Pandey,Sunita Agarwal\n\nHon'ble Arun Tandon, J.\n<\/pre>\n<p>The Manger of Chaudhary Mahavir Prasad Memorial<br \/>\nMahavidyalaya, Hathiyawha, Birdpur, Siddhartha Nagar<br \/>\nfurnished a Cheque for sum of Rs. 21,87,500\/- in the name of<br \/>\nRegistrar General, High Court, Allahabad with reference to<br \/>\nthe Division Bench judgment of this Court in Special Appeal<br \/>\nNo. 530 of 2007 (decided along with connected matters on<br \/>\n24.07.2007). The Cheque so furnished was put for collection<br \/>\nby the Registrar General of this Court. The same has been<br \/>\nreturned by the Bank concerned with the endorsement that<br \/>\nsufficient funds are not available in the account of the payee.<br \/>\nOn 21.01.2010 when the said fact was noticed by the Court<br \/>\non the report of the Registry, time was obtained by the<br \/>\ncounsel for the Committee of Management namely Shri<br \/>\nGirijesh Tiwari for obtaining instructions within 24 hours.<br \/>\nAccordingly the matter was posted for 22.01.2010.<br \/>\nOn 22.01.2010 one Shri C.K.Patel filed an affidavit as<br \/>\nPairokar for the Committee through a newly engaged counsel<br \/>\nnamely Shri Ravindra Tripathi and in paragraph 03 of the<br \/>\naffidavit it was stated that the Cheque has bounced due to<br \/>\nnegligence and the Manager will appear before the Court<br \/>\nalong with the Draft on the next date for which time be<br \/>\ngranted.\n<\/p>\n<p>Having regard to the prayer made, this Court on 22.01.2010<br \/>\nprovided that the Bank Draft for the like amount be presented<br \/>\n with the Registrar General of this Court by 27.01.2010 and<br \/>\nthat the matter be listed on 29.01.2010.\n<\/p>\n<p>Today counsel for the Committee namely Shri Ravindra<br \/>\nTripathi has made an statement that the Manager has not<br \/>\nresponded nor the Bank Draft is ready. He however states<br \/>\nthat he has been informed by the Pairokar that some stay<br \/>\norder has been granted by the Hon&#8217;ble Supreme Court,<br \/>\nhowever he has no knowledge of the proceedings or the<br \/>\norder passed.\n<\/p>\n<p>I am of the considered opinion that the Manager cannot be<br \/>\npermitted to abuse the process of the Court, in the manner it<br \/>\nhas been done. She must appear in person before this Court<br \/>\non 05.02.2010 at 2:00 p.m. along with an affidavit indicating<br \/>\nas to why Draft has not been submitted contrary to the<br \/>\nundertaking given in form of affidavit before the Court and as<br \/>\nto how a Cheque furnished to the Court by her in compliance<br \/>\nto the Division Bench judgment of this Court could bounce for<br \/>\ninsufficient funds and as to why proceedings for criminal<br \/>\ncontempt, for interfering in the administration of justice, be<br \/>\nnot initiated.\n<\/p>\n<p>Counsel for the Manager has stated that he cannot ensure<br \/>\nthe presence of Manager on the next date. Therefore, in<br \/>\norder to ensure her presence on the next date fixed, it is<br \/>\nprovided that Superintendent of Police, Siddhartha Nagar<br \/>\nshall take all necessary action for her presence before this<br \/>\nCourt on 05.02.2010 at 2:00 p.m.<br \/>\nCopy of the order may be issued to the Standing Counsel by<br \/>\n01.02.2010 for necessary information to the Superintendent<br \/>\nof Police, Siddhartha Nagar.\n<\/p>\n<p>The Court may further record that deliberately no affidavit not<br \/>\n records disclosing the details of the students who were<br \/>\nadmitted has been filed. For the purpose, one last opportunity<br \/>\nis afforded to the Committee of Management to file an<br \/>\naffidavit by the next date fixed i.e. 05.02.2010.<br \/>\nThe original records pertaining to the admission of the<br \/>\nstudents in all respect namely the date the fee was collected<br \/>\nalong with the document establishing the issuance of the<br \/>\nreceipt be produced before this Court by all the Committee of<br \/>\nManagements, by the next date fixed.\n<\/p>\n<p>Put up on 05.02.2010 at 2:00 p.m.<br \/>\nDated : 29.01.2010<br \/>\nVR\/WP-20653\/08\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Km.
