The appeliants  of noti\ufb01cation at
\nAnnexure     Acquisition Act,
\ndenotif3″\/ingi    of the appellants. The
\nentire:’1episo’dAe.Vite}:setee L:baek\u00bb.to”the 5’\/ear 1958 at which time a bandara
\n(water  sa_i'(ix’t0: fo\ufb02\ufb02ed for the benefit of Kainkatti<\/p>\n
viit\u00e9tge and otI.’1ei*..Ve:1v_I__zf;tfo\u00a5:t111di11g villages in Badami Taluk, now in<\/p>\n
\u00bbA  The appellants are the owners of Sy.No.3<\/p>\n
  Sy.No.5f3 measuring 2 acres 39 guntas,<\/p>\n
S\u00a7,;’f~\u00a7o.2’f,i3 nieasurieg 17 games and Sy.No.4\/2–s\u00bb3+4+5A measurirzg 8<\/p>\n
 .. xguntas Vfespectively. It is also not in dispute that about 20 acres of
\n was used for the fonnation of bandara by the Government \u00a3n the<\/p>\n

3. The whole problem seems to have cropped up when
\n4E1 noti\ufb01cation made by the Government in December 2f}0<'-)T was<\/p>\n
issued.\n<\/p>\n
4. According to the learned Counse_l.Vfo;’r’  K  <\/p>\n
though the proposal pertains to  M3″*lei2l_1;.t4″};f33″i’A’$, <\/p>\n
under 4\/1 came to be issued _ot1lylllnrthe  <\/p>\n
issuance of 6\/1 notification?’ _aequ’isitifo;iV’  to be
\nwithdrawn by dehhtirg\u00e9hhg lu43(1) has Act. This
\ncame to be challenged  ‘  ..\n<\/p>\n

aneestozsof  and so also the erstwhile owners of<\/p>\n
 rbespectivel’ lamisvoluntarily consented for the formation of<\/p>\n
t  the  (bandara) which was not only bene\ufb01cial to the<\/p>\n
it ‘  the land but also to the villagers surrounding the said<\/p>\n
‘i7his was purely by way of donation is the contention of the<\/p>\n
_ <\/p>\n
6. As a matter of fact, not even a scrap of’<\/p>\n
recording this fact is placed before ns. Howe.ver,.iif\u00a3’ne of <\/p>\n
bandara in the year 1958 itself isanot   the of i’<\/p>\n
the land. We do not find any correspondence  ;<\/p>\n
of the land and the up  the State
\nGovernment betwee1f:…_zI’}5’8*i_Vto   ancestors of
\nthe appellants or  of tinte claimed
\n  apart, the revenue
\n  to ascertain these facts
\nbefore   and they learnt horn the villagers<\/p>\n
who asjsernhledi  all the land which was used for the<\/p>\n
pp ._\u00a7:fo3rnation ofniater  was donated by the respective landlord<\/p>\n

  the predecessor-in-title pertaining to certain lands still<\/p>\n

V i i  was the ray of hope for the appellants and the other several<\/p>\n
owners of the land to approach the concerned authorities much<\/p>\n
