ATIULLAH KHAN\n                                                Versus\n                                     THE STATE OF BIHAR\n                                              -----------\n<\/pre>\n<p>04        28.03.2011             Heard learned counsel for the petitioner as well as<\/p>\n<p>                       learned Additional Public Prosecutor for the State.<\/p>\n<p>                                      Petitioner is languishing in jail custody since<\/p>\n<p>                       14.01.2010 in connection with Budha Colony P.S. Case No. 05 of<\/p>\n<p>                       2010 initially, registered under Section 307 of the Indian Penal<\/p>\n<p>                       Code and subsequently, converted under Section 302 of the Indian<\/p>\n<p>                       Penal Code.\n<\/p>\n<p>                                      Allegedly, the petitioner mercilessly assaulted the<\/p>\n<p>                       deceased with bricks as a result of which deceased sustained injury<\/p>\n<p>                       and died after 25 days of the alleged occurrence in course of his<\/p>\n<p>                       treatment.\n<\/p>\n<p>                                      The contention of learned counsel for the petitioner is<\/p>\n<p>                       that no brick was found near the place of occurrence and even if,<\/p>\n<p>                       the prosecution story assumed to be true, then also, there was no<\/p>\n<p>                       intention of the petitioner to kill the deceased but I am not, at all,<\/p>\n<p>                       convinced with the submission of learned counsel for the<\/p>\n<p>                       petitioner.\n<\/p>\n<p>                                      Accordingly, this bail petition stands rejected.<\/p>\n<p>                                      However, learned trial court is directed to expedite<\/p>\n<p>                       the trial of the petitioner.\n<\/p>\n<\/p>\n<pre>Shahzad                                               ( Hemant Kumar Srivastava, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
