BAKHTIYARPUR, DISTRICT PATNA AT\nPRESENT POSTED AS BLOCK EDUCATION EXTENSION OFFICER, BAIRGANIA,\nDISTRICT SITAMARHI. ----- PETITIONER\n                                       Versus\n                  THE STATE OF BIHAR ---- OPPOSITE PARTY\n\nFor the petitioner :   Mr. Sunil Kumar Verma, Advocate\n                       Mr. Suman Kumar Verma, Advocate\nFor the State:         Mr. Jharkhandi Upadhyay, A.P.P.\n                                           -----------\n<\/pre>\n<p>2        21.6.2011                       Heard learned counsel for the petitioner and the<\/p>\n<p>                            counsel appearing on behalf of the State.\n<\/p>\n<p>                                         The petitioner has challenged the order dated<\/p>\n<p>                            30.12.2006 by which cognizance has been taken against the<\/p>\n<p>                            petitioner for the offences under Section 384 of the Indian Penal<\/p>\n<p>                            Code.\n<\/p>\n<p>                                         Briefly stated the prosecution case as made out in the<\/p>\n<p>                            complaint petition by a teacher of a school is that some<\/p>\n<p>                            construction work was to be done for the school. The complainant<\/p>\n<p>                            began to undertake the construction of the two toilets etc. The<\/p>\n<p>                            money for the work was withdrawn by joint signature of the<\/p>\n<p>                            Principal of the school and the Secretary of the Education<\/p>\n<p>                            Committee.     It has been alleged by the complainant that the<\/p>\n<p>                            Secretary of the Education Committee as well as the Principal<\/p>\n<p>                            demanded a sum of Rs. 60,000\/- for passing the said bills. The<\/p>\n<p>                            complainant is said to have made a complaint to the Block<\/p>\n<p>                            Education Extension Officer, Bairgania, Sitamarhi (Petitioner) and<\/p>\n<p>                            the Officer Incharge of Bairgania. On the basis of the aforesaid<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>         facts, the petitioner who is the Block Education Extension Officer<\/p>\n<p>         has been made accused.\n<\/p>\n<p>                       Learned counsel for the petitioner submits that no<\/p>\n<p>         offence under Section 384 of the Indian Penal Code is made out<\/p>\n<p>         against the petitioner. Section 383 of the Indian Penal Code deals<\/p>\n<p>         with extortion which envisages that if a person puts any person in<\/p>\n<p>         fear of any injury to that person, or to any other, and thereby<\/p>\n<p>         dishonestly induces the person so put in fear to deliver to any<\/p>\n<p>         person any property or valuable security, or anything signed or<\/p>\n<p>         sealed which may be converted into a valuable security commits<\/p>\n<p>         &#8220;extortion&#8221;. It would apparent from the definition of the offence<\/p>\n<p>         that the petitioner had neither demanded any money nor had he<\/p>\n<p>         threatened or put the complainant in any fear or in fact had any<\/p>\n<p>         interaction with the complainant and as such the offence under<\/p>\n<p>         Section 384 of the Indian Penal Code is not made out against this<\/p>\n<p>         petitioner.\n<\/p>\n<p>                       In the result, I quash the order of cognizance dated<\/p>\n<p>         30.12.2006, passed in Complaint Case No. C-I\/1286\/06 giving rise<\/p>\n<p>         to Trial No. 2058 of 2006.\n<\/p>\n<p>                       This application is allowed.\n<\/p>\n<\/p>\n<pre>Sanjay                                          ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Gopal Prasad Singh vs State Of Bihar on 21 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
