(J)\n\nCITATION:\n 1996 SCC  (2) 315\t  JT 1995 (8)\t496\n 1995 SCALE  (6)700\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     The detenu,  Jayantibhai Rambhai Patel, was detained on<br \/>\nApril 1, 1992 under COFEPOSA Act. The appellant on behalf of<br \/>\nher husband,  filed a  writ Petition in A.P. High Court. The<br \/>\nHigh  Court   in  the  first  instance\tdismissed  the\twrit<br \/>\npetition.  Subsequently\t  two  other   detenues\t filed\twrit<br \/>\npetition on the ground that copies of the documents supplied<br \/>\nto the\tdetenues were  illegible and  that  they  have\tbeen<br \/>\ndeprived of their valuable right to make a representation to<br \/>\nthe Advisory  Board, to the State Government and the Central<br \/>\nGovernment.  That   contention\twas  found  acceptable\tand,<br \/>\ntherefore, the\tdetention order was quashed. Thereafter, the<br \/>\nappellant filed another writ petition and contended that the<br \/>\ndetenu had  not\t been  informed\t of  his  right\t to  make  a<br \/>\nrepresentation to  the Specified  Officer. Therefore, he has<br \/>\nbeen denied  of the constitutional right under Article 22(5)<br \/>\nof the\tConstitution. A\t Division Bench\t of the\t High  Court<br \/>\nunder the  impugned order  dated March 10, 1993 made in Writ<br \/>\nPetition No.15974 of 1992 dismissed the writ petition on the<br \/>\nground that the detenu had known that he had a right to make<br \/>\na representation  but he  did not  exercise that  right\t and<br \/>\nthat, therefore,  the order  of detention is not vitiated on<br \/>\nthe  ground   of  non-intimation   of  the   right  to\tmake<br \/>\nrepresentation to  the specified  Officer. Thus, this appeal<br \/>\nby special leave.\n<\/p>\n<p>     The  controversy\tis  no\t longer\t res   integra.\t The<br \/>\nConstitution Bench  of this  Court in Kamleshkumar Ishwardas<br \/>\nPatel vs.  Union of India &amp; Ors. [(1995) 4 SCC 51] laid down<br \/>\nthe law thus :\n<\/p>\n<blockquote><p>     &#8220;Having  regard  to  the  provisions  of<br \/>\n     Article 22(5)  of the  Constitution  and<br \/>\n     the provisions  of the  COFEPOSA Act and<br \/>\n     the PIT  NDPS Act, the question posed is<br \/>\n     thus answered :\n<\/p><\/blockquote>\n<blockquote><p>     Where the\tdetention order has been made<br \/>\n     under Section  3 of the COFEPOSA Act and<br \/>\n     the PIT NDPS Act by an Officer specially<br \/>\n     empowered for that purpose either by the<br \/>\n     Central   Government    of\t  the\tState<br \/>\n     Government the  person  detained  has  a<br \/>\n     right to  make a  representation and the<br \/>\n     failure on\t his part to do so results in<br \/>\n     denial of\tthe right  conferred  on  the<br \/>\n     person detained to make a representation<br \/>\n     against the  order\t of  detention.\t This<br \/>\n     right of  the detenu  is in  addition to<br \/>\n     his right\tto make the representation to<br \/>\n     the State\tGovernment  and\t the  Central<br \/>\n     Government where the detention order has<br \/>\n     been  made\t  by  an   officer  specially<br \/>\n     authorised by  a State Government and to<br \/>\n     the   Central   Government\t  where\t  the<br \/>\n     detention order  has  been\t made  by  an<br \/>\n     officer  specially\t  empowered  by\t  the<br \/>\n     Central Government, and to have the same<br \/>\n     duly considered.  This right  to make  a<br \/>\n     representation necessarily\t implies that<br \/>\n     the person\t detained must be informed of<br \/>\n     his right\tto make\t a representation  to<br \/>\n     the authority that has made the order of<br \/>\n     detention at  the time when he is served<br \/>\n     with the  grounds of  detention so as to<br \/>\n     enable him to make such a representation<br \/>\n     and the  failure to  do  so  results  in<br \/>\n     denial  of\t  the  right  of  the  person<br \/>\n     detained to make a representation.&#8221;<\/p><\/blockquote>\n<p>     In\t relation  to  the  detention  of  the\tdetenues  in<br \/>\nCriminal Appeal\t Nos.850 and 915 of 1994 under PIT NDPS Act,<br \/>\nthe Madras  High Court\tallowed the  writ petition  and\t set<br \/>\naside the  order of detention on the ground that the detenue<br \/>\nwere not  informed of  his Constitutional  right to  make  a<br \/>\nrepresentation to  the detaining officer and it vitiates the<br \/>\nright guaranteed  under Article\t 22 (5) of the Constitution.<br \/>\nThe Court  had upheld  the above  view. It  is seen that the<br \/>\ndetenu was informed on April 20, 1992 that he was at liberty<br \/>\nto make\t a representation  to the  State Government, Central<br \/>\nGovernment and\tto the\tAdvisory Board. It was asserted that<br \/>\nhe made\t a representation  through the prison authorities to<br \/>\nthe Government of Andhra Pradesh. In other words, from these<br \/>\nfacts, it would be clear that the detenu was not informed of<br \/>\nhis constitutional  right to  make a  representation to\t the<br \/>\nSpecified Officer  for reconsideration\tof his detention. In<br \/>\nview of\t the law laid down by this Court, the failure on the<br \/>\npart of\t the specified\tOfficer to inform the detenu that he<br \/>\nhas a  Constitutional right  to make  representation to\t the<br \/>\nSpecified Officer  against the\torder of detention, violates<br \/>\nArticle 22(5)  of the  Constitution. The  order of detention<br \/>\ngets vitiated.\n<\/p>\n<p>     It is  contended for  the respondents  that  since\t the<br \/>\ndetenu had  already undergone  the period  of detention, the<br \/>\nquestion becomes  one of academic interest. We cannot accede<br \/>\nto the\tcontention. Since  the order of detention would form<br \/>\nfoundation to  consequential actions to ensue, we are of the<br \/>\nview that  it would  be proper\tto consider  validity of the<br \/>\norder of  detention, though  the detenu\t had  undergone\t the<br \/>\nperiod of detention by the time the matter came up for final<br \/>\ndisposal.\n<\/p>\n<p>     In these  circumstances, the  appeal  is  allowed.\t The<br \/>\norder of detention stands quashed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mrs.Nutan J.
