Reference Cases<br \/>\nNo.1223\/2005 &amp; 1224\/2005 dated 30.04.2007 whereby, both the<br \/>\nreferences were partly allowed and the appellant-Corporation was<br \/>\ndirected to pay additional compensation to the respondent-original<br \/>\nclaimants at the rate of Rs.22.60 per sq. metre for their acquired<br \/>\nlands. The appellant-Corporation was also directed to pay additional<br \/>\namount at the rate of 12% on the additional amount of compensation so<br \/>\nawarded under the provisions of Section 23(1-A) of the Land<br \/>\nAcquisition Act, 1894 and 30% solatium and interest.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the competent authority acquired the lands<br \/>\nsituated in the sim of Village Chadasana of Taluka Chanasma, District<br \/>\nPatan for the purpose of drilling an oil well. The Notification u\/s.4<br \/>\nof the said Act was published on 27.08.1993 and Notification u\/s.6 on<br \/>\n19.03.1994. After following necessary procedure prescribed under the<br \/>\nsaid Act, the competent authority passed award on 15.12.1995. Being<br \/>\naggrieved by the same, the claimants raised dispute, which,<br \/>\nultimately, culminated into references before the Court below. After<br \/>\nconsidering the evidence on record, the reference Court partly<br \/>\nallowed the references by impugned judgment and award. Against the<br \/>\nsaid award, the appellant-Corporation has preferred the present<br \/>\nappeals.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the appellants and perused the documents on<br \/>\nrecord. Though served none appears on behalf of the<br \/>\nrespondent-claimants. Having gone through the impugned award, I find<br \/>\nthat the reference Court has relied upon an earlier award passed in<br \/>\nL.A.R. No.3700\/2003 and 3701\/2003 in respect of lands situated in the<br \/>\nsame Village wherein, the market value of the acquired lands has been<br \/>\nfixed at Rs.35.50 per sq. metre. In that case, the Notification u\/s.4<br \/>\nof the said Act was published on 22.06.1999. It is pertinent to note<br \/>\nthat in the present case, the Notification u\/s.4 of the said Act was<br \/>\npublished on 27.08.1993. In other words, the Notification u\/s.4 of<br \/>\nthe said Act in this case was published prior in point of time as<br \/>\ncompared to the Notification u\/s.4 published in the case of the award<br \/>\nrelied upon by the reference Court.\n<\/p>\n<p>4.\tIt<br \/>\nis a settled proposition of law that in an award wherein Notification<br \/>\nu\/s.4 of the said Act is subsequent to the date of Section-4<br \/>\nNotification in a given case, then the same could not be relied upon.<br \/>\nConsidering the facts of the case and since Section-4 Notification in<br \/>\nthe award relied upon by the reference Court is subsequent to the<br \/>\ndate of Section-4 Notification in this case, the same ought not to<br \/>\nhave been relied upon by the reference Court. Hence, the impugned<br \/>\naward deserves to be quashed and set aside and the reference cases<br \/>\ndeserve to be considered afresh.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the appeals are allowed. The impugned judgment<br \/>\nand award dated 30.04.2007 passed by the reference Court is quashed<br \/>\nand set aside and the matters are remanded to the reference Court for<br \/>\ndecision afresh on merits in accordance with law. The reference Court<br \/>\nshall hear both the sides and shall permit them to lead evidence and<br \/>\nthereafter, render its decision. The appeals stand disposed of<br \/>\naccordingly.
