Singh, Adv.<br \/>\n                   For the State      Mrs. Indu Bala Pandey, APP.\n<\/p>\n<p>                                             &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>3.   21.11.2011              The      accused-             petitioners           have<\/p>\n<p>                  preferred this revision application against the<\/p>\n<p>                  order   dated     9.6.2008       passed     by    the    learned<\/p>\n<p>                  Additional     Sessions     Judge,        FTC-2,      Chapra    in<\/p>\n<p>                  Sessions Trial No. 395 of 2005 by which their<\/p>\n<p>                  petition   under     Section       228    Cr.P.C.       has    been<\/p>\n<p>                  dismissed.\n<\/p>\n<p>                             Learned       counsel    for     the    petitioners<\/p>\n<p>                  submits    that    the    case     was     instituted         under<\/p>\n<p>                  Sections 341, 323, 325, 379 and 504\/34 I.P.C.<\/p>\n<p>                  but after investigation charge-sheet has been<\/p>\n<p>                  submitted also for the offence punishable under<\/p>\n<p>                  Section 307 I.P.C. without any basis.<\/p>\n<p>                             Learned counsel for the State submits<\/p>\n<p>                  that the allegation against               the      accused      is<\/p>\n<p>                  to have shot fire by firearms although it did<\/p>\n<p>                  not hit anyone but the action of the accused<\/p>\n<p>                  shows   that     they    had   intention         to   kill      the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>          informant.         There       is     also        allegation        and<\/p>\n<p>          evidence that they have assaulted the informant<\/p>\n<p>          mercilessly and due to intervention of the co-<\/p>\n<p>          villagers they have fled away. She has further<\/p>\n<p>          stated that there is material in the case-diary<\/p>\n<p>          to show that the accused have also committed<\/p>\n<p>          offence under Section 307 I.P.C.<\/p>\n<p>                       After       hearing          learned    counsel        for<\/p>\n<p>          both the parties and on perusal of the carbon<\/p>\n<p>          copy    of   the    case-diary            it    appears     that    the<\/p>\n<p>          learned trial court has considered the material<\/p>\n<p>          in     the   case-diary             and     has     come     to     the<\/p>\n<p>          conclusion that an offence under Section 307<\/p>\n<p>          I.P.C. is also made out against the accused.<\/p>\n<pre>                       Considering                  the       facts           and\n\n          circumstances,           I   do    not     find    any     ground    to\n\n          interfere      with          the     impugned        order.
