HARISCHANDRA PRASAD THAKUR VILL.-\n      HARPUR SINGHIA, P.S.- SAMASTIPUR-MUFASSIL, DISTT.- SAMASTIPUR\n                                        -----------\n<\/pre>\n<p>                  For the Petitioner : Mr. Sunil Kumar Sharma, Advocate<br \/>\n                  For the state       : Mr. Prasoon Sinha, G.A. 3<br \/>\n                  For Respondent no. 5: Mr. Kripa Nand Jha, Advocate\n<\/p>\n<p>                                          &#8212;&#8212;\n<\/p>\n<p>3.   02.12.2010           Heard learned Counsel for the petitioner, learned Counsel<\/p>\n<p>                  for the State and the learned Counsel for Respondent no. 5.<\/p>\n<p>                          The petitioner is aggrieved by the order dated 15.3.2010<\/p>\n<p>                  passed by the Additional Collector, Samastipur on an application<\/p>\n<p>                  preferred   by   Respondent   no.   5   holding   that   there   was<\/p>\n<p>                  encroachment of Chak No. 84 as his boundary wall enclosed a<\/p>\n<p>                  portion of the road in that chak as per the report of the Anchal<\/p>\n<p>                  Amin.\n<\/p>\n<p>                          Respondent no. 5 came to this Court in CWJC No. 4227 of<\/p>\n<p>                  2009 disposed on 12.1.2010 with the grievance that part of his<\/p>\n<p>                  lands were sought to be utilized for road widening without<\/p>\n<p>                  acquisition in accordance with law. This Court directed matters<\/p>\n<p>                  to be examined in accordance with law. The impugned order<\/p>\n<p>                  came to be passed in pursuance thereof.\n<\/p>\n<p>                          Counsel for the petitioner submits that he purchased the<\/p>\n<p>                  lands in question on 16.1.1975.The impugned order rightly<\/p>\n<p>                  records contribution of lands on 16.7.1975 voluntarily by the<\/p>\n<p>                  persons concerned including the petitioner and the private<br \/>\n<span class=\"hidden_text\">                                                                         2<\/span><\/p>\n<p>respondent to facilitate the construction of a brick soled road.<\/p>\n<p>There are houses on both sides with boundary wall. The<\/p>\n<p>petitioner has not encroached any portion of Chak No. 84<\/p>\n<p>identified as the lands donated by both sides and on which the<\/p>\n<p>road stands. It is next submitted that the boundary wall of the<\/p>\n<p>petitioner as existing has been so since long years and no one<\/p>\n<p>has objected to the same. There is thus a presumption that there<\/p>\n<p>is no encroachment by the petitioner.\n<\/p>\n<p>       Counsel for the State and the private respondent have<\/p>\n<p>opposed the same to urge that the order impugned records a<\/p>\n<p>finding based on spot inspection report submitted by the Anchal<\/p>\n<p>Amin of encroachment on Chak 84. The petitioner did not<\/p>\n<p>question the report before the Additional Collector, except for<\/p>\n<p>calling it collusive.\n<\/p>\n<p>       The extent of the area of the lands voluntarily contributed<\/p>\n<p>by   the   parties      including   the   petitioner   and   the   private<\/p>\n<p>respondents for purposes of construction of a road is a question<\/p>\n<p>of fact. The full details thereof shall naturally be available in the<\/p>\n<p>Government records including the documents preparing the<\/p>\n<p>chak and numbering it as 84. The physical dimension of the<\/p>\n<p>land along with its boundaries shall also form part of such<\/p>\n<p>report. The fact that after donation a person may have continued<\/p>\n<p>in occupation of part of the land donated may not be sufficient<\/p>\n<p>justification for holding on to the land. This Court hastens to<\/p>\n<p>add that it is not recording any finding to that effect against the<\/p>\n<p>petitioner. The discussion is only for the purpose and limited to<\/p>\n<p>the question of the difficulties that arise in writ jurisdiction for<\/p>\n<p>adjudication of these issues of fact. The writ Court cannot sit as<br \/>\n<span class=\"hidden_text\">                                                                              3<\/span><\/p>\n<p>            an appellate authority over the impugned order to re-appreciate<\/p>\n<p>            evidence and facts unless there is perversity in the finding of<\/p>\n<p>            fact. Apparently there is no error in the decision making process.<\/p>\n<p>            The petitioner has had full opportunity. No perversity in the<\/p>\n<p>            order has been pointed out. That the petitioner may have urged<\/p>\n<p>            before the court below that the report of the Anchal Amin was<\/p>\n<p>            collusive may not be sufficient for the writ Court to interfere. It<\/p>\n<p>            was for the petitioner to demonstrate from the dimension of the<\/p>\n<p>            donated land as recorded in the government documents with the<\/p>\n<p>            situation existing today with regard to the road that it was<\/p>\n<p>            physically the same as it was when the lands were donated on<\/p>\n<p>            16.7.1975 and that as per the measurement mentioned in the<\/p>\n<p>            report of the Anchal Amin read with the document of lands for<\/p>\n<p>            donation there was no encroachment. These were issues to be<\/p>\n<p>            raised by the petitioner as question of fact before the Additional<\/p>\n<p>            Collector himself.\n<\/p>\n<p>                  This Court therefore finds it difficult to examine the<\/p>\n<p>            impugned order on these questions of fact which can only be<\/p>\n<p>            examined by an appropriate authority where evidence can be led,<\/p>\n<p>            documents may be exhibited etc.<\/p>\n<p>                  The present order and any observation contained therein<\/p>\n<p>            are for the purposes of disposal of the writ application and shall<\/p>\n<p>            have no application or bearing on any proposed proceeding<\/p>\n<p>            initiated by the petitioner before the appropriate forum for<\/p>\n<p>            purposes as discussed in this order.\n<\/p>\n<p>                  The writ application is dismissed.\n<\/p>\n<\/p>\n<pre>Snkumar\/-                                           (Navin Sinha,J.)\n<span class=\"hidden_text\"> 4<\/span>\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Arbind Kumar Thakur vs The State Of Bihar &amp;Amp; Ors on 2 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.9303 of 2010 1.
