Agarwal, J.<\/p>\n<p> 1. This revision petition under Section 397\/401<br \/>\nCr.P.C. is directed against the order dated 18.2.2002,<br \/>\npassed by the court of Sh. S.N. Gupta, ASJ, Delhi, while<br \/>\nsetting aside the conviction of the petitioner under<br \/>\nSections 420 read with 511 IPC and reducing the sentence<br \/>\nawarded to petitioner under Section 471, from one year to<br \/>\nsix months RI and fine of Rs. 5,000\/- in default S.I. for<br \/>\nthree months, in case FIR No. 54\/90, under Sections<br \/>\n420\/468\/471 IPC, P.S. Mukherjee Nagar, Delhi.\n<\/p>\n<p> 2. Facts in brief are: that on or about 23.10.89<br \/>\npetitioner produced a domicile certificate bearing No. 1413<br \/>\ndated 5.8.89 purported to have been issued by<br \/>\nSub-divisional Officer, Haldwani (Civil); knowing the<br \/>\nsame to be a forged document for seeking some exemption in<br \/>\nheight for selection as sub-inspector in Delhi Police;<br \/>\nand claimed himself to be a person belonging to hill area.<br \/>\nBefore the petitioner could be appointed, on a suspicion<br \/>\nbeing raised, certificate was got verified and the same<br \/>\nwas found to be forged. Case was registered and after<br \/>\ninvestigation challan was filed. The trial court, vide<br \/>\njudgment and order dated 1.11.2002 held the petitioner<br \/>\nguilty under Sections 471 and 420 read with 511 IPC and<br \/>\nsentenced him to undergo RI for one year with fine of<br \/>\nRs. 5,000\/- in default, S.I. for three months. In the<br \/>\nappeal filed by the petitioner against this order was<br \/>\ndismissed on 18.2.2002. The sentence awarded was reduced<br \/>\nfrom one year R.I. to six month R.I. for the offence<br \/>\nunder Section 471 IPC with fine of Rs. 5,000\/-. The<br \/>\nconviction for offence under Sections 420\/511 IPC was<br \/>\nset-aside.\n<\/p>\n<p> 3. Learned counsel for petitioner did not press the<br \/>\nrevision on merits and prayed for a lenient view on<br \/>\nsentence. He submits that petitioner suffered pain and<br \/>\nagony of trial for about 12 years; he did not derive any<br \/>\nadvantage on the basis of forged domicile certificate<br \/>\npurported to have been issued by Sub-divisional Officer,<br \/>\nHaldwani (Civil); he is above 35 year old having three<br \/>\nminor school going children; and he has already undergone<br \/>\nsentence of about one and half month. Therefore, he prays<br \/>\nthat he be released on probation under Probation of<br \/>\nOffenders Act, 1958 or the sentence be reduced. Learned<br \/>\ncounsel for State submits that quantum of sentence is a<br \/>\nmatter of discretion by the court.\n<\/p>\n<p> 4. The object of the Probation of Offenders Act,<br \/>\n1958 is to prevent the youthful offenders from association<br \/>\nwith hardened criminals of mature age. The object is in<br \/>\nconsonance with the present trend in the field of<br \/>\npenology. It affords an opportunity to the convict having<br \/>\nregard to the circumstances of the case, the nature of the<br \/>\noffence and the character and antecedents of the offender<br \/>\nto reform himself.\n<\/p>\n<p>5. In this case, report of the Probation Officer<br \/>\nwas also called. It confirms that petitioner has three<br \/>\nminor children, i.e., two daughters aged about 13 years,<br \/>\n10 years studying in 7th and 5th standard, and one son<br \/>\naged about 3 years. The economic condition of the<br \/>\npetitioner is poor; father of petitioner is retired army<br \/>\npersonnel getting Rs. 3000\/- as pension. It is stated that<br \/>\nthe petitioner was running &#8220;Kirana&#8221; shop.\n<\/p>\n<p> 6. Taking into consideration the nature of the<br \/>\noffence and report of Probation Officer and the fact that<br \/>\npetitioner has suffered pain and agony of trial for about<br \/>\n12 years, a case for release of the petitioner on<br \/>\nprobation is made out.\n<\/p>\n<p> 7. In view of above, revision petition is partly<br \/>\nallowed. Petitioner is ordered to be released on his<br \/>\nentering into a bond in the sum of Rs. 10,000\/- with one<br \/>\nlocal surety in the like amount to keep peace and be of<br \/>\ngood behavior, for two years,and to appear and receive<br \/>\nsentence whenever called upon during the said period.\n<\/p>\n<p> 8.
