The respondent Ghamandiram Kewalji Gowani was  detained<br \/>\nunder  Conservation  of Foreign Exchange and  Prevention  of<br \/>\nSmuggling   Activities\tAct  (hereinafter  referred  to\t  as<br \/>\nCOFEPOSA)  in  1974.   The  said  order\t of  detention\t was<br \/>\nchallenged by the son of the detenu Shri Tej Raj before\t the<br \/>\nBombay\tHigh  Court  and after considering  the\t grounds  of<br \/>\ndetention, the Bombay High Court quashed the detention order<br \/>\nby  judgment dated 1-11-1974.  Sometime in June 1975  during<br \/>\nthe  period  of emergency declared under  the  Constitution,<br \/>\nanother\t  detention  order  was\t passed\t against  the\tsaid<br \/>\nGhamandiram.  The second detention order was also challenged<br \/>\nin  the Bombay High Court.  By an interim order dated  10-3-<br \/>\n1976,  the  Bombay  High  Court held  that  the\t detenu\t was<br \/>\nentitled  to  challenge the grounds for\t detention  and\t the<br \/>\npetition presented before the High Court for such  challenge<br \/>\nwas  maintainable.  On the revocation of the emergency,\t the<br \/>\ndetenu\twas  released  but the challenge  to  the  detention<br \/>\norder, was pursued and ultimately by the judgment and  order<br \/>\ndated 23-2-1981, the Bombay High Court set aside and quashed<br \/>\nthe second detention order.\n<\/p>\n<p>+ From the Judgment and Order dated 23-2-1981 of the  Bombay<br \/>\nHigh Court in Crl.  Appeal No. 1320 of 1975<br \/>\n<span class=\"hidden_text\">41<\/span>\n<\/p>\n<p>2.The  instant\tappeal arises out of such  judgment  of\t the<br \/>\nBombay\tHigh  court  dated  23-2-1981  quashing\t the  second<br \/>\ndetention  order.  During the pendency of this\tappeal,\t the<br \/>\nrespondent Ghamandiram died on 2-2-1983.  No application for<br \/>\nsubstitution  of the heirs of the legal\t representatives  of<br \/>\nthe said deceased respondent Ghamandiram was made within the<br \/>\nperiod\tof  limitation.\t No application\t for  setting  aside<br \/>\nabatement after condonation of delay has also been made.  It<br \/>\nmay  be\t stated\t here  that in view of\tthe  said  order  of<br \/>\ndetention  passed  against Ghamandiram, three  notices\twere<br \/>\nissued, one against the deceased Ghamandiram and two against<br \/>\ntwo  sons  of  deceased under Section  6  of  Smugglers\t and<br \/>\nForeign\t Exchange Manipulators (Forfeiture of Property)\t Act<br \/>\n(hereinafter referred to as SAFEMA).  It has been  contended<br \/>\nin  the\t application for substitution that since  the  other<br \/>\nappeals\t have also been preferred against quashing  of\tsuch<br \/>\nnotices\t issued under SAFEMA to the sons of Ghamandiram\t and<br \/>\nin  such  appeals, the question of the\tvalidity  of  second<br \/>\ndetention  order also arises for determination, there is  no<br \/>\nquestion of abatement of the instant appeal because in other<br \/>\nappeals\t some  of the heirs of Ghamandiram  are\t already  on<br \/>\nrecord.\t Such contention has been seriously disputed by\t the<br \/>\nlearned\t counsel who has entered appearance for the sons  of<br \/>\nGhamandiram  in\t the other appeals by contending  that\tthey<br \/>\ncannot\tbe  held  to be on record of  the  appeal  preferred<br \/>\nagainst\t Ghamandiram  in the matter  of\t quashing  detention<br \/>\norder  for  allowing the application for  substitution\tmade<br \/>\nlong after the period of limitation.  It may be stated\there<br \/>\nthat it is not the case of the appellant that the  appellant<br \/>\nwas not aware of the death of Ghamandiram because such\tfact<br \/>\nof  death  was\tmade  known  and  in  the  application\t for<br \/>\nsubstitution  it has been stated that such  application\t was<br \/>\nnot made  earlier  because  in the  connected  appeals,\t the<br \/>\nheirs of Ghamandiram were     already on record.\n<\/p>\n<p>3.   The   learned   counsel   opposing\t  the\tprayer\t for<br \/>\nsubstitution has contended that the other appeals  preferred<br \/>\nagainst\t some  of the heirs of Ghamandiram  are\t independent<br \/>\nappeals\t and they arise out of a different cause of  action.<br \/>\nThe notices under SAFEMA to sons of Ghamandiram were  issued<br \/>\nnot in the capacity of their being heirs of Ghamandiram\t and<br \/>\nholding\t the properties of Ghamandiram but on the  basis  of<br \/>\ntheir  being close relations of the detenu  under  COFEPOSA,<br \/>\nwithin\tthe meaning of SAFEMA, the properties owned by\tthem<br \/>\nwere  also liable to be confiscated under the provisions  of<br \/>\nSAFEMA.\t In such circumstances, learned counsel opposing the<br \/>\napplication  for substitution contends that the question  of<br \/>\ndoctrine  of presentation of the estate of a deceased  party<br \/>\nas  sought  to be raised in support of the  application\t for<br \/>\nsubstitution   does  not  arise\t and  the  application\t for<br \/>\nsubstitution   being   hopelessly  time-barred\t should\t  be<br \/>\ndismissed.\n<\/p>\n<p>4.   The  learned  counsel for the appellant  has,  however,<br \/>\nrelied upon the decision of this Court in <a href=\"\/doc\/1430046\/\">Mahabir Prasad  v.<br \/>\nJage  Ram1<\/a>  for\t contending  that  since  in  the  connected<br \/>\nappeals,  the heirs of Ghamandiram were already\t on  record,<br \/>\nthere was no question of abatement of this appeal.  We\tare,<br \/>\nhowever,<br \/>\n1 (1971) 1 SCC 265 :(1971) 3 SCR 301<br \/>\n<span class=\"hidden_text\">42<\/span><br \/>\nunable to accept such contention.  In the said decision\t the<br \/>\nquestion  of abatement of a proceeding was considered  where<br \/>\nin the same proceeding, one of the heirs of a deceased party<br \/>\nwas already on record.\tThe said decision does not relate to<br \/>\nabatement of a different proceeding which is independent  of<br \/>\nthe other proceedings where an heir in his personal capacity<br \/>\nis a party.  In the aforesaid circumstances, the application<br \/>\nfor  substitution which is otherwise hopelessly\t time-barred<br \/>\nis  rejected&#8217;.\t Consequently,\tthis appeal  abates  and  is<br \/>\ntherefore dismissed.\n<\/p>\n<p>CA Nos. 928 and 1198 of 1991\n<\/p>\n<p>5.
