P. Rai, learned Govt. Advocate for\nthe respondents No. 1 and 2.\n    Shri A. K. Chourasiya, learned counsel for\nthe respondent No. 3.\n    With    consent     of    learned    counsel      for      the\nparties the matter is heard finally.\n    This    petition    under       Article     226    of      the\nConstitution of India is directed against the order\ndated 05\/07-03-2011 passed by respondent No. 3\/\nChief   Executive       Officer,       Janpad    Panchayat-\nMohgaon,    tahsil     and    district-Mandla,        whereby\nservices of the petitioner, who was employed\nTypist on contract basis, have been dispensed\nwith.\n    Facts<\/pre>\n<p>   briefly     are    that,    the   petitioner         in<br \/>\nresponse to the policy of the State Government,<br \/>\nappointed    as      Typist    in      Janpad     Panchayat<br \/>\nMohgaon, tahsil and district Mandla, by order<br \/>\ndated 03-02-2001 (Annexure-P\/2).<br \/>\n    Contention of the petitioner is that despite<br \/>\nof rendering satisfactory services, the services of<br \/>\n                                                          WP6258.11<\/p>\n<p>the   petitioner   were     dispensed       with   by    order<br \/>\ndated      05\/07-03-2011    passed     by      Shri     V.    K.<br \/>\nSharma, the then Chief Executive Officer, Janpad<br \/>\nPanchayat, Mohgaon. It is urged that the said<br \/>\nChief Executive Officer, who was placed under<br \/>\nsuspension vide order dated 04-03-2011, passed<br \/>\nthe order of termination with an ulterior motive<br \/>\nand without any authority.\n<\/p>\n<p>      To    substantiate   the     submission      regarding<br \/>\nsuspension of said Shri V. K. Sharma, learned<br \/>\ncounsel for the petitioner has placed reliance on<br \/>\nthe order dated 07-03-2011 passed by Collector,<br \/>\nMandla wherein it is indicated that said Shri V.<br \/>\nK.    Sharma,    Chief     Executive    Officer,        Janpad<br \/>\nPanchayat, Mohgaon, was suspended by order<br \/>\ndated 04-03-2011 passed by the Commissioner,<br \/>\nJabalpur Division, Jabalpur.\n<\/p>\n<p>      On     18-04-2011      the     respondents         were<br \/>\ndirected to show cause. In             response whereof<br \/>\nreturn is filed by respondent No. 3 wherein it<br \/>\ncontended that the appointment of petitioner as<br \/>\nTypist was not in accordance with the procedure.<br \/>\nIt is stated in the return that the services of the<br \/>\npetitioner were dispensed with on the basis of<br \/>\nthe report furnished by Audit Committee. Be that<br \/>\n                                                                 WP6258.11<\/p>\n<p>as it may.\n<\/p>\n<p>     The         question         which      crops       up         for<br \/>\nconsideration is as to whether said Shri V. K.<br \/>\nSharma, the then Chief Executive Officer, Janpad<br \/>\nPanchayat, Mohgaon, who was under suspension<br \/>\ncould     have     terminated         the    services      of      the<br \/>\npetitioner.\n<\/p>\n<p><span class=\"hidden_text\">     Learned counsel for the respondent No. 3<\/span><\/p>\n<p>when      faced     with        the   aforesaid      proposition,<br \/>\ncandidly submits that an officer who is placed<br \/>\nunder     suspension        loses     an    authority     to     take<br \/>\nadministrative decision.\n<\/p>\n<p>     In    the    case     at    hand,     the    documents         on<br \/>\nrecord reveal that said Shri V. K. Sharma while<br \/>\nhe was discharging his duties as Chief Executive<br \/>\nOfficer, Janpad Panchayat, Mohgaon, was placed<br \/>\nunder suspension by an order passed by the<br \/>\nCommissioner          bearing         No.        335\/ l-v-pkj \/2011<br \/>\nJabalpur, dated 04-03-2011. Thus, from the date<br \/>\nof his suspension he lost the authority to pass<br \/>\nany administrative order. Whereas contrary to<br \/>\nthis by order dated 05\/07-03-2011 (Annexure-P\/1)<br \/>\nhe   terminated      the        services    of    the   petitioner<br \/>\nwhich on the face of it is without any authority.\n<\/p>\n<p>     Since the impugned order is not passed by a<br \/>\n                                                          WP6258.11<\/p>\n<p>Competent Authority, it is non-est in the eyes of<br \/>\nlaw and has no legal force.\n<\/p>\n<p>     In view whereof, the impugned order dated<br \/>\n05\/07-03-2011     so   far   as    it    relates    to      the<br \/>\npetitioner is hereby quashed.\n<\/p>\n<p>     The respondents are directed to reinstate<br \/>\nthe petitioner on the post on which she was<br \/>\nappointed   and    engaged        as    Typist.
