THE PRINCIPAL, PRIMARY SCHOOL     SAKHUA TOLA, GRAM\n                  PANCHAYAT KISHANPUR BALUA, BLOCK AND ANCHAL- DHAMDAHA,\n                  PURNIA-----------------------RESPONDENTS\n                                -----------\n<\/pre>\n<p id=\"p_1\">                 For the Petitioner: Mr. Amaresh Kumar Sinha, Advocate<br \/>\n                 For the State:      Mr. Aslam Ansari, AC to SC-14\n<\/p>\n<p id=\"p_1\">                                 &#8212;&#8212;&#8212;-\n<\/p>\n<p id=\"p_2\">2   10.12.2010                  Heard learned counsel for the parties.<\/p>\n<p id=\"p_3\">                                Annexure-8 is the order by virtue of which<\/p>\n<p>                 petitioner who was appointed as a Shiksha Mitra came to be<\/p>\n<p>                 removed because he failed to obtain intermediate degree within 33<\/p>\n<p>                 months of his engagement.\n<\/p>\n<p id=\"p_4\">                                Contention of learned counsel for the petitioner is<\/p>\n<p>                 that his case is squarely covered by a decision rendered by a<\/p>\n<p>                 Bench of this Court in a batch of cases related to Indu Devi vrs.<\/p>\n<p>                 The State of Bihar (CWJC No. 3700 of 2009 disposed of on<\/p>\n<p>                 14.7.2009. The matter was considered in a quite detail        after<\/p>\n<p>                 having heard learned counsel for the State and taking into<\/p>\n<p>                 consideration the Circular No. 2517 dated 4.7.2008 issued by the<\/p>\n<p>                 respondent State it was held that no removal can be effected on the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -2-<\/span><\/p>\n<p>      ground of delay having been caused in obtaining intermediate<\/p>\n<p>      degree.\n<\/p>\n<p id=\"p_5\">                      The case of the petitioner is covered by the said<\/p>\n<p>      decision. Therefore annexure-8 is quashed. Petitioner will be put<\/p>\n<p>      back in service forthwith, if he has been removed.
