            Application filed by Sahara Bano claimant\/respondent No. 1<\/p>\n
for the grant of compensation on account of death of her husband Ismile<\/p>\n
was accepted by learned Workmen’s Compensation Commissioner,<\/p>\n
Gurgaon vide impugned order dated March 29, 1985 and the appellant-<\/p>\n
Insurance Company and Inder Sain Bhasin\/respondent No. 2-owner of the<\/p>\n
offending truck were held jointly and separately responsible for depositing<\/p>\n
an amount of Rs. 57,500\/- as compensation and penalty of Rs. 28,750\/-,<\/p>\n
besides interest on the amount of compensation from 20.9.1984 till the<\/p>\n
deposit of the same with the learned Commissioner. Aggrieved of the<\/p>\n
same, the present appeal has been filed under Section 30 of the Workmen’s<\/p>\n
Compensation Act, 1923 (hereinafter referred to as ‘the Act’).

             The facts of the case are that deceased Ismile had been<\/p>\n
employed by respondent No. 2 for working as a Cleaner on his truck<\/p>\n
bearing registration No. DEG-2666, which stood insured with the<\/p>\n
appellant-Insurance Company. While the deceased was on duty on the<\/p>\n
aforementioned truck on 20.9.1984, the truck was involved in an accident<\/p>\n
and he died at the spot. Prayer was, accordingly, made by the claimant-<\/p>\n
respondent for awarding an amount of Rs. 2,00,000\/- as compensation.<\/p>\n
             The claim petition was opposed by the Insurance Company by<\/p>\n
pleading that the accident which occurred on 20.9.1984 did not arise out of<\/p>\n
and in the course of employment of deceased Ismile. Notice issued by the<\/p>\n
claimant was not in conformity with the mandatory procedure and,<\/p>\n
therefore, the Insurance Company was not liable to pay any amount of<\/p>\n
compensation.     In his written statement, the owner of the truck admitted<\/p>\n
the fact that his truck was involved in the accident and deceased Ismile<\/p>\n
used to get Rs. 500\/- per month as wages.\n<\/p>\n<\/p>\n
             On the pleadings of the parties, learned Commissioner framed<\/p>\n
the following issues :-\n<\/p>\n<\/p>\n
             1.     Whether the applicant is entitled to the<\/p>\n
                    amount claimed in the application ? OPA.<\/p>\n<\/blockquote>\n
             2.    Relief.<\/p><\/blockquote>\n
            After going through the pleadings of the parties and evidence<\/p>\n
led by them, learned Commissioner held that the death of Ismile stood
\n F.A.O. No. 973 of 1985                                                -3-<\/span><\/p>\n
proved and, therefore, the claimant-respondent was entitled to receive the<\/p>\n
aforementioned amount as compensation and penalty along with interest.<\/p>\n
             The only submission made on behalf of the appellant-<\/p>\n
Insurance Company is that the liability of the Insurance Company to<\/p>\n
indemnify the insured in respect of any liability under this Act could only<\/p>\n
arise in case the employer was insolvent or making a composition or<\/p>\n
scheme of arrangement with his creditors or if the employer is a company,<\/p>\n
in the event of the company having commenced to be wound up. No such<\/p>\n
circumstances had arisen and, therefore, the Insurance Company was not<\/p>\n
liable to indemnify the insured, i.e. respondent No. 2.<\/p>\n
             Section 14 (1) of the Act reads as under :-\n<\/p>\n
             “Section 14. Insolvency of employer – (1) Where<\/p>\n
             any employer has entered into a contract with any<\/p>\n
             insurers in respect of any liability under this Act to<\/p>\n
             any workman, then in the event of the employer<\/p>\n
             becoming insolvent or making a composition or<\/p>\n
             scheme of arrangement with his creditors or, if the<\/p>\n
             employer is a company, in the event of the company<\/p>\n
             having commenced to be wound up, the rights of the<\/p>\n
             employer against the insurers as respects that<\/p>\n
             liability shall, notwithstanding anything in any law<\/p>\n
             for the time being in force relating to insolvency or<\/p>\n
             the winding up of companies, be transferred to and<\/p>\n
             vest in the workman, and upon any such transfer the
\n F.A.O. No. 973 of 1985                                                    -4-<\/span><\/p>\n
             insurers shall have the same rights and remedies and<\/p>\n
             be subject to the same liabilities as if they were the<\/p>\n
             employer, so, however, that the insurers shall not be<\/p>\n
             under any greater liability to the workman than they<\/p>\n
             would have been under the employer.”\n<\/p>\n
             Policy of Insurance Ex. R.1 is available on the record. It was<\/p>\n
clearly stated therein by the Insurance Company that it would indemnify<\/p>\n
the insured against all sums, including claimant’s costs and expenses, which<\/p>\n
the insured shall become legally liable to pay in respect of :-<\/p>\n
             (i)    death of or bodily injury to any person caused by<\/p>\n
                    or arising out of the use (including the loading<\/p>\n
                    and\/or unloading) of the Motor Vehicle.<\/p>\n<\/blockquote>\n
             (ii)   damage to property caused by the use (including<\/p>\n
                    the loading and\/or unloading) of the Motor<\/p>\n
                    Vehicle.”<\/p><\/blockquote>\n
             As per the cover note issued on behalf of the Insurance<\/p>\n
Company, it had charged an amount of Rs. 48\/- under heading P.A. to<\/p>\n
Driver\/Cleaner etc, besides four coollies at the rate of Rs. 8\/- per person.<\/p>\n
             However, under certain conditions, the Insurance Company<\/p>\n
was not liable under the policy in respect of :-\n<\/p>\n<\/p>\n
             (i)    any accident loss damage and\/or liability<\/p>\n
                    caused sustained or incurred outside the
\n F.A.O. No. 973 of 1985                                                -5-<\/span><\/p>\n
                 Geographical area,<\/p>\n<\/blockquote>\n
         (ii)    any claim arising out of any contractual<\/p>\n
                 liability,<\/p>\n<\/blockquote>\n
         (iii)   any accident loss damage and\/or liability caused<\/p>\n
                 sustained or incurred whilst the Motor Vehicle<\/p>\n
                 is–<\/p><\/blockquote>\n
\n\n\n                 (a)    being used otherwise than in accordance\n\n                        with the Limitations as to Use or\n\n\n                 (b)    being driven by any person other than\n\n                        driver.\n\n\n         (iv)    any accident loss damage and\/or liability\n\n<\/pre>\n
                 caused sustained or incurred after any variation<\/p>\n
                 in or termination of the Insured’s Interest in the<\/p>\n
                 Motor Vehicle.\n<\/p><\/blockquote>\n
<\/blockquote>\n
         (v)     (a)    any accident loss or damage to any<\/p>\n
                 property whatsoever or any loss or expense<\/p>\n
                 whatsoever resulting or arising therefrom or<\/p>\n
                 any consequential loss,<\/p>\n<\/blockquote>\n
                 (b)    any liability of whatsoever nature<\/p>\n
                 directly or indirectly caused by or contributed<\/p>\n
                 to by or arising from ionising radiations or<\/p>\n
                 contamination by radioactivity from any
\n F.A.O. No. 973 of 1985                                                     -6-<\/span><\/p>\n
                       nuclear fuel or from any nuclear waste from the<\/p>\n
                       combustion of nuclear fuel. For the purpose of<\/p>\n
                       the exception combustion shall include any self<\/p>\n
                       sustaining process of nuclear fission.<\/p>\n<\/blockquote>\n
               (vi)    any accident loss damage or liability directly<\/p>\n
                       or indirectly caused by or contributed to by or<\/p>\n
                       arising from nuclear weapons material<\/p>\n<\/blockquote>\n
               (vii)   any accident loss damage or liability caused<\/p>\n
                       sustained or incurred during the period of<\/p>\n
                       requisition   or    commandeering        by   the<\/p>\n
                       Government for any purpose.<\/p><\/blockquote>\n
               It stands proved from the evidence that deceased Ismile used to<\/p>\n
work as a Cleaner on the truck in question and, therefore, Insurance<\/p>\n
Company was liable to indemnify the insured in respect of the death of<\/p>\n
Ismile.\n<\/p>\n<\/p>\n
               Nowhere in the exception Clause any stipulation was made that<\/p>\n
the liability of the Insurance Company would arise only in the event of the<\/p>\n
employer\/insured becoming insolvent. In such a situation, provisions of<\/p>\n
Section 14(1) of the Act were not applicable to the facts and circumstances<\/p>\n
of the case.\n<\/p>\n<\/p>\n
               Even otherwise, Section 14(1) of the Act does not absolve the<\/p>\n
Insurance Company of its liability to pay the compensation amount.<\/p>\n
Instead, it only enables the Insurance Company to step into the shoes of the
\n F.A.O. No. 973 of 1985                                                    -7-<\/span><\/p>\n
insured in the event of the employer becoming insolvent or making a<\/p>\n
composition or scheme of arrangement with his creditors or, if the<\/p>\n
employer is a Company, in the event of the Company having commenced to<\/p>\n
be wound up. Under any of these situations, the rights of the employer<\/p>\n
against the Insurance Company gets transferred to and vests in the<\/p>\n
workman. Considered from this angle, the argument submitted on behalf of<\/p>\n
the appellant that the Insurance Company was not liable to indemnify the<\/p>\n
insured unless and until the employer became insolvent cannot be accepted.<\/p>\n
            Another submission made on behalf of the appellant is that the<\/p>\n
Insurance Company be, at the most, burdened with liability to pay the<\/p>\n
amount of compensation and not the penalty or interest. However, as is<\/p>\n
clear from the insurance policy, the Insurance Company was to indemnify<\/p>\n
insured against all sums, including costs and expenses, which the insured<\/p>\n
became legally liable to pay Therefore, the Insurance Company cannot<\/p>\n
avoid its liability for the penalty or interest as the same was imposed on<\/p>\n
account of not paying the amount of compensation from the date it fell due.<\/p>\n
            No other point has been urged on behalf of the appellant<\/p>\n
            The impugned order passed by the learned Workmen’s<\/p>\n
Compensation     Commissioner,     Gurgaon     was    based   upon     proper<\/p>\n
appreciation of the pleadings of the parties and the evidence led by them.<\/p>\n
No case is made out for interference in the impugned order. The appeal,<\/p>\n
being without any merit is, therefore, dismissed. No order as to costs.

            At the time of admission of the appeal, learned counsel for the<\/p>\n
appellant had stated that the amount of compensation had already been paid<\/p>\n
to the claimant, whereas the amount of penalty and interest stood deposited<\/p>\n
by the Insurance Company. Accordingly, it was directed that the amount so<\/p>\n
deposited be put in fixed deposit in a nationalised bank for 37 months. If<\/p>\n
that be so, the amount of penalty and interest along with accrued interest be<\/p>\n
disbursed to the claimant-respondent on proper identification and against<\/p>\n
receipt.<\/p>\n
