Mr. Kamal Dave, for the petitioners.\n<\/p>\n<\/p>\n
              This petition has been filed by Railway against the<\/p>\n
order    dated   1.11.2000     passed   by    Central   Administrative<\/p>\n
Tribunal,     Jodhpur   Bench,    Jodhpur     in    Contempt    Petition<\/p>\n
No.47\/1999 in Original Application No.406\/1996.<\/p>\n
              It is submitted by learned counsel for the petitioners<\/p>\n
that earlier on 7.1.1999 in OA No.406\/1999, the following order<\/p>\n
was passed :\n<\/p>\n
                           “The O.A. Is accordingly allowed
\n              with the direction to the respondents to
\n              consider the case of the applicant for
\n              absorption\/regularisation     as     Jeep    Driver
\n              against 25% of the vacancies reserved for
\n              departmental promotion from the unskilled and
\n              semi-skilled     categories    subject    to    the
\n              applicant’s passing the requisite trade test,
\n              within a period of three months from the date
\n              of receipt of a copy of this order.”<\/p><\/blockquote>\n
\n                                      2<\/span><\/p>\n
              Thus, it is clear that an order was made for<\/p>\n
considering    the       case   of   the   applicant     for     absorption\/<\/p>\n
regularisation as Jeep Driver against 25% of the vacancies<\/p>\n
reserved for departmental promotion from the unskilled and<\/p>\n
semi-skilled categories subject to the applicant’s passing the<\/p>\n
requisite trade test, within a period of three months from the<\/p>\n
date of receipt of a copy of the order.\n<\/p>\n<\/p>\n
              As   per    learned    counsel   for     the     petitioner   in<\/p>\n
compliance of the said order, the case of the respondent Suraj<\/p>\n
Bhan was considered and he was not fount suitable for<\/p>\n
absorption\/regularisation and this fact was brought to the notice<\/p>\n
of learned Tribunal vide Annexure-7. Meaning thereby, the order<\/p>\n
for considering the candidature of respondent Suraj Bhan was<\/p>\n
complied with but by way of passing order dated 1.11.2000 in<\/p>\n
the contempt petition, the learned Tribunal passed an order that<\/p>\n
one months time is granted for compliance of the order dated<\/p>\n
7.1.1999.      Further, it was ordered that in case of non-<\/p>\n
compliance, we direct the respondent No.1 shall be present<\/p>\n
before the Court on the next date of hearing. Learned counsel<\/p>\n
for the petitioner argued that this petition has been filed only<\/p>\n
against the order of the Tribunal whereby the Tribunal has<\/p>\n
directed the respondent No.1 to remain present before the Court
\n                                         3<\/span><\/p>\n
       on the next date of hearing.\n<\/p>\n<\/p>\n
                    After perusing the pleadings of this writ petition and<\/p>\n
       considering the totality of the circumstances, we are of the<\/p>\n
       opinion that once the order          passed by Tribunal in O.A.<\/p>\n
       No.406\/1996 has been complied with then the order for securing<\/p>\n
       the presence of respondent No.1 for non compliance of the order<\/p>\n
       is not justified.\n<\/p>\n<\/p>\n
                    In this view of the matter, this writ petition is<\/p>\n
       allowed.    The order dated 1.11.2000 passed by Tribunal for<\/p>\n
       securing personal presence of respondent No.1 is hereby<\/p>\n
       quashed and set aside. If the contempt petition is still pending<\/p>\n
       with the tribunal, the Tribunal may proceed with the same<\/p>\n
       without compelling the respondent No.1 to remain present<\/p>\n
       before the Court.\n<\/p>\n
