      The appellant filed O.P.(MV) No.2202 of 1996 before<\/p>\n
the Motor Accidents Claims Tribunal, Ernakulam under<\/p>\n
section 166 of the Motor Vehicles Act, claiming a<\/p>\n
compensation of Rs.1,62,750\/- for the loss caused to him, on<\/p>\n
account of the injury sustained by him in a motor accident.<\/p>\n
The Tribunal awarded a total compensation of Rs.47,250\/-.<\/p>\n
      2. According to the appellant, he was riding his<\/p>\n
scooter    bearing   registration       No.KL-7K-3513    along<\/p>\n
Kakkanad – Pallikkara road on October 5, 1995 at about<\/p>\n
9.10 a.m. His wife, claimant in O.P.(MV) No.2203 of 1996,<\/p>\n
was   pillion  riding.   When      they     reached  near  the<\/p>\n
Manakkakadavu Toll Gate, they were knocked down by a<\/p>\n
bus bearing registration No.KRD 9144, which came from<\/p>\n
the opposite side.\n<\/p>\n
      3. The claimant sustained the following injuries in the<\/p>\n
MACA 750\/2004                2<\/span><\/p>\n
accident, as revealed from Ext.A9 wound certificate :-<\/p>\n
      1) Loss of consciousness.\n<\/p><\/blockquote>\n
      2) Cerebral concussion.\n<\/p><\/blockquote>\n
      3) Contusion (R) side of face. Extensive bruising<\/p>\n
          with contusion (L) upper arm. Contusions on<\/p>\n
          the lips.\n<\/p><\/blockquote>\n
      4) Loss of one tooth and broken some of teeth.<\/p>\n<\/blockquote>\n
      5) Laceration – upper lip. Fracture (L) globellar<\/p>\n
          region extending from superomedial wall of<\/p>\n
          orbit to midline-undisplaced Le Foret II<\/p>\n
          fracture maxilla.\n<\/p><\/blockquote>\n
      4. The O.P. was filed against respondents 1 to 3;<\/p>\n<\/blockquote>\n
owner, driver and insurer of the offending bus. The insurer<\/p>\n
of the scooter was subsequently impleaded as supplemental<\/p>\n
respondent No. 4 before the Tribunal.\n<\/p>\n
      5. Respondents 1 and 2 remained absent and were set<\/p>\n
ex parte by the Tribunal. The third respondent, insurer of<\/p>\n
the offending bus, admitted the policy. The fourth<\/p>\n
respondent, insurer of the scooter also admitted policy.<\/p>\n

      6. This O.P. was jointly tried along with O.P.(MV) No.<\/p>\n
2203 of 1996 filed by the wife of the claimant and a<\/p>\n
common award was passed.\n<\/p>\n
      7. PWs.1 and 2 were examined and Exts. A1 to A26<\/p>\n
were marked on the side of the claimant. No evidence was<\/p>\n
adduced by the respondents. The Tribunal, on an<\/p>\n
appreciation of the evidence, found that the accident<\/p>\n
occurred due to the negligence on the part of the second<\/p>\n
respondent, driver of the offending bus and awarded a total<\/p>\n
compensation of Rs.47,250\/- with interest at the rate of 9%<\/p>\n
p.a. from the date of petition till realization and<\/p>\n
proportionate cost. The claimant has come up in appeal<\/p>\n
challenging the quantum of compensation awarded by the<\/p>\n
Tribunal.\n<\/p>\n
      8. Heard the learned counsel for the claimant and<\/p>\n
learned counsel for respondents 3 and 4.<\/p>\n
      9. The accident is not disputed. The finding of the<\/p>\n
Tribunal that the accident occurred due to the negligence<\/p>\n
on the part of the second respondent, driver of the<\/p>\n

offending bus, is not challenged in this appeal. Therefore,<\/p>\n
the only question, which arises for consideration, is whether<\/p>\n
the claimant is entitled to any enhanced compensation?<\/p>\n
      10. The Tribunal awarded a total compensation of<\/p>\n
Rs.47,250\/-. Break up of the compensation awarded is as<\/p>\n
under:-\n<\/p>\n
      Transport to hospital             :   Rs.      500\/-\n      Damage to clothing                :   Rs.      250\/-\n      Attendant expenses                :   Rs.      500\/-\n      Extra nourishment                 :   Rs. 1,000\/-\n      Loss of earnings                  :   Rs. 3,000\/-\n      Medical and expenses              :   Rs. 9,000\/-\n      Pain and suffering                :   Rs. 15,000\/-\n      Loss of amenities                 :   Rs. 10,000\/-\n      Loss of one tooth and             :   Rs.     5,000\/-\n      some teeth were broken.\n      For future treatment              :   Rs.     3,000\/-\n                                            ----------------------\n               Total                    ;   Rs. 47,250\/-\n                                            ========\n\n<\/pre>\n
      11. The learned counsel for the appellant\/claimant<\/p>\n
sought enhancement of compensation for pain and suffering<\/p>\n
endured, loss of amenities and enjoyment in life and on<\/p>\n
other heads. He pointed out that no compensation was<\/p>\n
awarded for the disability caused.\n<\/p>\n

        12. We find that no compensation was awarded for<\/p>\n
the disability caused. The Tribunal awarded Rs.3,000\/- for<\/p>\n
the loss of earnings. The claimant was employed in<\/p>\n
Kalamassery Premium Tyres as Lift Operator. Therefore, we<\/p>\n
are of the view that his monthly income can reasonably be<\/p>\n
fixed at Rs.2,500\/-. Nature of the injuries sustained by him<\/p>\n
show that he must have been disabled for three months, for<\/p>\n
which he is entitled to a compensation of Rs.7,500\/-. Thus,<\/p>\n
on this count the claimant is entitled to an additional<\/p>\n
compensation of Rs.4,500\/-.\n<\/p>\n
       13. Towards medical expenses, the Tribunal awarded<\/p>\n
a compensation of Rs.9,000\/-. The claimant has produced<\/p>\n
bills for Rs.10,620\/-. Therefore, we feel that a compensation<\/p>\n
of Rs.10,500\/- would be reasonable on this count.<\/p>\n
       14. For the loss of amenities and enjoyment in life,<\/p>\n
Rs.10,000\/- was awarded by the Tribunal which is quite<\/p>\n
inadequate. Having regard to the nature of the injuries<\/p>\n
sustained, we feel that a compensation of Rs.20,000\/- would<\/p>\n
be reasonable on this count. As regards the compensation<\/p>\n

awarded under other heads, we find the same to be<\/p>\n
reasonable and therefore, we are not disturbing the same.<\/p>\n
      15. Therefore, the claimant is entitled to an additional<\/p>\n
compensation of Rs.16,000\/-. He is entitled to interest at<\/p>\n
the rate of 9% p.a. from the date of petition till realization<\/p>\n
with proportionate cost. The third respondent, being the<\/p>\n
insurer of the offending bus, shall deposit the amount<\/p>\n
before the Tribunal within two months from the date of<\/p>\n
receipt of a copy of this judgment with notice to the<\/p>\n
claimant. The award of the Tribunal is modified to the above<\/p>\n
extent.\n<\/p>\n
      In the result, the appeal is disposed of as found<\/p>\n
above.\n<\/p>\n<\/p>\n
