended   that   in   the   light   of<\/p>\n<p>such   a   statement   given   by   her   to   the   Magistrate,   it   will   be   an<\/p>\n<p>abuse of the process to continue the investigation further.   It is<\/p>\n<p>true   that   there   is   no   provision   to   reopen   the   investigation,   as<\/p>\n<p>though there can be a re-investigation.  But the order passed by<\/p>\n<p>the   Magistrate   on   21.8.07   can   only   be   treated   as   a   formal<\/p>\n<p>permission   to   conduct   further   investigation   under   Sec.   173(8)<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>.  Power to conduct further investigation is the prerogative<\/p>\n<p>of the Police and the Police need only seek formal permission of<\/p>\n<p>the   court   to   conduct   further   investigation.     Hence   the   order<\/p>\n<p>passed   on   21.8.07   can   only   be   treated   as   one   granting<\/p>\n<p>permission   to   the   Dy.S.P.,   Thaliparamba   to   conduct   further<\/p>\n<p>investigation.     No doubt,   in the further statement given by the<\/p>\n<p>1st informant to the Magistrate she has stated that she had illicitl<\/p>\n<p>relationship   with   Devassia   with   whom   she   was   in   love   and   she<\/p>\n<p>begot the child in that relationship.  But she has also stated that<\/p>\n<p>Crl.M.C.No.496 of 2008<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                         4<\/span><\/p>\n<p>he is the father of her child.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">      It   is  too  early   to  observe   that  in   the   light   of  Annexure   A5<\/p>\n<p>further   statement   given   by   her   to   the   Magistrate,   the   further<\/p>\n<p>investigation should be quashed.   After collecting the additional<\/p>\n<p>materials,   if   the   officer   in   charge   of   the   investigation   comes   to<\/p>\n<p>the   conclusion   that   there   is   no   material   sufficient   to   place   the<\/p>\n<p>accused   on   trial,   the   officer   in   charge   of   the   investigation   can<\/p>\n<p>definitely give a supplementary final report under Sec.169 read<\/p>\n<p>with   Sec.173(2)   <a href=\"\/doc\/445276\/\" id=\"a_7\">Cr.P.C<\/a>.     But   this   court   cannot   prematurely<\/p>\n<p>interfere with the process of further investigation.   Accordingly,<\/p>\n<p>leaving   the   Investigating   Officer   to   proceed   with   the   further<\/p>\n<p>investigation in accordance with law, this Crl.M.C is disposed of.<\/p>\n<p id=\"p_9\">                                                V.
